The project has been completed by Municipal Pipe Tool Company, LLC of Hudson, Iowa, in
substantial accordance with the plans and specifications. The Engineer's Report and
Performance and Payment bonds are on file with the City Clerk.

Background /Analysis:
The 2018 Annual Sewer Rehabilitation Project is part of ongoing sanitary sewer maintenance that
included Cured -In -Place Pipe (C I PP) lining work at the following sites:

Dear City Clerk:
I hereby certify that the 2018 Annual Sewer Rehabilitation Project has been completed by
Municipal Pipe Tool Company, LLC of Hudson, Iowa in substantial accordance with the plans
and specifications prepared by AECOM Technical Services, Inc., of Des Moines, Iowa.
The project was bid as a unit price contract and the final contract price is $300,355.97.
There was a total of one (1) change or extra work order for the project as follows:

Resolution accepting the work for the 2018 Annual Sewer
Rehabilitation Project
Whereas, the Engineering Division has recommended that the work for construction of the 2018
Annual Sewer Rehabilitation Project, as included in a contract between the City of Iowa City and
Municipal Pipe Tool Company, LLC of Hudson, Iowa, dated March 5, 2019 be accepted; and
Whereas, the Engineer's Report and the performance, payment and maintenance bond have been
filed in the City Clerk's office; and
Whereas, funds for this project are available in the Annual Sewer Repair account # V3101; and
Whereas, the final contract price is $300,355.97.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa, that said
improvements are hereby accepted by the City of Iowa City, Iowa.

The applicant, Advantage Development, Inc., has requested a final subdivision plat for the
10.06 -acre project area located at south of American Legion Rd. and northwest of Wapsi
Ave SE. in unincorporated Johnson County. The requested platting is to subdivide the
subject property into six lots for development of future single-family housing.
The owner of the subject property submitted an application for a rezoning to Johnson
County for an (R) Residential zoning designation in October of 2018. Because of the
City/County Fringe Area Agreement, this rezoning request was also reviewed by the Iowa
City Planning and Zoning Commission. Because the requested zoning conflicted with the
Fringe Area Agreement, which called for primarily agricultural uses, the rezoning was not
recommended by the Planning and Zoning Commission or City Council. However, in
January of 2019, a conflict resolution committee consisting of representatives of the City
Council, the Johnson County Board of Supervisors, and City and County staff met to further
discuss the rezoning. After additional consideration, the City Council withdrew its
opposition to the rezoning, and recommended that the rezoning from County Agricultural
(A) to County Residential (R) be approved.
In June 2019, City Council approved the preliminary plat. There are several non -substantive
differences between the approved preliminary plat and the final plat. The approved
preliminary plat was called the Bluegrass Ridge subdivision was called Bluegrass Ridge,
and it contained seven lots for development of future single-family housing, with an outlot
for stormwater management. The final plat has been renamed to Rolling Prairie Estates,
and contains six lots for development of future single-family housing. The local street
names have been changed from Declan Drive SE and Maddi Lane SE to Rolling Prairie
Drive and Hillcrest Lane SE, respectively. The preliminary plat included a third street,
Mitchell Street SE, that stemmed off of American Legion Road into a cul-de-sac. This street
has been removed from the proposed final plat. The preliminary plat included an outlot on
the east side of Mitchell Street SE for future development. This outlot is not included in the
proposed final plat.
Because the subject property is in the area designated within the Iowa City/Johnson County
fringe area, the subdivision must be approved simultaneously by the City and by Johnson
County. As the subject property is in the Fringe Area "B", outside of the growth area, it is
not required to conform to the City's Urban Design Standards. The subject property is

located about 1.76 miles east of the eastern city limits.
The subdivision must attain approval by the Iowa City Council before action can be taken
by the Johnson County Board.
ANALYSIS:
Compliance with the Comprehensive Plan: The Fringe Area agreement has designated this
area as Fringe Area "B" outside of the growth area. The Fringe Area agreement calls for
primarily agricultural uses in this area, but does allow some flexibility for other uses that
fall within the Johnson County Land Use Plan, and are consistent with uses in a
Rural/Agricultural area. The Johnson County Land Use Plan does call for residential use in
the subject area. The subject property is zoned Residential (R) under the Johnson County
zoning ordinance. This zoning designation requires a minimum lot size of 40,000 square
feet and allows single-family land uses. The proposed final plat conforms with the
Residential (R) zone district and the Johnson County comprehensive plan.
Subdivision Design: The proposed subdivision splits the subject property into six separate
lots, ranging in size between 1.16 and 1.40 acres (without right-of-way). Two new streets
will be built in the subdivision. Rolling Prairie Drive will have direct access to American
Legion Rd. SE. Hillcrest Lane SE will be equipped with a hammer -head turnaround to
accommodate emergency vehicle access. If Hillcrest Lane SE is ever extended to the west,
the turnaround easement areas will be vacated. City staff would typically require a 60' right-
of-way on local streets in the Fringe Area. However, because the current iteration of the
Fringe Area Agreement does not specifically require a 60' wide right-of-way in Fringe Area
"B" outside of the City's Growth Boundary, and due to the remote chance that the subject
property is ever annexed into the City, Public Works staff has agreed to allow the 50' wide
right-of-way that is shown on both Rolling Prairie Drive and Hillcrest Lane SE.
Environmentally Sensitive Areas: The subject property does not contain any
environmentally sensitive areas.
Storm Water Management: Stormwater management will be provided by installation of a
wet detention pond, located to the south of the subject property on land owned by the
developer. Stormwater management standards will ultimately be required to comply with
Johnson County's standards.
Sanitary Sewer and Water Service: The subject area does not have access to the City's
water or sanitary sewer systems. All six lots will use the same well for water access. Each
individual lot will have its own individual septic system. These septic sewer systems will be
required to conform to the Johnson County Board of Health Rules and Regulations
Governing On -Site Wastewater Treatment Systems.
NEXT STEPS:
Pending City Council approval, the final plat application will be heard by the Johnson
County Board of Supervisors for final action. A decision on the final plat from the Iowa City
Council must be made before the Johnson County Board of Supervisors can take final
action on the application.

