It is undeniably the right thing to do at this time. I am an Iowa native and former resident of Iowa City, and I had planned a trip to see family this summer. Sadly, that trip is on hold indefinitely. Governor Reynolds is not getting ahead of this issue and is making more Iowans --my family members among them --at risk. I am an essential worker, a GM at a natural foods cooperative, and we have worked steadily throughout the pandemic in a state that was one of the first hot spots for the coronavirus . But now Massachusetts has considerably lowered the virus rate by enforcing a mask mandate. Wearing masks has kept every one of my employees safe --no one has tested positive. And as an extension of that practice we helped protect our customers and at the very least provided them with peace of mind which is a rare commodity these days. Even though you've issued an (illegal) order regarding the forced wearing of masks in public, and provided exemptions for medical, legal, or behavioral cases, this is guaranteed to cause problems. All it takes is the wrong interaction by a stupid person who isn't aware of the exemptions to set off the patient. I'm sure we'll see or hear of busybodies questioning those without masks. Demanding to know what their medical exemption is, who their doctor is, and so forth. While most patients know to not reveal anything, some might be angered or confused and then blurt out personal information or their condition which is none of the public's business. Or patient involvement with law enforcement. LEOs might not know of all the exemptions. These kinds of interactions have occasionally escalated. Have you seen the virual video of the policeman pepper -spraying a man at Tim Horton's in Montreal? You want that here? I know you're not going to rescind the (illegal) order, but you have to think about these people. When we went through H1N1 pandemic in 2009, there was no mask order. We were told that masks weren't needed and are not effective at prevention, and there are numerous controlled studies with health care workers over the decades that prove this. Don't cite me the bogus "studies" quickly published in the past few months based on numbers because that's nothing but propaganda. Don't cite me anything from Lancet, the same bunch who published the vaccines = autism fraud. During 2009's H1N1 pandemic, testing stopped once a few positives popped up in communities, especially college towns. We know it's going around. We didn't have hysterical "numbers porn" then. It's not necessary. We said back then that there's nothing you can do except wash your hands, don't go into crowds, and keep those with comordbities from the general public. This isn't 1918, although a lot of people think most of the deaths in 1918 were from overuse of aspirin. The bodies aren't being stacked in the street today. Most who test positive don't have symptoms or don't have to be hospitalized. We have numerous courses of treatment that work. I don't want to see any stories in the news about the police being called on people, but that's going to happen. I think you want it to happen. Adding low level criminal penalties puts Black Iowa Citians at increased risk of disproportionate police contract. Please rewrite the policy to focus on business and government operations and add enforcement by public health agencies rather than the police department. Assign fines for code violations, rather than criminal penalties. Make any fines to individuals low enough to not be excessively punitive, or eliminate them altogether. Social justice needs inform every council decision if Iowa City is going to make progress. Along the way I must have encountered 25-35 people in all stages of life including mothers with strollers and toddlers. I am not exaggerating when I say I was the ONLY one on the trail that bothered to employ a mask as needed and I was the ONLY one to initiate social distancing as needed. Many times my social distancing space was entered into rudely and abruptly by cyclists who gave no warning and left me in their slipstream. I don't consider Clear Creek trail to be safe anymore because of this, which is a shame and a huge disappointment because it's such a beautiful little trail and fun to walk. On my way today I made sure to stop and take some pictures of the wildflowers (they were quite nice today). I don't feel comfortable doing that anymore until some alteration in behavior is achieved. I don't think these people are bad. I just think that they haven't thought things through and they need some guidance. In my opinion, I'm afraid we may be forced to shut down the trail if this doesn't stop. And I think that would disappoint everyone. As a university student and staff member as well as a member of the community, I have been losing sleep over the risks posed to our city with the university reopening. I stand firmly in the belief that the sheer volume of students is an abhorrent risk in itself, let alone the fact that what they do outside of classrooms (in the Iowa City and Coralville communities and in the residence halls) is completely out of anyone's control. This is on my mind because last night I was enjoying a socially -distanced night with friends at the City Park tennis courts that was interrupted by what can only be described as a horde. Despite the mask mandate, despite the spike in cases nationwide and locally, 50+ people that were very clearly students showed up at the courts with only a few wearing masks and with no distancing in place. It was clear that everyone at the courts immediately felt unsafe, as evidenced by body language and people abruptly abandoning their games. Our friend confronted the person who seemed to be the "MC" of this tennis tournament, asking him why