They had been in operation since 1988 and were approaching the end of their useful life. In addition, the systems were also not able to provide consistent heating and cooling, resulting in numerous patron complaints regarding water and air temperatures. The new systems were integrated into the City's existing Building Automation System, and this project will reduce operating costs and energy consumption in this facility. The City of Iowa City Supplemental Specifications have been revised to address needed changes. Staff recommends adopting the revised City of Iowa City Supplemental Specifications. Background /Analysis: The City has previously adopted the use of Statewide Urban Design and Specifications (SUDAS) specifications and City supplemental specifications. Most recently, in Resolution 20-1, dated January 7, 2020, the City of Iowa City adopted the use of the SUDAS Standard Specifications (2020 Edition), SUDAS General Supplemental Specifications, and the City of Iowa City Supplemental Specifications (January 2020). During construction of public improvement projects and other work with City right-of-way, issues can arise that may not be adequately covered by the City's existing specifications. City staff regularly evaluates these issues, and recommends revisions to the specifications as needed. To reflect recent, needed functional and technical changes, the City of Iowa City Supplemental Specifications have been revised. The revised City of Iowa City Supplemental Specifications have been placed on file with the City Engineer's Office, and will be made available for use in the construction of public improvements and construction within the public right-of-way within the City of Iowa City. This rehabilitation of pipes is one of the components of the City's annual sanitary sewer repair and replacement program. Background /Analysis: This project includes lining approximately 10,600 linear feet of sanitary sewer pipe, reinstatement of approximately 236 service connections, and other associated work for locations near the following addresses: 1116 and 1400 Block of Buresh Avenue; 1400 — 1600 West Benton Street; 1400 — 1600 Blocks of Derwen Drive; Arbury Drive; 6-48 Denbigh Drive; Penfro Drive; 1545 and 1950 Delwood Drive; 1912 and 1918 Flatiron Avenue; 1700-1900 Blocks of Flatiron, Gleason, and California Avenues; Grant Wood Drive; Aniston Street; Amber Lane; Regal Lane; and 1900 — 2300 Blocks of Lakeside Drive. AECOM Technical Services, Des Moines, Iowa developed the design for this project and is assisting City staff during bidding, letting, and construction. A preliminary assessment indicates proposed improvements require the acquisition of property for right-of-way, temporary construction easement and permanent storm water easement from property owners adjacent to the project construction limits. Background /Analysis: Melrose Avenue / IWV Road is in poor condition and requires reconstruction to current design standards in order to serve the current and anticipated future transportation needs of the region. The roadway will be widened to include two 12 foot lanes with a 5 foot paved shoulder and a 3 foot gravel shoulder on both sides. Driveway improvements will be made as necessary and five storm water culverts under Melrose Avenue / IWV Road will be replaced to maintain and improve drainage. A 12" water main will be extended on the north side of Melrose Avenue / IWV Road from the existing water main stub at Slothower Road to Hebl Avenue, where it will continue on the east side of the roadway to the Iowa City Landfill and Recycling Center. The City contracted with Anderson -Bogert Engineers & Surveyors, Inc. in July, 2019 to provide consulting services, prepare and administer property acquisitions, and to provide construction administration services. Final design plans will be submitted to the Iowa Department of Transportation for an April 2021 bid letting. A 28E Agreement between the City of Iowa City and Johnson County was approved in May, 2019 to share Engineering Design, Construction Management and Construction costs. The City will be responsible for necessary acquisitions within the City limits and/or related to the City's water main extension, while Johnson County will be responsible for the remaining acquisitions. Kisner Kennedy Enterprises, LLC PO Box 2000 Iowa City IA 52244-2000 Johnson County Iowa 913 S Dubuque Street, Suite 101 Iowa City IA 52240 Chapter 613 of the Iowa Code requires a governmental body that proposes to acquire property rights under power of eminent domain for a public improvement project to give notice of the project to all agricultural property owners whose properties may be affected and to hold a public hearing. DESCRIPTION OF THE PROJECT. NOTICE IS HEREBY GIVEN to the above -identified agricultural property owners that the City Council of the City of Iowa City will consider funding of the site-specific design for the Melrose Avenue / IWV Road — Highway 218 to Hebl Avenue Improvements Project, making the final selection of the route or site location, or acquiring or condemning property rights, if necessary, required for the project at a public hearing to be held on August 18, 2020. If the above-described project is approved by the City Council, the City may need to acquire property rights for the project improvements. Property rights may include a temporary construction easement, a permanent easement, and/or a fee simple parcel (complete ownership). Upon review of the records of the Johnson County Auditor, it appears that properties or portions of properties owned by the above -identified persons may have to be acquired for the project by the methods described above. The City will attempt to purchase the required property by good faith negotiations. If negotiations are unsuccessful, the City will condemn those property rights which it determines are necessary for the project. The proposed location of the above-described public improvement is shown on documentation which is now on file in the office of the City Clerk and available for public viewing. 