CIVIC CENTER COUNCIL CHAMBERS MEMBERS PRESENT: Fisher, Messier, Randall, Winegarden MEMBERS ABSENT: Mask STAFF PRESENT: Beagle, Boyle, Moen, Van Steenhuyse SPECIAL EXCEPTION ITEMS: 1. SE -8634. A request submitted by Master Muffler Shops (Marvin Swafford) for a special exception to expand an auto and truck oriented use in the CC -2, Commu- nity Commercial, zone for property located at 510 South Riverside Drive, was approved 4-0, subject to, the applicant's site plan dated January 26, 1987, and the condition that replacement of vegetation along the bank of the Iowa River be made in conformance with the screening requirements of the Zoning Ordinance in the event the existing vegetation is removed, destroyed, or washed away. 2. SE -8636. A request submitted by the Diocese of Davenport (Newman Center) for a special exception to permit the expansion of a religious institution for property located at 104 East Jefferson Street, was approved 4-0, subject to compliance with the applicant's site plan dated January 27, 1987. 3. SE -8701. A request submitted by Lena Hoffineier-Burks for a special exception o mo ify the required front yard of the RS -5 zone from 20 feet to 0 feet on Highland Avenue for property located at 1401 Keokuk Street, was approved subject to the following conditions: 1. That the reduction be restricted to the location of the fence no greater than 6 feet 5 inches in height as identified on the applicant's site plan, with all other buildings and structures being subject to the setback requirements of the RS -5 zone. 2. That the special exception apply only to the fence and continue to be valid as long as the fence is not altered, enlarged, or otherwise expanded. The fence may, however, be repaired, replaced, removed, reduced in height, or set back further from the street. 3. That the proposed fence and hedge amendments are passed so as to allow the fence to remain on the front property line. APPEALS TO THE BOARD OF ADJUSTMENT: 1. A-8701. A request submitted by Benjamin P. Chait to appeal an interpretation by the City Manager that, by definition, an awning without script composed of translucent material with lights underneath mounted in such a way as to allow the light to shine through the material is an illuminated awning and consti- tutes a sign and is, therefore, subject to the requirements of the sign regu- lations of the Zoning Ordinance. SE -8703. A request submitted by Trinity Christian Reformed Church for a speciaT exception to permit the expansion of a religious institution in an RS -5 zone for property located at 2908 Raven Street was approved by a vote of 5-0. On a separate motion, a request by Trinity Christian Reformed Church for a special exception to modify the front yard requirements in the RS -5 zone from 34 feet to 20 feet for property at the above address, was approved by a vote of 5-0, subject to the condition that: the exception granted is only to the extent necessary to permit projection of the addition in the minimum yard required along Court Street as shown on the site plan file stamped March 5, 1987. VARIANCE ITEMS: 1. Approved by a vote of 4-0, a request submitted by Old Brick/Lutheran Corporation for a special exception to reduce the parking requirements for uses at 26 East Market Street provided: a. that the uses in the building consist of religious institutions, offices for non-profit organizations, or other uses permitted in the CO -1 zone with parking requirements which are no greater than one off-street parking space for each 200 square feet of floor area, b. that the sanctuary located on the second floor of the sanctuary wing of the building continues to be used only as a religious auditorium or as an auditorium for public and private events, and c. that no change in appearance of the exterior features of the building or of the site for which a regulated permit is required shall be undertaken unless a Certificate of Appropriateness or a Certificate of No Material Effect has been granted by the Iowa �n eo ity Historic Preservation Commission.