no one was distancing or wearing masks and explaining the risk that this posed to others. They tried to placate us by telling us the event was outdoors and therefore safe. There was absolutely no reasoning to be had. Members of the group who were wearing masks as accessories (hanging from ears, pulled down around their chins) asked us where our masks were — we wear them as we enter and leave the courts but not while playing, which is permissible by the mask mandate. We were intimidated off the courts by the behavior of others and by one of the members who followed us to our car and bikes. Despite our deep misgivings about calling the cops due to our feelings about America's police state, we felt that the situation warranted it due to the obvious risk the situation posed. The cop who came issued a warning but did not disburse the crowd. This is dispatch #20102617 in the ICPD report on 7/23/2020. 1 feel the need to emphasize that my issue is not with the group members who were playing on the courts but the large gathering of people who were standing outside in a social gathering and in defiance of the mask mandate. I also feel that the handling of this situation would have gone very differently if the group was not majority white people. I am deeply disappointed that the mask mandate does not seem to have any real power and that local authorities are unwilling to enforce the mandate. As a member of our community, this incident made it clear to me that the return of students to the UI campus this fall poses an unacceptable risk and compromises the health of our community members AND their right to peaceful existence. The group knew exactly what they were doing when they showed up to the courts, and they got exactly what they wanted — we were intimidated to leave because we were 1) irritated by their shouting and loud music and 2) absolutely terrified by the statistical undeniability of someone in their group spreading COVID-19. I am asking that the city council apply pressure to the University of Iowa in any way that it can. Clearly the UI cannot be trusted to make decisions that adequately protect the health of students, based on their inane plan to welcome students into residence halls and "socially distanced" classrooms. They are ignoring the obvious, which is that the truly dangerous pathology that students will bring to campus is their inability to consider the impact their behavior has on others, especially the Iowa City community. We can inhibit the spread of COVID-19, but we can't pretend that students will willingly comply with university or Iowa City mandates. Thank you for taking the time to read my message. I appreciate the work that you all do for our community and I am grateful to live in a place where I feel my voice will be heard. I can't tell you how disappointed I was when you passed a city-wide mask mandate, particularly because your wording was an overreaching and unenforceable (illegal) imposition on citizens and businesses. However, my bigger concern since the mandate took effect has been my own health and the health and safety of my family and community. I've watched when I've been out as people have spread whatever expanse of cloth they could rig up across their noses and mouths, seemingly unaware of just how small a virus really is based on the weaves and types of masks they wear. This mandate is NOT science -based, and neither are the responses that citizens are having to it. I've also watched in horror as these masks - which undoubtedly are not washed or sanitized regularly and therefore become moist, sticky traps for all manner of infection - have caused the public to touch, fondle, pick, and otherwise mess with their faces at a rate far, far higher than they ever would have done without a mask. I now am much more afraid of catching something in public because I see the hand -to -mask -to item touching that's going on. From what I can tell, every can of food on the shelf, cart, door handle, etc. is much more likely to contain contagions now than ever before. Frankly, I appreciate your desire to keep people safe, but I can't help but think that an effort to "at least so something" (a cry we hear so often these days) is actually worse for us than if we had let people make up their own minds about masks. Please consider the data below: May 5, 20202, the U.S. Centers for Disease Control and Prevention published an article in their peer- reviewed journal called Emerging Infectious Diseases which offered a pooled analysis of previous studies on viral disease prevention. Their conclusions regarding masks can best be summarized by the direct quotes that follow: "we found no significant reduction in influenza transmission with the use of face masks" "Our systematic review found no significant effect of face masks on transmission of laboratory - confirmed influenza." From a paragraph discussing homemade cloth facemasks - "improper use [cloth masks] might increase the risk for transmission" A June 2020, article from doctors at the Dept. of Infectious Diseases and Microbiology at a children's hospital in Australia doesn't even recommend that even healthcare professionals wear masks, and further concluded: "There is no good evidence that facemasks protect the public against infection with respiratory viruses, including COVID-19." "experiments have shown that surgical and cotton masks do not trap the SARS-CoV-2 (COVID-19) virus, which can be detected on the outer surface of the masks for up to 7 days." "wearing a facemask for hours without changing it and without washing hands every time they [presymptomatic or asymptomatic infected wearers] touched the mask could paradoxically increase the risk of infecting others." The World Health Organization does NOT