3. CITY PROCESS TO DECIDE TO PROCEED WITH THE PROJECT AND TO ACQUIRE PROPERTY RIGHTS; CITY COUNCIL ACTION REQUIRED TO FUND PROJECT. The City has provided funding in its budget for this project, as well as funding to acquire any property rights that may be needed for the project. City staff has analyzed the options for how to proceed with this project and has coordinated project planning with other appropriate agencies. The planning has reached the point where preliminary designs now indicate that certain property rights may need to be acquired. Any public comment will be considered in preparing the final designs, particularly as private property may be affected. In making the decision to fund the site-specific design for the public improvement, to make the final selection of the route or site location, or to acquire or condemn property rights, if necessary, the City Council is required to hold a public hearing, giving persons interested in the proposed project the opportunity to present their views regarding the decision to fund the site-specific designs for the project, make the final selection of the route or site location, or to acquire or condemn, if necessary, property or an interest in property for the project. The public hearing will be held on the 18th day of August, 2020 in the City Council Chambers, City Hall, 410 East Washington Street, Iowa City, Iowa, commencing at 7:00 p.m. or, if cancelled, at the next meeting of the City Council thereafter as posted by the City Clerk. The Melrose Avenue / IWV Road — Highway 218 to Hebl Avenue Improvements Project will include reconstruction of the roadway from Highway 218 to Hebl Avenue and extension of water main from Slothower Road to the Iowa City Landfill, which project is to be known as the Melrose Avenue / IWV Road — Highway 218 to Hebl Avenue Improvements Project. Property rights acquisition may include right of way, temporary construction easement, and permanent storm sewer from property owners within the project corridor. Recommendations: Staff: Approval Commission: Attachments: Heinz Road Amendment #2 Resolution of Necessity Executive Summary: This Amendment will allow the City to enter into agreements with businesses and industrial users to provide economic development assistance for projects that improve the energy efficiency of businesses and industrial users located within the urban renewal area. The goal is to reduce carbon emissions required to power their operations and help the City achieve a 45% reduction in carbon emissions by 2030. According to the Accelerating Iowa City Climate Actions report, industrial users account for 27% of Iowa City's carbon emissions and commerical users account for another 20%. Due to the urgency of meeting emissions goals and the extent of industrial and commercial energy usage, the City has established a program to directly assist local businesses as they pursue greater building efficiency and emissions reduction measures. Background /Analysis: On August 6, 2019, Council declared a Climate Crisis and called on staff to prioritize action to address the climate crisis and limit global warming. To that end, Council adopted the Intergovernmental Panel on Climate Change (IPCC) targets of a 45% reduction in carbon emissions by 2030 and reaching "net -zero" by 2050. In 2007, the City of Iowa City took its first deliberate step to address Climate Change by signing the U.S. Mayor's Climate Protection Agreement. In 2008, the Council agreed to participate in the "Cities for Climate Protection Campaign." In 2009, the City completed the first greenhouse gas inventory in the state. The Mayor signed the updated U.S. Climate Protection Agreement in 2014 and the Council set greenhouse gas emissions reduction goals in 2016. The next year a Climate Action Steering Committee was formed to provide input on the development of a Climate Action Plan. Comprised of and representing many stakeholders in the community, the committee sought and received public input to guide planning efforts. In 2017, Council adopted the Iowa City Climate Action and Adaptation Plan. The Buildings section of the Action Plan includes among its goals, a) increasing energy efficiency in businesses and b) increasing on-site renewable energy systems and electrification. In 2019, Council increased the carbon emission reduction targets, declared a Climate Crisis, and requested a report to accelerate the City's identified climate actions. The resulting 2020 Accelerating Climate Actions report has a "Buildings: