Resolution Authorizing the Mayor to Execute and City Cleric to
attest permanent sanitary sewer and temporary construction
easement agreements with Monument Farms, LLC and
Harvest Preserve Foundation Inc. in connection with property
located at the northeast and northwest comers of the
intersection of Scott Boulevard and Rochester Avenue.
Comment Development of property at the northeast and northwest comer of Scott Blvd.
and Rochester Ave. will require the extension of sanitary sewer thereto. In anticipation of
development of the property and construction of the sanitary sewer extension, the owners
desire to dedicate the necessary sanitary sewer easements to the City.
8.c. Amending Budgeted Position - Transportation Services

Comment A review of the duties and responsibilities involved in overseeing evening
Transportation Services operations has prompted restructuring and reclassification of the
.75 FTE Operations Specialist position to 1.0 FTE Operations Supervisor. The
fiscal impact of the reclassification is $32,173.69 (step one) - $48,792.35 (max step).

Comment The project has been completed by Baker Mechanical Inc. of Ankeny,
Iowa, in substantial accordance with the plans and specifications. The Engineer's

9.a. Burlington and Madison Intersection Imroveents
Iq -a5 -7 pmResolution setting a public hearing on November 4, 2019 on
project manual and estimate of Cost for the construction of the
Burlington and Madison Intersection Improvements Project
(NHSX-001 -5(120)-3H-52), directng City Clerk to publish notice
of said hearing, and directing the City Engineer to place said
project manual on file for public inspection.
Comment This project includes the widening of Burlington Street from Madison Street to
Front Street to include cor tmxxas buffered bike lanes from Madison Street to Riverside
Drive. The project also includes traffic signal and pedestrian signal improvements, ADA
sidewalk improvements, and public utility improvements at the Burlington Stmt and
Madison Street intersection. The estimated cost of construction is $1,400,000 and will be
funded with STBG funds, 3R funds, and General Obligation bond proceeds.

Ordinance conditionally rezoning approAmately 1.6 acres of land
located at 305 and 315 East Prentiss Street and 625 South Gilbert
Street, from Intensive Commercial (CI -1) and Community
S� Commercial (CC -2) to Riverfront Crossings — Central Crossings
(RFC -CX). (REZ19-07).
Comment Al its meeting on September 5, 2019, by a vote of 6-0 (Parsons absent), the
Planning and Zoning Commission reoornnwxled approval of the rezoning subject to the
following conditions: 1) dedication of right -0f -way along S. Gilbert Street, 2) provision of an
access easement for the City to access the manhole for the trunk server boated neer the
SW corner of the property, 3) provision of an access easement for the City to access the
sanitary sewer line that runs through the SE portion of the property, 4) improvements of
Ralston Creek, including removal of invasive trees, addition of rip -rap, tree plading, and
dedication a temporary access easement vAhout compensation for the reconstruction of
the Prentiss Street Bridge, and 5) execution of an affordable housing agreement. Approval
of the regulating plan amendment is necessary before approval of this rezoning.

Ordinance amending Title 14, entitled "Zoning Code," Chapter 6, entitled
"Airport Zoning," to update the airport zoning requirements based on the
new Airport Layout Plan, dosing of the north/south runway, and changes
in FAA regulations.
Comment The airport zoning code mitigates nonoormpatible uses and hazards to safe air
navigation and was last updated in 2002. The proposed amendment reflects the new Airport
Layout Plan, dianges in FAA regulations, and tine dosing of the nor#Vsoulh runway. At its meeting
on Sept. 6, the Airport Zoning Commission recommended approval of the ordinance by
a vote of 5-0.

14. Disorderly Conduct and Disorderly House
Ordinance amending Tide 8, entitled "Police Regulations," Chapter 5,
entitled "Miscellaneous Offenses," to amend the ordinance so that it
ey,.& complies with a recent federal court decision. (First Consideration)
Comment On September 26, 2019 a federal judge in the Southern District of Iowa determined
that Iowa Code Section 723.4(2) was unconstitutionally vague because it did not contain a
required intent component or provide adequate notice of what conduct is prohibited. Because two
subsections of the CiVs disorderly conduct ordinance and its disorderly house ordinance were
drafted in a manner that closely followed section 723.4(2), we must amend the City Code to
comply with the recent federal decision.

15. Assessment Schedule
Resolution adopting an assessment schedule of unpaid mowing, dean -up
of property, snow removal, sidewalk repair, and stop box repair charges
and directing the Cleric to certify the same to the Johnson County Treasurer
for collection in the same manner as property taxes.
Comment The City has the aultwity under Iowa Code §364.136 to assess the nuisance
abatement costs in the same manner as a property tax This resolution allows the City Clerk to
certify to the .Johnson County Treasurer the abatement cost to be assessed against the property.
This assessment is being pursued only after the City took many steps to resolve the matter. The
City notified the homeowners to abate the nuisance (for example, to mmove snowfrom the
sidewalk) and alter the homeowner did not take aeon to abate the nuisance, the City abated the
nuisance and billed the owner. After being billed at Inst twice, these owners sti11 have not paid the
abatement costs. The City has sent a letter to the homeowner giving them notice that this
resolution would be on the agenda, a copy of which is attached to the resoludon. W interest will
be charged if the owner pays within 30 days of the first required publication. Attached as an exhibit
to the resolution is a Fist of the properties that wi be assessed and the amount that will be
assessed.
