Staff requested a traffic study for the proposed development. The study determined that the development would yield an additional 30-40 trips during both A.M. (7:00 A.M. — 9:00 A.M.) and P.M. A) Vehicular and Pedestrian Circulation and Access to Private Property: The ROW is not currently being used, due to vegetation overgrowth. The existing sidewalk on the west side of Orchard Court will continue through the planned private drive. -MA B) Emergency and Utility Vehicle Access and Circulation: No emergency service access is currently provided in the ROW. The intended driveway will be accessible to emergency and utility service personnel. C) Impact on Access of Adjacent Private Properties The ROW has not been improved for public use. Staff has not been contacted by any adjacent residents stating that they use the ROW. D) Desirability of Right -of -Way for Access or Circulation Needs Staff is not aware of any desire from adjoining residents to maintain the ROW as a means of access. City staff has no plans for construction of infrastructure (roads, alleys, etc.) in the ROW. E) Location of Utilities and Other Easements or Restrictions on the Property One utility company has disclosed that they have fiber communication lines running beneath the ROW area. Unless the utility company abandons use of this area, the City will need to retain a utility easement over the utility area. F) Any Other Relevant Factors Pertaining to the Specific Requested Vacation The applicant has offered to purchase the area to be vacated. Council will review and consider the conveyance. "M Summary The subject ROW is currently not being used. The applicant intends to convert the ROW into a private driveway that can be used a means of access for both residents of the proposed multi- family development, and emergency response personnel. A rezoning of 1.75 acres of land to the south of the ROW area is contingent upon approval of this vacation. Approval of the ROW vacation and purchase offer-P&Z recommendation to City Council.