Incentives" section which includes the following action: "Launch a TI F -funded climate action incentive program aimed at reducing industrial energy consumption". This initiative, geared towards energy efficiency, renewable energy sources, electrification and site improvements that will help reduce emissions is labeled as Phase 1, slated for initiation in 2020. By addressing facility inefficiencies, users will reduce costs and by reducing energy use, they will reduce greenhouse gases emitted at power plants (Energy Star, U.S. Environmental Protection Agency). To encourage industry to make the sizeable investments required to improve energy efficiency, companies could apply for economic development assistance for eligible energy efficiency improvements. While upfront costs are significant, companies that make energy efficiency improvements will begin to see an immediate return by a reduction of their energy costs. Over time, the cumulative reduction in carbon emissions required to operate the business will be better for the planet. The Heinz Road Urban Renewal Area was established in 2002 to attract new business, boost business retention and expansion, and retain and attract newjobs to the area. The base year value was set in 2001 for tax increment financing rebate projects with United Natural Foods Inc. and Alpla. Those rebates ended in 2011 and since then, the taxable valuation of the area has increased by more than $21 M, and is now creating an unused available tax increment of more than $640,000 each year. The sunset for this TI F district is FY25, leaving only 4 fiscal years from which to collect increment. The project amount detailed in this Amendment #2 of $2.5 million would allow for the maximum use of available increment, but likely would not approach the full amount. This tax increment, generated from taxes paid by property owners in this industrial area, would be used for matching grants on qualified industrial energy efficiency improvements. Owners would apply for the funds, projects would be vetted by professionals or contractors in the energy efficiency industry, and owners would enter into a development agreement, subject to City Council approval. The amendment to this plan seeks to assist users achieve those goals. SECTION 3 — DESCRIPTION OF THE URBAN RENEWAL AREA The legal description of the area is attached hereto as Attachment No. 1. SECTION 4 — AREA DESIGNATION 2 This area remains an economic development area, as that term is defined in the Iowa Code Chapter 403. SECTION 5 — PROPOSED URBAN RENEWAL PROJECTS The eligible urban renewal projects under this Urban Renewal Plan include: Development Agreements Enter into development agreements with industrial users in the Urban Renewal Area to provide economic development assistance for projects that include improvements to the facilities making them more energy efficient. The proposed Urban Renewal Projects contemplated by this Amendment No. 2 may require evaluation by a qualified third -party engineering firm to determine and recommend the optimal energy efficiency solutions for industrial companies. Projects may range from adjustments to existing systems to the installation of new systems. They may include a change -over from natural gas to electric energy to the installation of solar panels to reduce carbon emissions. Recommendations: Staff: Approval Commission: Attachments: Amendment #2 Scott Six Urban Renewal Area Resolution of Necessity Executive Summary: This Amendment will allow the City to enter into agreements with businesses and industrial users to provide economic development assistance for projects that improve the energy efficiency of businesses and industrial users located within the urban renewal area. The goal is to reduce carbon emissions required to power their operations and help the City achieve a 45% reduction in carbon emissions by 2030. According to the Accelerating Iowa City Climate Actions report, industrial users account for 27% of Iowa City's carbon emissions and commerical users account for another 20%. Due to the urgency of meeting emissions goals and the extent of industrial and commercial energy usage, the City has established a program to directly assist local businesses as they pursue greater building efficiency and emissions reduction measures. Background /Analysis: On August 6, 2019, Council declared a Climate Crisis and called on staff to prioritize action to address the climate crisis and limit global warming. To that end, Council adopted the Intergovernmental Panel on Climate Change (IPCC) targets of a 45% reduction in carbon emissions by 2030 and reaching "net -zero" by 2050. In 2007, the City of Iowa City took its first deliberate step to address Climate Change by signing the U.S. Mayor's Climate Protection Agreement. In 2008, the Council agreed to participate in the "Cities for Climate Protection Campaign." In 2009, the City completed the first greenhouse gas inventory in the state. The Mayor signed the updated U.S. Climate Protection Agreement in 2014 and the Council set greenhouse gas emissions reduction goals in 2016. The next year a Climate Action Steering Committee was formed to provide input on the development of a Climate Action Plan. Comprised of and representing many stakeholders in the community, the