recommend that people wear face masks unless they are caring for someone with an active case of COVID-19. A representative from the WHO said, "Masks should only be used by health care workers, caretakers or by people who are sick with symptoms of fever or cough." Even Dr. Anthony Fauci said in a March 2020 interview, "When you're in the middle of an outbreak, wearing a mask might make people feel a little bit better, and it might even block a droplet, but it's not providing the perfect protection that people think that it is, and often there are unintended consequences. People keep fiddling with the mask and they keep touching their face." I understand that you have a tremendous responsibility when it comes to protecting the health and safety of our citizens. However, you are also tasked with protecting our rights and freedoms, and this mandate would take us in the wrong direction in all of these areas. The unintended consequences and potential for INCREASED disease transmission from improper mask usage and the removal of individual rights and choices is not the right choice for Iowa City, which is why I urge you to lift this ineffective, unenforceable, and ill-advised mandate. Moving forward Iowa City should make this a permanent change and encourage responsible drinking and get rid of the "open container" rules. But, I have asked the property manager to consider other options and they of course was ignored. Income today with this pandemic is limited for me it is anyway. So, I have have paid my full months rent for 7/2020, 1 dont have any friends or family that I can live with for 5 days and 6 nights, I have been trying to figure out ways to reduce my out of pocket expenses for these days since 4/2020. The option I'm left with as of today is to: get a hotel that's currently booked at $340 being discounted for the five days 6 nights so that my children and I have a place to stay after I already paid a full months rent plus rent a uhaul that's about $150 or more to have for 6 days since I am not even given til the end of business day to vacate the property but instead asked to be out by 8am 7/26. All of this without any accommodations to even prorate my rent or anything... How can these landlords bill people for something they're not fully recieving? It is the role of the Planning and Zoning Commission to determine if the conditional use that is being applied for, a commercial communication tower within the City/County Fringe Area, should be recommended for approval to the City Council. The subject property is within Fringe Area "C" of the Fringe Area Policy Agreement, and outside of the City's growth boundary. The Johnson County Zoning Ordinance requires that cities be allowed to review Conditional Use Permits within their extraterritorial jurisdiction (the area covered by the Fringe Area Agreement). Conditional Use Permits in Johnson County require a 4/5 majority vote of the Board of Adjustment to approve if the use is opposed by a vote of the City Council. The subject property is zoned County Agricultural (A). Adjacent properties to the south and west are also zoned County Agricultural (A). Properties to the east are zoned County Commercial (C) and County Highway Commercial (CH). The property to the immediate north, located on the north side of Hwy. 1, is zoned County Residential (R-10), allowing for residential development on lots that are at least 10 acres. Proposed Land Use: The Johnson County Unified Development Ordinance (UDO) defines a commercial communication tower as "A tower, pole, or similar structure, including supporting lines, cables, wires, braces, or other support structures, designed to hold one or more communications antennas. Communication towers are typically freestanding, guyed or attached to another building." The tower is intended to fill a gap in cellular signal service in the southwestern Johnson County area. The applicant has stated that the tower will provide better connectivity to support emergency response calls needed to service the area. The applicant also stated that there are no options to collocate onto another communications facility in this area. Completion of the proposed tower would allow for up to three other users to use the tower site for colocation of services. Plans attached to the application show a 195' tall commercial communication tower, on a 75' x 75' area. The perimeter of the tower area would be landscaped to County standards. The tower would be protected by an 8' tall fence along the site's perimeter, with an additional three strings of barbed wire atop the fence. As the subject property is located outside of the City's Growth Boundary, the property is not discussed in the City's Comprehensive Plan. While analyzing potential changes to the City's Growth Boundary, the City has identified the subject parcel as a potential area of expansion for July 10, 2020 Page 2 inclusion into the Growth Boundary. The County's future land use map currently shows the subject parcel as planned for Intense Commercial/Low Intensity Industrial land use. The existing neighborhood character features large plots of farmland and scattered rural residences. The subject property contains over 38 acres. The proposed commercial communication tower must comply with the following supplemental conditions (summarized) from section 8.1.23 of the Johnson County Unified Development Ordinance pertaining to commercial communication towers: Provision of additional materials. a. Narrative explaining the proposed location, and why colocation is not being pursued. b. Proof of liability insurance. c. Site plan. d. All plans required by section 8.3 — Environmental Standards. 2. Tower setback requirement from parcel lines of 110% of the tower height. (This equals 214.5 feet for the subject tower application) 3. Installation of a landscaping buffer. 