Staff recommends approval of SUB19-13, the final plat of Rolling Prairie Estates, a 6 -lot
subdivision that includes 6 single-family residential lots on 10.06 acres located in Johnson
County, south of American Legion Road and West of Wapsi Avenue SE.

Resolution approving the extraterritorial final plat of Rolling Prairie Estates
subdivision, a 9.34 -acre, 6 lot residential subdivision located in
unincorporated Johnson County, south of American Legion Road and west
of Wapsi Avenue SE. (SUB19-13).
Whereas, the owner, Advantage Development, Inc., filed with the City Clerk the final plat of
Rolling Prairie Estates subdivision, a 10.06 -acre, 6 lot residential subdivision located in
unincorporated Johnson County, south of American Legion Road and west of Wapsi Avenue SE.;
and
Whereas, said subdivision is located on the following -described real estate in Johnson County,
Iowa, to wit:
Said Auditor's parcel 2019137 contains 9.34 acres, and is subject to easements and restrictions of
record.
Whereas, this property is within the City's extraterritorial review area; and
Whereas, the Department of Neighborhood and Development Services and the Public Works
Department examined the proposed final plat and subdivision, and recommended approval; and
Whereas, said final plat and subdivision are found to conform with Chapter 354, Code of Iowa
(2020) and all other state and local requirements.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa, that:
The said final plat and subdivision located on the above-described real estate be and the
same are hereby approved.
2. The Mayor and City Clerk of the City of Iowa City, Iowa, are hereby authorized and
directed, upon approval by the City Attorney, to execute all legal documents relating to
said subdivision, and to certify a copy of this resolution, which shall be affixed to the final
plat after passage and approval by law. The City Clerk shall certify and send plat and

Executive Summary:
The Iowa City Industrial Campus is a City -owned industrial use site on 420th Street. In 2015 the
City Council approved a one-year listing agreement with Lepic-Kroeger, Realtors to sell the lots.
The agreement has since been extended each year, and this resolution extends it again until July
15, 2021.
Background /Analysis:
The Iowa City Industrial Campus is a City -owned 173 acre industrial use site on 420th Street. In
2015 the City Council approved a one-year listing agreement with Lepic-Kroeger, Realtors to sell
the lots. The City sold Lot 2 (approximately 11.2 acres) to Alexander Lumber, I nc. in 2018.
The listing agreement has since been extended each year, and this resolution would extend it
again until July 15, 2021. The sales commission has remained 6% since the agreement was
initially signed. The benefits to the City of having a listing agreement with a real estate company
are that commercial realtors are connected to numerous networks that can be helpful in linking
prospective buyers with sellers, they can prepare and distribute promotional materials including
videos, and they are knowledgeable about the latest market trends.

FIFTH AMENDMENT TO
COMMERCIAL LISTING CONTRACT
WHEREAS, on July 15, 2015, Lepic-Kroeger, Realtors (`Broker") and the City of Iowa
City ("Owner") entered into the Commercial Listing Contract ("Agreement") in which Owner
authorized Broker to be its exclusive agent in the sale of lots at 4201" Street Industrial Park;
WHEREAS, 420"1 Street Industrial Park has been subdivided and is now known as Iowa
City Industrial Campus; and
WHEREAS, the term of the Agreement was for one-year and the parties extended the
tern four times for one-year periods by written agreement which expired July 15, 2020; and
WHEREAS, the parties wish to extend the agreement for an additional year.
THE PARTIES THEREFORE AGREE AS FOLLOWS:
The "Expiration Time" in Paragraph 1 of the Agreement is amended by changing the
ending date to "July 15, 2021."
All other terms and conditions of the Agreement, not inconsistent with this amendment,
remain in full force and effect.

