• May 29, 2018:
• Council considered local landmark designation of 410-412 N. Clinton
Street
Deferred decision to January 2019 while staff explored a city-wide
transfer of development rights (TDR) program
August — November 2018:
Staff developed a draft TDR ordinance for historic properties
November 2018:
Council did not support the TDR ordinance
• January 2019:
• Council re -considered the local landmark designation
• Council supported the designation, but vote did not pass as a
supermajority was required
Background
January — December 2019:
Staff reached out to the property owner to explore options for a voluntary
local landmark designation
Property owner was open to exploring a scenario in which the City would
grant extra development potential for 400 N. Clinton Street & 112 E.
Davenport street in exchange for the local landmark designation of 410-412 N.
Clinton
Property owner submitted concepts for the redevelopment of 400 N. Clinton
Street & 112 E. Davenport Street
January 9, 2020:
Staff presented redevelopment option to HPC

• Concerns related to the demolition of 400 N. Clinton Street
• Willing to consider redevelopment in order to preserve 410-412 N. Clinton Street, if an
agreement includes provisions for:
Rehab of 410 N. Clinton Street in compliance with SOI standards for the exterior
• Ensuring a compatible use
• Design review on the rehab work from the Historic Preservation Planner and HPC
• Discussion of listing in the National Register and tax credits
• Design review of new building may include input from HPC

Comments Received
Friends of Historic Preservation
Recommended the following design changes:
Removing the 61h story
Allow the 51h story to be built without a stepback
Replaced gabled roof with a flat roof to reduce the scale of the building
Historic Preservation Commission
Concerned that historic properties are being held hostage; history of the community is
being leveraged for private gain.
Ideally 400 N. Clinton Street would also be saved.
Wants to work with the property owner to achieve an Iowa City Landmark Designation for
410-412 N. Clinton Street.
Current design is out of character with the existing neighborhood. Interested in exploring
the recommended changes to the design proposed by Friends.
Comments Received
Historic Preservation Commission (con't)
Expressed a need to explore the rehabilitation of the historic structure as part of the local
landmark designation.
Recommended transparency in the process in terms of public benefits vs. private gains.
Concerned that certain features of the built environment, such as height, are easily agreed
to without much thought to the impacts on the community.
Expressed an interest in exploring a more comprehensive solution. The Commission would
like to see a city-wide policy framework established (e.g. transfer of development rights)
rather than negotiate these situations on case-by-case basis.

Question for the Council
1. Does the City Council want staff to continue coordinating with the property owner
on the design of the building and draft the necessary code changes?
Are there certain code changes that the City Council would not support (e.g.
reduced parking, increased density, reduced open space)?
What type of design process does the City Council envision? A rezoning to PRM
would allow a multi -family building through the site plan review process, which is
an administrative process.
Are there other factors that the City Council would like staff to consider?