4. Installation of security fencing. 5. Specific lighting standards. 6. Independent inspection of the tower every 36 months. 7. Submission of an operation and maintenance plan. 8. Submission of a decommissioning plan. 9. Compliance with County Environmental Standards. 10. Alterations to tower height or location will have to be legally conforming. The applicant is simultaneously applying for a special exception to reduce the setback requirement from the eastern property line. The tower is proposed to be setback 187 feet from the eastern property line, which does not meet the County's requirement of a setback equaling 110% of the height of the tower (214.5 feet). The review and approval of special exceptions are at the sole discretion of the Johnson County Board of Adjustment. City Analysis: Zoning: The proposed commercial communication tower use is allowed in all County zoning designations except for County Environmental Resource Preservation Zoning District (ERP). The use is therefore an allowable conditional use in the County Agricultural (A) zone. The subject property already contains a transmission tower, which would be situated approximately 141 feet from the proposed tower. City and County Planning staff requested that the applicant provide a statement detailing how the communication tower can be located safely in proximity to the transmission tower. The applicant was able to provide a statement from the project engineer (see Attachment 5), certifying that in the rare event that would cause the tower to fall, the maximum fall zone radius would equal about'/2 of the tower height. July 10, 2020 Page 3 Fringe Area Agreement: For agriculturally zoned properties located outside of the City's Growth Boundary, the Fringe Area Agreement directs uses to be consistent with a Rural/Agricultural area as indicated in the Johnson County Land Use Plan and as designated in the Johnson County Unified Development Ordinance. The County Unified Development Ordinance permits commercial communication towers as a conditional use in Agricultural Zoning Districts. Current and Future Land Use: As noted above, the subject parcel might be included in a potential future expansion of the City's Growth Boundary. The County's Future Land Use Plan indicates that the subject parcel is slated for Intense Commercial/Low Intensity Industrial land use. City staff finds that the proposed use is appropriate for either the existing agricultural land use, or the potential future designated commercial/industrial land use. Communication towers can be found in abundance in agricultural zones, and if the existing surrounding land use and zoning persist, the overall character of the subject parcel will not be greatly affected by the existence of the tower. Likewise, the existing County Commercial zoning to the east of the subject parcel is already adjacent to a transmission tower on the subject property. Assuming the tower is built, any new occupants of a commercially oriented future land use on the subject parcel would be developing on the parcel with the understanding that the parcel hosts two rather large utility towers. Compliance with County Conditions: Staff recommends that the conditional use permit for the tower at the proposed location only be allowed if the applicant can obtain the necessary special exception to reduce the required setback distance from the eastern property line. Additionally, staff recommends that all other County supplemental requirements be fulfilled. County Planning staff have also recommended a condition of approval of the conditional use permit that the applicant obtain approval from the Federal Aviation Administration (FAA) to locate the communication tower in its proposed location. This impaired coverage area prevents AT&T customers from initiating and carrying calls and transmitting data. After placement of this facility, coverage will be substantially improved, resulting in better coverage for current and future AT&T subscribers in the area. This will provide the citizens additional choices for their communication needs. The site will dramatically improve AT&T in -building coverage as customers continue to use their wireless devices as their principal form of communication. Local Police and Fire departments report that about 75% of 911 calls originate from wireless devices. II. Why and how this location was chosen A. Technical reason for choosing this site This location was chosen after a "Search Ring" was developed and issued by AT&T's Radio Frequency Engineers. The Search Ring indicates a geographic area in which potential sites may be located which will result in the maximum amount of coverage in an impaired service area. Other factors considered during system design are the terrain elevation, ground clutter and foliage. Wireless technologies are governed by line of sight limitations and wireless phones generally need to "see" a compatible wireless communications facility for operation of customer phones, transmissions, and reception. Almost all Radio Frequency Engineers will use prediction tools to generate propagation studies in order to determine how effectively a proposed cell site will provide the required coverage. Radio Frequency Engineers with AT&T have generated a comprehensive Propagation Study that depicts the current lack of coverage in the area and which shows much improvement with the proposed structure Site Acquisition Contractors, such as Ward Development Services, are instructed by AT&T's management to target existing cell sites, rooftops, towers, and to utilize any existing structures to collocate equipment on within the Search Ring first, in order to minimize new