committee sought and received public input to guide planning efforts. In 2017, Council adopted the Iowa City Climate Action and Adaptation Plan. The Buildings section of the Action Plan includes among its goals, a) increasing energy efficiency in businesses and b) increasing on-site renewable energy systems and electrification. In 2019, Council increased the carbon emission reduction targets, declared a Climate Crisis, and requested a report to accelerate the City's identified climate actions. The resulting 2020 Accelerating Climate Actions report has a "Buildings: Incentives" section which includes the following action: "Launch a TI F -funded climate action incentive program aimed at reducing industrial energy consumption". This initiative, geared towards energy efficiency, renewable energy sources, electrification and site improvements that will help reduce emissions is labeled as Phase 1, slated for initiation in 2020. To encourage industry to make the sizeable investments required to improve energy efficiency, companies could apply for economic development assistance for eligible energy efficiency improvements. While upfront costs are significant, companies that make energy efficiency improvements will begin to see an immediate return by a reduction of their energy costs. Over time, the cumulative reduction in carbon emissions required to operate the business will be better for the planet. By addressing facility inefficiencies, users will reduce costs and by reducing energy use, they will reduce greenhouse gases emitted at power plants (Energy Star, U.S. Environmental Protection Agency). The Scott Six Industrial Area was established in 1997 to attract new business, boost business retention and expansion, and retain and attract new jobs to the area. The base year value was set in 2001 for a tax increment financing rebate project with Owens -Brockway for an expansion. Those rebates ended in 2009 and since then, the taxable valuation of the area has increased by more than $45M, and is now creating an unused available tax increment of more than $1.36 million each year. Time is of the essence, however, as the sunset for this TI F district is FY23, leaving only 2 fiscal years from which to collect increment. The project amount detailed in the Amendment #2 of $2.7 million would allow for the maximum use of available increment, but likely would not approach the full amount. This tax increment, generated from taxes paid by property owners in this industrial area, would be used for economic assistance for qualified industrial energy efficiency improvements. Owners would apply for the funds, projects would be vetted by professionals or contractors in the energy efficiency industry, and owners would enter into a development agreement, subject to City Council approval. The amendment to this plan seeks to assist users achieve those goals. SECTION 3 — DESCRIPTION OF THE URBAN RENEWAL AREA The legal description of the area is attached hereto as Attachment No. 1. SECTION 4 — AREA DESIGNATION 2 This area remains an economic development area, as that term is defined in the Iowa Code Chapter 403. Recommendations: Staff: Approval Commission: Attachments: Amendment #3 Sycamore and First Resolution of Necessity Executive Summary: This Amendment will allow the City to enter into agreements with businesses and industrial users to provide economic development assistance for projects that improve the energy efficiency of businesses and industrial users located within the urban renewal area. The goal is to reduce carbon emissions required to power their operations and help the City achieve a 45% reduction in carbon emissions by 2030. According to the Accelerating Iowa City Climate Actions report, industrial users account for 27% of Iowa City's carbon emissions and commerical users account for another 20%. Due to the urgency of meeting emissions goals and the extent of industrial and commercial energy usage, the City has established a program to directly assist local businesses as they pursue greater building efficiency and emissions reduction measures. Background /Analysis: On August 6, 2019, Council declared a Climate Crisis and called on staff to prioritize action to address the climate crisis and limit global warming. To that end, Council adopted the Intergovernmental Panel on Climate Change (IPCC) targets of a 45% reduction in carbon emissions by 2030 and reaching "net -zero" by 2050. In 2007, the City of Iowa City took its first deliberate step to address Climate Change by signing the U.S. Mayor's Climate Protection Agreement. In 2008, the Council agreed to participate in the "Cities for Climate Protection Campaign." In 2009, the City completed the first greenhouse gas inventory in the state. The Mayor signed the updated U.S. Climate Protection Agreement in 2014 and the Council set greenhouse gas emissions reduction goals in 2016. The next year a Climate Action Steering Committee was formed to provide input on the development of a Climate Action Plan. Comprised of and representing many stakeholders in the community, the committee sought and received public input to guide planning efforts. In 2017, Council adopted the Iowa City Climate Action and Adaptation Plan. The Buildings section of the Action Plan includes among its goals, a) increasing