Executive Summary:
Each year, the City bids a project to rehabilitate sanitary sewer pipes through a lining process.
This rehabilitation of pipes is one of the components of the City's annual sanitary sewer repair and
replacement program.
Background /Analysis:
This project includes lining approximately 10,600 linear feet of sanitary sewer pipe, reinstatement
of approximately 236 service connections, and other associated work for locations near the
following addresses: 1116 and 1400 Block of Buresh Avenue; 1400 — 1600 West Benton Street;
1400 — 1600 Blocks of Derwen Drive; Arbury Drive; 6-48 Denbigh Drive; Penfro Drive; 1545 and
1950 Delwood Drive; 1912 and 1918 Flatiron Avenue; 1700-1900 Blocks of Flatiron, Gleason,
and California Avenues; Grant Wood Drive; Aniston Street; Amber Lane; Regal Lane; and 1900 —
2300 Blocks of Lakeside Drive.
AECOM Technical Services, Des Moines, Iowa developed the design for this project and is
assisting City staff during bidding, letting, and construction. AECOM Technical Services
estimated the cost of the project as $420,000

Whereas, notice of public hearing on the project manual and estimate of cost for the above-named
project was published as required by law, and the hearing thereon held; and
Whereas, the City Engineer or designee intends to post notice of the project on the website owned
and maintained by the City of Iowa City; and
Whereas, funds for this project are available in the Annual Sewer Main Replacement, Account
Number V3101.
Now, therefore, be it resolved by the Council of the City of Iowa City, Iowa, that:
1. The project manual and estimate of cost for the above-named project are hereby approved
2. The amount of bid security to accompany each bid for the construction of the above-named
project shall be in the amount of 10% (ten percent) of bid payable to Treasurer, City of Iowa
City, Iowa.
3. The City Clerk is hereby authorized and directed to post notice as required in Section 26.3,
not less than 13 days and not more than 45 days before the date of the bid letting, which
may be satisfied by timely posting notice on the Construction Update Network, operated by
the Master Builder of Iowa, and the Iowa League of Cities website.
4. Sealed bids for the above-named project are to be received by the City of Iowa City, Iowa,
at the Office of the City Clerk, at the City Hall, before 3:00 p.m. on the 111h day of August,
2020. At that time, the bids will be opened by the City Engineer or his designee, and
thereupon referred to the City Council of the City of Iowa City, Iowa, for action upon said
bids at its next regular meeting, to be held at the Emma J. Harvat Hall, City Hall, Iowa City,
Iowa, at 7:00 p.m. on the 151 day of September, 2020, or at a special meeting called for that
purpose. If City Hall is closed to the public due to the health and safety concerns from
COVID-19, sealed bids may still be delivered in person on Mondays through Fridays 8:00
am to 5:00 pm. The person delivering the sealed bid may come to the front lobby of City

Executive Summary:
The Center for Worker Justice (CWJ), a local non-profit organization that works with low income
workers and families, initiated a program in response to the COVI D-19 pandemic called From
Our Home To Yours. This program assists primarily immigrant and refugee families that are
experiencing financial hardship due to COVI D, but typically ineligible for unemployment or federal
stimulus funds. To date they have raised over $130,000 in private funds and have distributed over
$127,000 to families in need.
CWJ requested $25,000 from the City to further assist Iowa City families in need through this
program. CWJ also submitted a request to the County for $40,000. The County approved the
request but the CWJ is currently seeking changes to the approved grant agreement. The
approved County agreement along with the proposed changes being requested by the CWJ are
attached for Council review. To the extent possible, the staff believes it is appropriate for the City
and County to have substantially the same terms and requirements. This generally eases
administrative burdens and allows for greater clarity for the public seeking assistance and for
referring agencies, some of whom are offering similar relief programs.
Background /Analysis:
City staff met with CWJ Staff and Board Members to discuss the request for City funds. The
From Our Home to Yours program provides payments of $300-$600 per family to local
community members in crisis. Applicants are typically already familiar with CWJ services or are
referred by other community providers to the program. Upon application, the applicant meets with
CWJ staff to answer questions to determine the household's situation and financial need. A CWJ
Board appointed committee reviews the applications and determines eligibility. A payment is then
issued directly to the applicant. To date the vast majority of applicants have received one payment.
A few have received a second payment in non-consecutive months.
Based on staff's conversation with CWJ, staff anticipates an agreement that incorporates the
following provisions:
• Applicant must live in Iowa City.
• The household income of the applicant must be under 80% of median income. Applicants
may self -certify their income if documentation is not available.
• The household must be impacted financially by COVID-19. If documentation of COVID
impact is not available applicants may self -certify.
• Payment, up to $600 per household, can be provided to the applicant for food, rent or
mortgage, utilities, healthcare and/or childcare no more than twice in a 12 month period. If
payment is not made directly to the vendor, the applicant must submit receipts for their
eligible expenses and these must be kept on file with the CWJ application.
• CWJ will work with the applicant to exhaust other local, state and federal funding sources
before utilizing City provided funds under this program.
• CWJ will assist other City funded COVID relief housing assistance providers, specifically
Shelter House and CommUnity Crisis Services, to verify if assistance for rent, mortgage
and/or utilities were provided to a household to avoid a duplication of benefits. To protect
confidentiality such verification can be made over the phone.
• CWJ will provide monthly status updates by email or mail to the City's Neighborhood
Services Coordinator until the funds are depleted. The update shall include the number of
households assisted, the amount of the assistance, and the type of assistance. Once the
funds are depleted, CWJ must submit a close out report identifying total amount of funds
spent, number of households assisted, average amount of assistance per household, and
what expenses were paid with City assistance.
• The City will allow administrative expenses up to 10% of the total award due to the City's
requirements.
If Council chooses to proceed forward with a contribution, the City Manager will be authorized to
execute the agreement consistent with Council direction provided. Staff will attempt to align the
agreement with Johnson County's agreement unless there are significant differences between
City Council provided direction and the County's desired rules and regulations.