construction, expedite improved coverage, and to meet the spirit and intent of local zoning regulations, which typically encourge collocation. The above considerations and processes were followed in selecting the site that is the subject of this Application. B. Coverage objectives and reasons for choosing this site AT&T's objective in placing a facility on the Subject Property is to improve impaired service in the area. The Federal Communications Commission ("FCC") restricts the power output on all telecommunications antennae, requiring additional sites to fill in gaps in the network. The number of wireless communications facilities correlates to the size, terrain, and amount of customer traffic in a specific area. While AT&T endeavors to collocate on existing structures wherever possible, the lack of existing structures requires a new wireless communications facility to be built. AT&T's service is limited by (Radio Frequency) coverage, which propagates from antennae located on towers. There is no other possible way to cover this area without building a new tower, as there are no collocatable structures available in the area that meets the objectives of the Radio Frequency Engineer's criteria. AT&T consistently seeks to increase or supplement their coverage footprint so that they may serve their growing customer base. Due to the present and anticipated growth of cell phone use, complaints from existing AT&T customers losing their signal while driving in the area or while using their devices in their homes necessitate the additional coverage that will be provided by this tower. As there are no existing structures in the area, our search was to locate a property that met the intent of the requirements for a Conditional Use Permit. There is only one communication tower in the area. This tower is a 130' SST tower at 4127 Maier Drive to the northeast. The tower has Verizon and T -Mobile as tenants. The highest elevation for AT&T is 92' which will not meet our needs. III. Compliance with the Johnson County Zoning Ordinance This Application complies with the requirements of Johnson County Code of Ordinance. Below find a response to the criteria required for a Conditional Use Permit Exception per Section 8:1.28[F] (1) a -e of the Unified Code. F. Conditional Uses. These are uses which generally have a distinct impact on areas in which they are located, or are capable of creating special problems for bordering properties unless given special attention. 1. Review Criteria. To provide for the appropriate review of the location, site development, and conduct of certain designated uses, in any determination upon a particular conditional use at the location requested, the Board of Adjustment shall consider the following guidelines: a. That the proposed location, design, construction, and operation of the particular use adequately safeguards the health, safety and general welfare of persons residing or working in adjoining or surrounding property. The new tower will enhance communications for the area and bring additional voice, text and data to users. As mentioned many people do not use landlines and cell phones is the most widely used tool for emergency communications. The FirstNet network for first responders will also be able to utilize this structure for their needs as part of AT&T's nationwide contract to deploy this system b. That the proposed use will not adversely affect the quality and supply of water, air, and light to surrounding property. That the proposed use will not adversely affect established property values of adjoining or surrounding buildings. The facility is located in an area used for farming and industrial uses. There will be no adverse affect to property values d. That the proposed use is in accordance with the character of the area and the peculiar suitability of this area for the proposed use. The remaining land on the property can be used for agricultural proposes, sold for commercial use or used residentially. The Board of Adjustment may approve a Conditional Use Permit subject to compliance with certain required conditions. The Board shall state the specific requirements of said conditions and the time limit for compliance. CU20-02: Applicant: Steve Ward on behalf of New Cingular Wireless PCS, LLC Location: 4200 Block of Yvette Street SW; Unincorporated Johnson County An application for a conditional use permit to allow for a commercial communication tower in the County Agricultural (A) zone within Fringe Area C of the City/County Fringe Area. Heitner began the staff report with showing an aerial of the subject property which is located at the 4200 block of Yvette Street SW in the County. The entire subject parcel is zoned County Agricultural as is most of the surrounding area however, to the immediate east, there's some County Commercial and County Highway Commercial Zoning with some light industrial land uses currently. Directly north across from Highway 1, there's some larger lot County Residential zoning and are 5 to 10 -acre residential lots. Heitner showed another map showing the Fringe Area and noted the subject parcel is located outside of the City's growth area boundary in Fringe Area C. He showed a photo of the subject parcel and pointed out where the proposed cell tower is supposed to fall within the subject parcel. Regarding some background on the case, it's an application to the Johnson County Board of Adjustment for the allowance of a commercial communication tower located on the 4200 block Yvette Street SW in Johnson County. The conditional use permit allows for use on a specific property subject to fulfilling a number of conditions set forth by the County. It's the role of the Planning and Zoning Commission this evening to determine if the