energy efficiency in businesses and b) increasing on-site renewable energy systems and electrification. In 2019, Council increased the carbon emission reduction targets, declared a Climate Crisis, and requested a report to accelerate the City's identified climate actions. The resulting 2020 Accelerating Climate Actions report has a "Buildings: Incentives" section which includes the following action: "Launch a TIF -funded climate action incentive program aimed at reducing industrial energy consumption". This initiative, geared towards energy efficiency, renewable energy sources, electrification and site improvements that will help reduce emissions is labeled as Phase 1, slated for initiation in 2020. To encourage industry to make the sizeable investments required to improve energy efficiency, companies could apply for economic development assistance for eligible energy efficiency improvements. While upfront costs are significant, companies that make energy efficiency improvements will begin to see an immediate return by a reduction of their energy costs. Over time, the cumulative reduction in carbon emissions required to operate the business will be better for the planet. By addressing facility inefficiencies, users will reduce costs and by reducing energy use, they will reduce greenhouse gases emitted at power plants (Energy Star, U.S. Environmental Protection Agency). The Sycamore and First Avenue Urban Renewal Area was established in 2000 to attract new business, boost business retention and expansion, and retain and attract new jobs to the area. The base year value was set in 1999 for tax increment financing rebate projects with the Sycamore Mall and Plamor redevelopment. Those rebates ended in 2012. In 2003, the Area was amended to add land including Procter & Gamble and the MidAmerican Energy properties. In 2014, a second amendment was made for a new project with Iowa City Marketplace. That project has defaulted on their agreement, leaving unused available increment of approximately $440,000 in the single remaining fiscal year of the plan. The sunset for this TI F district is FY22, leaving one fiscal year from which to collect increment. The project amount detailed in the Amendment #3 of $425,000 would allow for nearly the full use of available increment. This tax increment, generated from taxes paid by property owners in this area, would be used for economic assistance for qualified industrial energy efficiency improvements. Owners would apply for the funds, projects would be vetted by professionals or contractors in the energy efficiency industry, and owners would enter into a development agreement, subject to City Council approval. The Sycamore and First Avenue Area was originally adopted in 2000 pursuant to resolution 00-295; amended in 2003 pursuant to Resolution 03-157 to add land to the area; and amended in 2014 pursuant to Resolution 14-301 to add a project. The base valuation of the area will be unchanged by this Amendment. SECTION 2 — URBAN RENEWAL GOALS AND OBJECTIVES The Urban Renewal Goals and Objectives previously set forth in the Original Plan and Amendments No. 1 and 2 remain unchanged by this Amendment. This Amendment No. 3 adds the goal of reducing carbon emissions by helping users of industrial facilities in the Urban Renewal Area improve energy efficiency. The amendment to this plan seeks to assist users achieve those goals. SECTION 3 — DESCRIPTION OF THE URBAN RENEWAL AREA The legal description of the area is attached hereto as Attachment No. 1. SECTION 4 — AREA DESIGNATION This area remains an economic development area, as that term is defined in the Iowa Code Chapter 403. Personal note: The Bicycle Advisory Council met in late June to discuss this decision. Originally, this section was supposed to have bike lanes. However, the road width is the bare minimum for what would allow a bike lane. Here's a note from the meeting: BACmembers discussed the benefits and drawbacks of bike lanes in these constrained situations. Shared lane markings were also considered. Those in attendance indicated that the minimum lane widths in these situations were problematic and might not function to provide a safe and comfortable route for bicyclists. Sharrows were not viewed as an effective or useful substitution. Instead, members recommended prioritizing establishing alternate routes as bike boulevards, including Sheridan, Summit, 7th Avenue, and College Street. We also discussed having a "bike may use full lane" sign in the section where there are sharrows proposed. Regarding Muscatine Ave, however, I see that the proposal is Muscatine Avenue bike lanes from Iowa Ave to Burlington Street and sharrows from Burlington Street to 2nd Avenue. This last portion comes as both a stray from the 2017 IC Bike Master Plan (which proposed buffered bike lanes along Muscatine) and a disappointment. I think adding proper bike lanes (particularly buffered version) would serve not only to accommodate bicyclists, but would also act as a traffic -calming measure, as it would help to slow traffic given narrower lanes. I urge you to challenge the proposed sharrows in favor of a more aggressive and inclusive approach (buffered bicycle lanes would accommodate more hesitant riders and families much better). I bring these views