Dear Mayor Teague and Councilors,
At the May 21 council meeting, City Manager Fruin presented the Council with some possible
frameworks for COVID-19 recovery efforts. The council responded that relief for individuals and
nonprofits was its clear and unanimous priority. We write to thank you for 1) your recognition of
the devastating crisis facing our most vulnerable residents and 2) your commitment to action.
The Center for Worker Justice relief effort "From Our Home to Yours" was created in April in
response to this need_ So far, over $120,000 has been donated by caring individuals with
money to share, and the first distributions have been made to 147 local families. Every dollar
raised will be redistributed to community members whose already -low wages have been further
limited by the economic devastation of COVID-19. Many families in our community are in crisis
with no safety net, leaving them unable to afford rent, utilities, and basic needs. Many immigrant
families in our network are not eligible for unemployment or federal stimulus funds.
Our project passes along payments of $300-$600/family to local community members in crisis,
starting with those who are ineligible for other assistance programs. CWJ distributes the funding
through a process developed and monitored by a committee of leaders. This modest amount of
assistance per household has made a significant improvement on recipients' health, safety and
ability to recover from the impact of COVID-19.
To aid in the continued success of this program, we are requesting $25,000 from the City of
Iowa City. This money will be distributed to Iowa City residents. Your support will help us to
reach our overall goal of $250,000 in support from individual community members, businesses
and local government.
We are fortunate to live in such a strong and resilient community. We ask you to support and
empower the most vulnerable in our community. Every dollar invested with our recipients will be
spent again in our local economy. And, as you noted on May 21, putting individuals and
nonprofits at the front and center of relief efforts is how we will truly recover, together.

Johnson County Social Services Emergency Assistance Funding
THIS AGREEMENT, made between Johnson County, Iowa ("County"), and Center for Worker Justice of Eastern
Iowa ("Recipient").
This Agreement shall be subject to the following terms and conditions, to -wit:
I. SCOPE OF SERVICES
Acknowledging the diminished household income many families in our community are experiencing due to
business closures and other effects of the COVID-19 pandemic and the consequent inability of some
households to meet regular rent, utility, food, and other essential expenses of daily life at the present time,
and further acknowledging the public benefits of preventing homelessness, maintaining adequate indoor
climate control for persons with vulnerable health conditions, and mitigating food insecurity, that
temporary financial assistance to such households can provide, during the term of this Agreement the
Recipient shall implement the following services:
A. Provide emergency assistance for rent, utilities, food, and other essential needs primarily to immigrant
and refugee families who are experiencing financial hardship. Households must first apply for and
follow through with all other assistance programs in which they may be eligible; including, but not
limited to the COVID-19 Iowa Eviction and Foreclosure Prevention Program, Iowa City CDBG
emergency assistance funding administered by CommUnity, the Iowa City emergency assistance
funding administered by Shelter House, the Johnson County General Assistance Program and the
Supplemental Nutrition Assistance Program (SNAP). Households receiving rent or mortgage
assistance from one of the above- mentioned programs shall not be eligible for County funding within
the same month. The Recipient's application process will review with the applicants for assistance the
programs for which they may be eligible and for which they have applied or will apply.
B. While taking appropriate steps to protect the confidentiality of the applicants, collaborate with Shelter
House, CommUnity Crisis Services and Food Bank and Johnson County General Assistance Program
to ensure efficiency and avoid duplication of services.
II. REPORTING