conditional use that is being applied for, a commercial communication tower within the City's Fringe Area, should be recommended for approval to the City Council. Craig asked if the County requires the same good neighbor information, letting people in the neighborhood know what is going on, as the City does. Have those other commercial uses there know what's happening and have they expressed any concerns or anything? Heitner replied the County does have an outreach policy for Board of Adjustment hearings, which this will be a part of, so that would be on the County to make that outreach. Heitner stated he hasn't heard of any Planning and Zoning Commission July 16, 2020 Page 3 of 8 concerns or objections so far to this application Hensch noted the owner of the parcel in question is also the owner of the adjacent business lands. Craig agreed but noted they might own the property, but there's quite a few businesses there, seems like every towing business in town is there. Heitner continued stating the proposed land use is a commercial communications tower. That's how the County Zoning Ordinance classifies what's often referred to as a cell tower, and it's usually a large monopole tower intended to house cellular service for cellular providers. He noted the subject property in this application is not referenced in the City's Comprehensive Plan because it's outside of the City's growth area. The area is pretty rural area for the most part other than the light, industrial, Highway Commercial area to the direct east of the subject property. The parcel contains over 38 acres so it's a fairly large property in of itself. One unique aspect of this subject property is that there is a transmission line that runs through the middle of the property that bisects the property and with that line there is one transmission tower almost right in the middle of the subject property. That tower is estimated to be about 141 feet from where the proposed cell tower is proposed to go. Heitner showed images of the subject property and surrounding area. Heitner next showed a schematic of the proposed cell tower, the proposed height is 190 feet, and a monopole design, not a whole bunch of guide wires or anything like that. For some of the residual mechanical that's at the ground level, there's going to be a few layers of screening, some fencing as well as some arbor variety trees, which is a good screening tree species. Heitner next went over the supplemental conditions that the County requires as part of their conditional use permit process. One is submission of a narrative liability insurance for the project and site plan and the narratives an important component as it's on the onus of the applicant to provide a justification for why the specific location is being selected for this use and why colocation on another preexisting tower is not an option. The applicant did detail that that and it was included in the staff report assemblage. Second condition is a setback requirement requiring the tower to be 110% of the tower height setback from parcel lines. The applicant did apply for a special exception with the County Board of Adjustment to reduce the setback requirement and that was approved just last night. So additional conditions from the County were installation of a landscape buffer, which can be seen in the schematic, as well as the security fencing. That fencing must be eight feet tall with some barbed wire strands on top of it and there's some specific lighting standards that the tower would have to conform to. Heitner noted there'd be an independent inspection of the tower every 36 months and submission of an operation and maintenance plan to the County as well as submission of a decommissioning plan should the use for the tower ever subside, they would need a plan on how the applicant or the tenant intends to take down the tower. Heitner said there must be compliance with County environmental standards and sensitive area standards and a notification that any alterations to tower height or location in the future would have to be legally conforming with County Zoning. In terms of City analysis, they look at this in a couple ways. One is how does the zoning check out in terms of what's allowable right now and the County zoning designation states this use is allowed in all of the County zones except for an environmental resource preservation district, so the County does permit this use in the current agricultural zoning district. Heitner did acknowledged it was noted in the staff report that this parcel is potentially an area that the City might consider for future growth boundary expansion. Right now the County has in their future Planning and Zoning Commission July 16, 2020 Page 4 of 8 land use map designated this area as potentially suitable for highway commercial or light industrial use. As far as the City staff review of how this use would fit in with those zones, they feel it would be compatible with those zones or with an agricultural zoning district as is the present case. Either way, staff does not feel that the overall character of the subject area will be greatly affected by the addition of the tower. Heitner reiterated when there are County requests, they collaborate in the analysis with County planning staff. In addition to all those supplemental County conditions, Heitner reiterated there was the request for setback reduction from the eastern property line that was approved last night by the Johnson County Board of Adjustment. That setback would be about 187 feet, which is almost 100% of the tower height, which is 195 feet. Another request staff worked on with the County is trying to get a written approval from the FAA that a structure of the height in proximity to the Iowa