from the perspective of a transportation safety researcher with a PhD in injury epidemiology and also as a mother, IC resident, and bicyclist myself. But I do try stick to trails, lanes, or lesser -used roads when going through town. As a residential taxpayer and a motor vehicle owner who contributes to the road use tax fund through fuel taxes (and registration fees?), I urge you to invest in infrastructure that makes the roads safer for cyclists, pedestrians, and motor vehicles. Designated spaces for different modes of transportation improves safety for all, not just cyclists, as does slowing traffic by designing narrower motor vehicle lanes. Bike commuting and walking to work or school reduces motor vehicle traffic and air pollution, promotes healthier living and exercise, and adds community vibrancy and engagement. Muscatine and Dodge are wide roads, which encourages speeding. In residential areas like these, traffic should be slowed. Despite being designed for motor vehicles, these routes are part of the transportation network for cyclists. In addition, as part of the Muscatine Ave. project, please install a pedestrian crossing island where the multi -use trail crosses Muscatine Ave. to Creekside Park similar to where the trail crosses First Avenue near Hy -Vee. The First Ave crossing does a great job slowing traffic in this busy area as well as provide a protected area to make it much safer for pedestrians and cyclists. Background /Analysis: This resolution authorizes staff to issue $253,802.02 in credit from the Parking Fund and the Transit Fund to permit holders and hotels with parking agreements during the period the general public was not charged for hourly parking in facilities. $189,318 would come from the Parking Fund and $64,484 would come from the Transit Fund. The parking credits are split between the two funds as parking proceeds from the Court Street Transportation Center are federally designated for transit use only. The current Parking Fund balance is approximately $2,539,973; however, we anticipate paying just over $600,000 for the Augusta Place parking facility which would reduce the total fund balance to approximately $1,939,973. Parking Fund revenues are beginning to increase again as businesses began reopening downtown. During June (preliminary figures), current Parking Fund expenses total $268,225 while current revenues total $333,266, for a net surplus of $65,041. This is a significant increase in net surplus from April and May when the Parking Fund operated at a net loss of approximately $328,193 and $183,214, respectively. The Transit Fund balance is approximately $1,692,854. We are expecting to receive approximately $1,700,000 in annual FY20 federal operating assistance for transit within the upcoming weeks for a forecasted balance of $3,392,854. During May, Iowa City was allocated $5,109,870 in emergency federal CARES Act funding to support the transit system during COVID-19. The CARES Act funds will be drawn down incrementally through reimbursement of transit related expenses. The funds are designated to help offset the costs and revenue loss related to maintaining service during and recovering from the pandemic. The emergency funds, which are of tremendous assistance to operations at this time, do not expire and will be available until expended. The parking credit amount for each customer was calculated by taking 56 days (the number of days that parking facility fees were suspended) multiplied by the average daily cost of the permit or agreement. Upon approval, the credits would be applied to customers accounts in July. When the customer is invoiced for their next permit (quarterly, or annually depending on the length of permit) they will be notified of the credit and will be billed for the remaining balance due. The issuance of this parking credit will help ensure that parking fees are more equitably assessed to all parking customers during COVI D-19. The City had passed such a resolution on February 15th, 2011, and posted signs on its buildings and buses warning of the weapons prohibition. In order to avoid a violation of revised Iowa Code section 724.28, Resolution No. 11-55 should be rescinded. Background /Analysis: Under current State law, persons with a permit to carry a firearm can do so, even within the limits of a city, in an open or concealed manner. Local Sheriffs, responsible for issuance of the permits, are required to issue the permits, even against their best judgment, if the applicant is not disqualified for any of the specific reasons listed in Iowa Code 724.8. Local governments can prohibit firearms and other dangerous weapons from their buildings only if they both screen all those who enter the buildings for weapons, and provide armed security personnel in each such building. The City could implement those requirements for singular events that warrant that level of security, but would not want to do so for every building all the time. In order to avoid costly litigation and payment of attorney fees and costs, the City should rescind the earlier resolution. City staff will work to ensure the safety of the public and City employees and officials to the best of their ability. I attended and participated in a number of City Council meetings last year (deer management?) and