A. Number of households and individuals served (duplicated and unduplicated);
B. Type (rent, utility, food, and other essential needs) and amount of assistance received per household;
Outcomes (impact of the programming on participants)
A. At least 75% of households receiving rent, mortgage or utilities assistance will report that without the
help from the From Our Home to Yours Program they faced possible loss of housing
(eviction/foreclosure), food deficiency, or other hardships related to the impact of COVID-19;
III. FUNDING
A. As its sole obligation, under this Agreement, the County shall pay to Recipient up to $40,000 for
emergency assistance to families in need. Recipient will receive the first installment of $20,000 on or
around July 24, 2020. The second installment of $20,000 will be issued when the first installment has
been expended, all documentation of expenditures has been received and scope of services and
outcomes continue to be successful in meeting community need, but no later than June 1, 2021.
B. Funds allocated through this program may be paid directly to the vendor, such as the landlord,
mortgage or utility company, where feasible, or directly to the applicant to meet diverse other
expenditures to meet essential basic needs, and the applicant shall provide itemized receipts to
document those expenditures..
C. Recipient shall submit documentation of expenses on or before the 151 of the month following the
month of services.
D. The Recipient will use Reimbursement Claim Forms provided by the Johnson County Social Services
Director.
IV. GENERAL ADMINISTRATION
A. On or before the 15' day of the month following the end of each calendar quarter, Recipient will
provide to the Social Services Director a report in a format prescribed by the County. In addition,
the recipient may be asked to provide additional documents including board minutes, financials
reports and external audits.
B. On or before July 30, 2021 Recipient will provide to the Social Services Director a final grant
report in a format prescribed by the County. In addition, the recipient may be requested to provide
additional documents including board minutes, financials reports and external audits.
C. Duly authorized representatives of the County shall at all reasonable times, have access to and the
right to inspect, copy, audit, and examine all financial books, records, and other documents of
Recipient related to this program, and to make site visits and survey participants in order to
evaluate and monitor the Recipient's program. No report or publication resulting from any such
inspection, audit, examination, site visit, or survey shall disclose the name or other identifying
information concerning persons using Recipient's services.
D. The County's sole responsibility hereunder shall be to provide the funds to Recipient in
accordance with the terms of this Agreement. Nothing contained in this Agreement, nor any act or
omission of the Recipient or the County, shall be construed to create any special duty,
relationship, third -party beneficiary, respondent superior, limited or general partnership, joint
venture, or any association by reason of the Recipient's involvement with the County, nor shall the
County have authority to direct the manner or means by which Recipient conducts activities.
E. This contract may be terminated with 30 days written notice by either party.
F. Recipient shall not permit any of the following terms and practices:
I. To discharge from employment or refuse to hire any individual because of their race, creed,
color, national origin, religion, age, sex, marital status, sexual orientation, gender identity,
disability, or disability status.
II. To discriminate against any individual in terms, conditions, or privileges of employment
because of their race, creed, color, national origin, religion, age, sex, marital status, sexual
orientation, gender identity, disability, or disability status.
III. Deny to any person its services on the basis of race, creed, color, national origin, religion, age,
sex, marital status, sexual orientation, gender identity, disability, or disability status.
G. Funds transferred to Recipient by the County pursuant to this Agreement shall be used only for
public purposes and only in furtherance of the provision of those services and deliverables
described in this Agreement. The recipient may use up to 10% of the allocated funds to cover
necessary administrative expenses, such as increasing staffing capacity. In the event Recipient
receives and/or holds County funds in advance of program expenditure or disbursement, Recipient
shall establish and maintain appropriate accounts for the purposes set forth herein. All funds held
by the Recipient shall be accounted for, managed and invested in compliance with Iowa law,
including but not limited to Chapters 12B and 12C of the Iowa Code.
V. TERM
This Agreement shall commence on July 1, 2020 and shall terminate on June 30, 2021, except as provided
herein.
VI. ASSIGNMENT
This Agreement may not be assigned by either party without prior written agreement of the other party.
VII. HOLD HARMLESS PROVISION
The Recipient shall indemnify, defend and hold harmless the County, its officers, employees and agents
from all liability, loss, cost, damage and expense (including reasonable attorney's fees and court costs)
resulting from or incurred by reason of any actions based upon the negligent acts or omissions of the
Recipient's officers, employees or agents during the performance of this Agreement.
VII. CONDITIONAL STATUS
The Board of Supervisors may place an agency on conditional status when one or more problems are
identified within the agency that puts its agreement with Johnson County in jeopardy. Problems may be in
service delivery, board activity, agency administration, fiscal management, cooperation with other agencies,
compliance with other government funders, or compliance with the Johnson County agreement. The Board
of Supervisors may request that an external financial audit be performed, at the sole expense of the agency,
if no audit records are available.
Following the placement of an agency on conditional status, a Board of Supervisors representative and/or
the Johnson County Social Services Director will meet with the agency director and board members to
discuss the concerns/problems as identified by the Board of Supervisors. The Board of Supervisors will
provide the agency with a written memo outlining the concerns/problems, specific corrective action steps,
and time frames for completion. The agency will provide periodic reports and meet with the Board of
Supervisors representative and/or the Johnson County Social Services Director during this period to ensure
that satisfactory progress.
Funding may be withheld by Johnson County until the agency has completed or made sufficient progress on
the action steps to correct the problems, as determined by the Board of Supervisors.
If an agency fails to meet the requirements of the Johnson County agreement and/or the action step memo
within the appropriate timeframe as specified, the Board of Supervisors may cease county funding.