City Airport would be an allowable use. They don't suspect that will be an issue, but it is his understanding the County is going to make that a condition of approval of their conditional use permit. Heitner reiterated the role of the Commission tonight is to determine if the conditional use that was being applied for, a commercial communication tower within the City's Fringe Area, should be recommended for approval to the City Council. In terms of next steps after Commission and City Council consideration the item will be brought before the Johnson County Board of Adjustment for approval. Staff recommends approval of an application submitted by Ward Development Services, Inc. for a conditional use permit to allow for a commercial communications tower on the 4200 block of Yvette St. SW in unincorporated Johnson County. Craig asked if other service providers might use this tower in the future they can use that structure, and not create another structure for another service provider, they just use the same tower. Heitner believed that was correct, it something the applicant can touch on a little bit more, but his understanding is that this tower will have capacity for up to three more users. He doesn't really know what the lifespan of how quickly users get added to these towers and when new towers need to go up but he would imagine that this tower would provide pretty strong coverage area for this area for the foreseeable future. Martin said the application states what the applicant is going to do, but not why it is necessary. Heitner stated he doesn't recall the page number but there should be a report from the applicant that outlines the need for the tower in this location and why colocation on existing towers in the area was not a feasible option. Hensch added he read in the report that area had impaired coverage. Signs asked if the adjacent zoning is highway commercial or light industrial. Heitner confirmed the current adjacent zoning is Highway Commercial and there is a little rectangular piece that's just general County Commercial and the rest is agricultural. Signs stated he didn't see a topo and wondered what the elevations were there. He wanted to make sure they weren't on top of a hill, but it doesn't look like it given the drainage there. Hensch noted there is a topo on page 37 of the packet and it looks like the main line right by the A is 750 feet. Signs stated from his recollection, right at that curve to the west of there it starts to go down again fairly rapidly and fairly substantially. So that is definitely is the high spot out in that area from his recollection. Planning and Zoning Commission July 16, 2020 Page 5 of 8 Signs noted it seems to that the height of the tower is greater than the distance between the tower and the utility transmission lines and is there any concern about that. Heitner stated that was probably their biggest concern when they were evaluating this, the proximity of the tower to the transmission lines, and then also the eastern property line. There was a narrative by the applicant, and they could probably go over this more eloquently, but the understanding is that in in case of disaster where the tower would have to come down that the fall radius of the tower would be about half of the tower's height. So probably about 95 to 97 feet, because the understanding is that the tower is designed to where the break point would occur halfway in the tower's height, so with that said, if the fall radius is in that 95 to 97 foot range, it should be clear of that 141 foot distance to the transmission tower and then also the 187 foot distance to the east property line. Hensch noted in the packet there's a page from an engineer with the statement that the maximum fall zone radius equal to or less than half the height of the tower. Hensch opened the public hearing. Steve Ward (Ward Development) is representing AT&T Cingular Wireless PCS stated he is here to answer any questions the Commission may have. There were a couple of questions while Heitner addressed them Ward can give a little bit more information. AT&T has a hole in their network, a lack of coverage, this is an expanding area, and they need to bring additional services to this area. There are no existing structures in the area that meet their need, but there are two structures in the area he wanted to bring to their attention and let them know that they did look at the transmission towers, which can be a possibility. Some communities or some power districts allow attachments to those transmission towers, others do not, and Alliant does not. Additionally, those towers really aren't built structurally to the codes required for communication antennas, there's a different code and cell towers are at a higher standard than a transmission tower or a power pole and those kind of things. There's an existing communication tower located on Maier Road, which is to the northeast of the site, it's owned by American Tower and about 160 feet. It has two users that are existing upon the tower and it just doesn't allow the elevation they need for their coverage. Ward noted the lot that their using has some unique configurations as far as the property lines and with the County's required setbacks where they were trying to place the site. Therefore, they are placing it as far back into the property as they could away from the highway. Additionally, there is the transmission line with a very wide easement that cuts diagonal across it and there's a creek that kind of runs across the property in an east/west direction and affects elevations So what they tried to do with nestle the tower as close as they could to the easement line and as close as they could to where they start losing elevation, and then still