witnessed first-hand the heightened emotions evoked by any number of the issues that you considered in members of our community. City Council meetings most certainly should be gun -free opportunities for community members to make their case without fear for their lives. And for goodness' sakes, no one should be carrying in our public library or parks. I appreciate the efforts that the City has made since 2011 when the state became a Right to Carry state. It is unfortunate that the folks in Des Moines are once again limiting our ability to conduct a community's activities in the manner agreeable to its members. Whereas, the City of Iowa City, to preserve the safety of the public and City employees and officials, prohibited the presence of firearms and weapons in and on property owned, leased, or otherwise occupied by the City of Iowa City in Resolution No. 11-55, adopted on February 15, 2011; and Whereas, on June 251, 2020, Governor Kim Reynolds signed House File 2502, which amended Iowa Code section 724.28 to preempt cities, counties, and townships from enacting any 'ordinance, motion, resolution, policy, or amendment regulating the ownership, possession, legal transfer, lawful transportation, modification, registration, or licensing of firearms, firearms attachments, or other weapons when the ownership, possession, transfer, transportation, or modifications is otherwise lawful under the laws of this state"; and Whereas, local governments can prohibit firearms and other dangerous weapons from their buildings only if they both screen all those who enter the buildings for weapons, and provide armed security personnel in each such building; and Whereas, this is the 2n1 effort by the State legislature to preempt cities, counties, and townships from enacting the kind of resolution adopted by this City Council through Resolution No. 11-55; and Whereas, House File 2502 also states that a person "adversely affected" by the "ordinance, measure, enactment, rule, resolution, motion, or policy may file suit" against the city, seeking damages, as well as reasonable attorney fees and court costs; and Whereas, the amendment to Iowa Code section 724.28 is effective July 1, 2020; and Whereas, in order to avoid costly litigation and payment of attorney fees and costs, the City must rescind the earlier resolution; and Whereas, City staff will work to ensure the safety of the public and City employees and officials to the best of their ability. Background /Analysis: The City has the authority under Iowa Code §364.13B to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. This assessment is being pursued only after the City took many steps to resolve the matter. The City notified the homeowners to abate the nuisance (for example, to remove snow from the sidewalk) and after the homeowner did not take action to abate the nuisance, the City abated the nuisance and billed the owner. After being billed at least twice, these owners still have not paid the abatement costs. The City has sent a letter to the homeowner giving them notice that this resolution would be on the agenda, a copy of which is attached to the resolution. No interest will be charged if the owner pays within 30 days of the first required publication. Whereas, the City Clerk has filed with the City Clerk an assessment schedule providing the amount to be assessed against certain lots for the actual unpaid abatement costs of mowing, cleaning up property, removing snow, repairing sidewalks, and repairing stop boxes in the same manner as property taxes; Whereas, said schedule is attached as Exhibit A to this resolution and incorporated herein by this reference; Whereas, Iowa Code § 364.13B authorizes the City Council to assess against the property said abatement costs in the same manner as property taxes; and Whereas, the City Council finds that the property owners listed in Exhibit A have received a written notice of the date and time of the public hearing on the adoption of said assessment schedule, in substantially the same form attached hereto as Exhibit B. Thank you for all that you are doing to keep us all safe and protected. We all greatly appreciate your efforts and guidance. I received a letter from the City of Iowa City that the City Council will be considering a resolution today that will assess against my property the cost the city has incurred for weed removal at my property last year. The bill amount is $247 for weed removal and $100 for Administrative fee for a total of $347. 1 do not owe the City of Iowa City any money, rather the City of Iowa City came to my property and destroyed my vines and crops at my property without any notification. If the City of Iowa City needs donations, I will be willing to donate this money to the city. This was not about enforcing city code or ordinance. Rather, it was about a racist and bigoted city employee, Brian Jensen's reterliation against me for challenging his competency by harassing and intimidating me at my property by abusing his authority. I am still considering filing a lawsuit against the city for this unpleasant experience. I am planning on attending the City Council Meeting this evening to give my side of the story if you are interested to hear from me. Thank you for your time and attention to this email message.