eligible; including, but not limited to the COVID-19 Iowa Eviction and Foreclosure Prevention
Program, Iowa City CDBG emergency assistance funding administered by CommUnity, the Iowa City
emergency assistance funding administered by Shelter House, the Johnson County General Assistance
Program and the Supplemental Nutrition Assistance Program (SNAP). Households receiving rent or
mortgage assistance from one of the above- mentioned programs shall not be eligible for County
funding within the same month. The Recipient's application process will review with the applicants
for assistance the programs for which they may be eligible and for which they have applied or will
apply.
B. While taking appropriate steps to protect the confidentiality of the applicants cGollaborate with
Shelter House, CommUnity Crisis Services and Food Bank and Johnson County General Assistance
Program to ensure efficiency and avoid duplication of services.
II. REPORTING

III. FUNDING
A. As its sole obligation, under this Agreement, the County shall pay to Recipient up to $40,000 for
emergency assistance to families in need. Recipient will receive the first installment of $20,000 on or
around July 24, 2020. The second installment of $20,000 will be issued when the first installment has
been expended, all documentation of expenditures has been received and scope of services and
outcomes continue to be successful in meeting community need, but no later than June 1, 2021.
B. Funds allocated through this program ma be paid directly to the vendor, such as the landlord,
mortgage or utility company, where feasible, or directly to the applicant to meet diverse other
expenditures to meet essential basic needs and the applicant shall provide itemized receipts to
document those expenditures. .
C. Recipient shall submit documentation of expenses on or before the 15'x' of the month following the
month of services.
D. The Recipient will use Reimbursement Claim Forms provided by the Johnson County Social Services
Director.
IV. GENERAL ADMINISTRATION
A. On or before the 15'x` day of the month following the end of each calendar quarter, Recipient will
provide to the Social Services Director a report in a format prescribed by the County. In addition,
the recipient may be asked to provide additional documents including board minutes, financials
reports and external audits.
B. On or before July 30, 2021 Recipient will provide to the Social Services Director a final grant
report in a format prescribed by the County. In addition, the recipient may be requested to provide
additional documents including board minutes, financials reports and external audits.
C. Duly authorized representatives of the County shall at all reasonable times, have access to and the
right to inspect, copy, audit, and examine all financial books, records, and other documents of
Recipient related to this program, and to make site visits and survey participants in order to
evaluate and monitor the Recipient's programs. No report or publication resulting from any such
inspection, audit, examination, site visit, or survey shall disclose the name or other identifying
information concerning persons using Recipient's services.
D. The County's sole responsibility hereunder shall be to provide the funds to Recipient in
accordance with the terms of this Agreement. Nothing contained in this Agreement, nor any act or
omission of the Recipient or the County, shall be construed to create any special duty,
relationship, third -party beneficiary, respondent superior, limited or general partnership, joint
venture, or any association by reason of the Recipient's involvement with the County, nor shall the
County have authority to direct the manner or means by which Recipient conducts activities.
E. This contract may be terminated with 30 days written notice by either party.
F. Recipient shall not permit any of the following terms and practices:
I. To discharge from employment or refuse to hire any individual because of their race, creed,
color, national origin, religion, age, sex, marital status, sexual orientation, gender identity,
disability, or handicap -disability status.
Il. To discriminate against any individual in terms, conditions, or privileges of employment
because of their race, creed, color, national origin, religion, age, sex, marital status, sexual
orientation, gender identity, disability, or handie ip-disability status.
III. Deny to any person its services on the basis of race, creed, color, national origin, religion, age,
sex, marital status, sexual orientation, gender identity, disability, or handicap -disability status.
G. Funds transferred to Recipient by the County pursuant to this Agreement shall be used only for
public purposes and only in furtherance of the provision of those services and deliverables
described in this Agreement. The recipient may use up to 10% of the allocated funds to cover
necessary administrative expenses, such as increasing staffing capacity. In the event Recipient
receives and/or holds County funds in advance of program expenditure or disbursement, Recipient
shall establish and maintain appropriate accounts for the purposes set forth herein. All funds held
by the Recipient shall be accounted for, managed and invested in compliance with Iowa law,
including but not limited to Chapters 12B and 12C of the Iowa Code.
V. TERM
This Agreement shall commence on July 1, 2020 and shall terminate on June 30, 2021, except as provided
herein.
VI. ASSIGNMENT
This Agreement may not be assigned by either party without prior written agreement of the other party.
VII. HOLD HARMLESS PROVISION
The Recipient shall indemnify, defend and hold harmless the County, its officers, employees and agents
from all liability, loss, cost, damage and expense (including reasonable attorney's fees and court costs)
resulting from or incurred by reason of any actions based upon the negligent acts or omissions of the
Recipient's officers, employees or agents during the performance of this Agreement.
VII. CONDITIONAL STATUS
The Board of Supervisors may place an agency on conditional status when one or more problems are
identified within the agency that puts its agreement with Johnson County in jeopardy. Problems may be in
service delivery, board activity, agency administration, fiscal management, cooperation with other agencies,
compliance with other government funders, or compliance with the Johnson County agreement. The Board
of Supervisors may request that an external financial audit be performed, at the sole expense of the agency,
if no audit records are available.
Following the placement of an agency on conditional status, a Board of Supervisors representative and/or
the Johnson County Social Services Director will meet with the agency director and board members to
discuss the concerns/problems as identified by the Board of Supervisors. The Board of Supervisors will
provide the agency with a written memo outlining the concerns/problems, specific corrective action steps,
and time frames for completion. The agency will provide periodic reports and meet with the Board of
Supervisors representative and/or the Johnson County Social Services Director during this period to ensure
that satisfactory progress.
Funding may be withheld by Johnson County until the agency has completed or made sufficient progress on
the action steps to correct the problems, as determined by the Board of Supervisors.
If an agency fails to meet the requirements of the Johnson County agreement and/or the action step memo
within the appropriate timeframe as specified, the Board of Supervisors may to -cease county funding.