keep it as far away from the property line to the neighbors to the east as they could. As mentioned, the County does have 110% of the tower height setback, Ward stated they mentioned to the County where 110% comes from or what the reasoning is neither here nor there, the tower is a monopole type tower. There are different types of towers, there are guide towers, there are self-support towers, and there's monopole towers. A lot of times these fall zone radiuses come from the guide towers because if a guide tower falls, it's either going to crumble upon itself or if it were hit just right it could topple in a direction. Self -supported towers, which would look like the erector sets, and monopole towers are typically designed with a break point or fail point. It sounds bad, but it just basically the weakest point in the tower as designed by code is going to be at the midpoint of the tower. So basically, if you can imagine trying to bend the soda straw, that's how the tower would fail and then if that soda straw would break apart, and then it would hit the ground and topple over, that's where you get the 50% radius. To the property line to the east they are at 187 feet so they're pretty close to almost making it, but again, Planning and Zoning Commission July 16, 2020 Page 6 of 8 they're far enough away with the fall zone. They did speak to that property owner, Mr. Kraus, he owns an asphalt company. Mr. Kraus had a similar concern, because he thought it was going to be right next to his building but they explained to him where it was and gave him the drawings, the survey and the tower fall radius letter. He then didn't have any problem with it. The other concern, which is a concern, as far as safety is what happens if the tower would fall and hit the powerlines, but again, with the tower fall radius, those power lines are about 141 feet away and with fall zone radius that more than takes care of that issue. Hensch asked what is the lifespan of this structure? Ward answered that's hard to say, it's a two- fold question. Typically, steel structures are 50 to 75 years, that's why the County has an inspection requirement and they've probably modeled that on FCC, who has a lot of regulations. The towers are inspected, monopoles are typically every five years, but the County wants them done every three years. An inspection is where somebody climbs up the tower and look at all the connections, at the bolts, look for rust, look at the Foundation, and then writes a report. If there's modifications or remedies that had to be made, they're made. Ward noted it was asked earlier if this tower would be used for other people. He replied that's the idea, vertical real estate. If someone else wants to use this such as Sprint, or Verizon or T - Mobile, they could put up to probably three platforms, three additional platforms on that height of a tower. In addition to that, a AT&T has a contract awarded by the federal government to build out a nationwide network called FirstNet, a network for first responders, and they're currently building that out nationwide. So FirstNet will also have the availability to use this site if they need it for their network. Hensch closed the public hearing. Craig moved to recommend approval of an application submitted by Ward Development Services, Inc. for a conditional use permit to allow for a commercial communications tower on the 4200 block of Yvette St. SW in unincorporated Johnson County. Signs seconded the motion. Martin stated a concern she hopes that the county addresses is that the people that are there that would could be affected have an opportunity to have a voice. She also noted that Larry Baker resigned from the Commission, so they have one vacancy. Those applications are due by the end of this month and hopefully they'll have a new Commissioner appointed by City Council and their first meeting will be in August. She also introduced Joshua Engelbrecht, he is the new planning intern. He's been with the City since May. The last thing Russett wanted to mention this isn't really related to Planning and Zoning, but Commissioner Townsend was joined by her husband on one of Mayor Teague's Community Connections Videos. Mayor Teague has been doing these community connection videos and having conversations with people throughout the community. The discussion with Commissioner Townsend and her husband aired earlier this week and she enjoyed listening to it and learning more about her, her activism and volunteerism in the community. Hensch noted how sad he was to hear of Baker's resignation as he always had thoughtful comments and he had a good humor and will be missed. He wants to welcome Engelbrecht and hopes that they're able to meet sometime in person. Installation of security fencing. 5. Specific lighting standards. 6. Independent inspection of the tower every 36 months. 7. Submission of an operation and maintenance plan. 8. Submission of a decommissioning plan. 9. Compliance with County Environmental Standards. 10. Alterations to tower height or location will have to be legally conforming City Analysis The commercial communication towers are allowed in all County zoning designations as a conditional use except for County Environmental Resource Preservation Zoning District (ERP). The Fringe Area Agreement directs uses in areas outside the City's Growth Boundary to be consistent with the rural agricultural character of an area The County's future Land Use Plan indicates this area as appropriate for development with intense commercial/low intensity industrial uses. Communication towers can be found both in other agricultural areas or near commercial uses. The overall character of the subject area will not be greatly affected by the addition of the tower.