Thanks for your work in these difficult and adverse times. I'm writing as chair of the Finance Committee
of the Center for Worker Justice of Eastern Iowa to ask for your support of an agreement between CWJ and
the City to provide $25,000 in small grants to the most hard-pressed members of our community struggling
under these COVID 19 conditions. CWJ has established a very effective program of support to families whose
needs have fallen through the cracks of existing support programs. Through its program, "From My Home to
Yours," CWJ has distributed more than $130,000 in privately donated contributions to more than 200 families
in several distributions of grants of $300 to $500. These have been life-saving funds for many in our
community. We are also discussing an agreement with the Johnson County Board of Supervisors for a grant of
$40,000. Grants from the city and county would significantly augment the funds available for distribution.
CWJ staff and board members have devised a careful and well-managed application and review process for
those seeking funds.

Resolution approving a $25,000 funding request from Center
for Worker Justice for emergency needs to households due to
COVID-19.
Whereas, Center for Worker Justice (CWJ) is a local non-profit corporation that works with low-
income workers and families;
Whereas, CWJ initiated a program in response to the COVID-19 pandemic called From Our
Home To Yours to assist primarily immigrant and refugee families experiencing financial
hardship due to COVID-19, but typically ineligible for unemployment or federal stimulus funds;
Whereas, to date CWJ has raised over $130,000 in private funds and distributed over $127,000
to families in need;
Whereas, Johnson County recently approved a CWJ funding request of $40,000;
Whereas, CWJ is requesting $25,000 from the City for From Our Home To Yours; and
Whereas, From Our Home To Yours is a public purpose and the request should be approved.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa, that:
With approval of the City Attorney, the City Manager is authorized to sign an agreement
with CWJ for $25,000 in funds to be used exclusively for the From Our Home to Yours
program that includes the following provisions:
1) The applicant must live in Iowa City.
2) The household income of the applicant must be under 80% of median income
and the applicant may self -certify if documentation is not available.
3) The household must be impacted financially by COVID-19 and provide
supporting documentation. If documentation is not available applicants may sef-certify.
4) Payment, up to $600 per household, can be provided to the applicant for food,
rent, mortgage, utilities, healthcare and/or childcare no more than twice in a 12 month
period. If payment is not made directly to the vendor, the applicant must submit receipts
for the eligible expenses, and these must be kept on file with the CWJ application.
5) CWJ will work with the applicant to exhaust other local, state and federal funding
sources before utilizing City funds under this program.

6) CWJ will assist other City funded housing assistance providers, specifically
Shelter House and CommUnity Crisis Services, to verify if assistance for rent, mortgage
and/or utilities were provided to a household to avoid a duplication of benefits.
7) CWJ will provide monthly status updates by email or mail to the City's
Neighborhood Services Coordinator until the funds are depleted. The update will include
the number of households assisted that month, the amount of the assistance, and the
type of assistance. Once the funds are depleted, CWJ must submit a close out report
identifying total amount of funds spent, number of households assisted, average amount
of assistance per household, and what expenses were paid with City assistance.
8) Up to 10% of the total award may be used for administrative expenses due to the
City's requirements.

Executive Summary:
The City is recommending assessing a property due to costs incurred by the City to address tall
grass and weeds (includes scrub trees). The City notified the owner to remove the tall grass and
weeds. After the issue went unresolved, the City hired a contractor to perform the work. The City
has invoiced the owner on three occasions for the cost plus an administrative fee. As the owner
has failed to pay the invoice, City staff recommend assessing the property. The owner is
contesting the proposed assessment.
Background /Analysis:
Photographs and a screen shot of the site are attached. A timeline of the violation is provided
below:
9-19-2019 — The City received a complaint at 1131 3rd Ave. for a vehicle parked on the grass.
When a complaint is investigated it is common to review the neighboring properties (properties in
the vicinity) for the same issue. When a complaint is investigated it is also common practice to
review all exterior code issues apparent at the property. When the inspector left 1131 3rd Ave.,
he decided to drive around the block to the immediate south and discovered multiple violations at
1222 4th Ave. Ousainou Keita is the owner of record for this property. Based on the observed
issues, the inspector left door hangers for all the violations at 1222 4th Ave.
Violations were as follows:
•14 -5A -2B Parking on grass, gravel or dirt is not permitted — six motor vehicles parked in front set
back/front lawn (photo attached).
Resolution: After tagged, the owner initially moved vehicles within roughly 24 hours.
• 6-1-2A Public Nuisance; causing, permitting or allowing any refuse, solid waste, garbage,
noxious substances, hazardous wastes, junk or salvage materials to be collected or to remain in
any place.
Resolution: Addressed within given time.
• 17-5-19V-3 Exterior area maintenance, prohibits the use or storage use of indoor furniture
outside.
Resolution: Addressed within given time.
• 6-3-213 Maintain grass/weeds under 10 inches (includes scrub trees).
Resolution: Resolved by the City (see below).
9-20-2019 — Notices of Violation were mailed for tall grass and weeds, parking on the grass, solid
waste, interior furniture outdoors to the owner's mailing address at 217 Lenz Ct., Iowa City, IA as
listed on the Assessor's site. Since the owner of the property is listed on Lenz Ct. it was
assumed that 1224 4th Ave. must be a rental property. Mr. Keita told the inspector that his wife
resides at 1222 4th Ave.
9-23-2019 — The inspector called Mr. Keita on another inspection matter unrelated to 1222 4th
Ave. and during the call the inspector reminded him that the lawn at 1222 4th Ave. needed to be
addressed.
9-26-2019 — A Notice of Violation for tall weeds and grass was mailed to 217 Lenz Ct. giving the
owner until 10/3/20 to cure the violation at 1222 4th Ave. It also notified him that the City would
correct the violation and assess him the costs if it was not corrected. The notice further provides
him with an opportunity to contest the notice, Mr. Keita did not do so.
10-7-2019 — Because the tall grass and weeds had not been cut, the City issued a work order to
the City contractor.
10-30-2019 — The City contractor completed the work to correct the code violation for the tall
grass and weeds violation.
11 -1 -19 -The City contractor invoiced the City for the work done at 1222 4th Ave. to correct the
code violation related to tall grass and weeds.
2-2020 - The City invoiced Mr. Keita for the cost of the contractor to correct the code violation
related to tall grass and weeds, plus the $100 administrative fee.
3-2020 - The City invoiced Mr. Keita for the cost of the contractor to correct the code violation
related to tall grass and weeds, plus the $100 administrative fee.
4-2020 - The City invoiced Mr. Keita for the cost of the contractor to correct the code violation
related to tall grass and weeds, plus the $100 administrative fee.
City code definition of weeds: Any plants growing uncultivated and out of context with the
surrounding plant life with a height of ten inches (10") or more or when such plan has a seed head
forming or formed.

Whereas, the City Clerk has filed with the City Clerk an assessment schedule providing the
amount to be assessed against certain lots for the actual unpaid abatement costs of mowing,
cleaning up property, removing snow, repairing sidewalks, and repairing stop boxes in the same
manner as property taxes;
Whereas, said schedule is attached as Exhibit A to this resolution and incorporated herein by
this reference;
Whereas, Iowa Code § 364.138 authorizes the City Council to assess against the property said
abatement costs in the same manner as property taxes; and
Whereas, the City Council finds that the property owners listed in Exhibit A have received a
written notice of the date and time of the public hearing on the adoption of said assessment
schedule, in substantially the same form attached hereto as Exhibit B.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa:
Exhibit A is adopted as the final assessment schedule pursuant to Iowa Code § 384.60(1).
The amounts listed in Exhibit A for unpaid mowing charges, clean-up property charges, snow
removal charges, sidewalk repair charges and stop box repair charges are confirmed and levied
against the properties listed in Exhibit A.
All unpaid assessments not paid within thirty (30) days after the first publication of the final
assessment schedule shall bear interest at the rate of 9% per annum, commencing on
September 3, 2020.
Assessments are payable at Johnson Country Treasurer, 13 South Dubuque Street, Iowa City,
Iowa. Until September 2, 2020 payment may be made at the City Clerk, 410 E. Washington
Street, Iowa City, Iowa.
The City Clerk is hereby directed to certify the schedule as set out in Exhibit A to the Treasurer
of Johnson County, Iowa for collection in the same manner as property taxes. The assessment
cannot be paid in installments.
