Resolution approving the City Street Finance Report for the fiscal
year ending June 30, 2020.
Comment Iowa Code section 312.14 requires all cities to submit the Street Finance
Report (SFR) to the Iowa Depar b-nent of Transportation by September 30 of each

6.b. Accepting Tobacco Penalty and Waiver of Right to Hearing,
Almost Paradise
Resolution accepting payment of $300.00 civil penalty and waiver
of right to hearing from Almost Paradise.
Comment This Resolution accepts a waiver of right to hearing and a payment of a
$300.00 civil penalty by Almost Paradise. The civil penalty is required by Iowa Code
Section 453A.22(2) due to a first instance of an employee selling or providing tobacco to
a minor within a two-year period.
6.c. Sand, Asphalt and Rods Materials Contract
Z(°I Resolution authorizing the procurement of sand, asphalt and rock
materials under the Sand, Asphalt and Rods Materials Contract.
Comment In March 2017, the City awarded a contract to S & G Materials to provide
sand products for one year with an option to renew for four years at an estimated annual
cost of $20,000 to $25,000. During the term of the contract the City's needs for materials
has increased and will result in a total cost in excess of the City Manager's spending
authority of $150,000.00. This resolution authorizes the City Manager to effectuate RAure
projects and renewals.

6.d. Rental of Wheel Loaders
2.-2 Resolution authorizing the rental of eight (8) wheel loaders for
snow removal operations.

Comment: This Resolution will approve the rental of eight (8) articulating wheel loaders
to be used for snow removal operations from November 15, 2020 through March 31,
2021. Request for Bid #21-210 was solicited for this rental. The total price for the rental
period is $166,400.00, which exceeds the $150,000.00 spending authority of the City
Manager, and so requires Council approval.
Procurement of Removal and Disposal of Lime Residual Material
Services
Resolution authorizing the procurement of Removal and Disposal
of Lime Residual Material.
Comment A Request for Proposals was made for the removal and disposal of lime
residual material from the Iowa City Water Treatment Facility. The City received two
proposals for this contract on July 31, 2020. After careful evaluation, the City is
recommending Nutri -Jett Systems Inc. for the two-year contact.
6.f. 28E Agreement with City of Coralville
2-0 Resolution authorizing the execution of a Chapter 28E Agreement
between the City of Iowa City, Iowa and the City of Coralville, Iowa
regarding certain road maintenance purposes.
Comment This resolution approves a Chapter 28E agreement with the City of Coralville,
Iowa regarding roads which are adjacent to or near the corporate limits of the City. This
agreement identifies the maintenance responsibilities for each governmental body for
these joint facilities.
6.g. Underground Duct and Fiber Installation to JECC

Resolution accepting the work for the Underground Duct and Fiber
Installation to JECC Communications Facility on Compass Drive

Comment The project has been completed by Utility Service Contactors of Hiawatha,
Iowa, in substantial accordance with the plans and specifications. The Engineer's
Report and Performance and Payment bonds are on file with the City Engineer.

Orchard Street Reconstruction
Resolution approving, authorizing and directing the Mayor to
execute and the City Clerk to attest an Agreement by and
between the City of Iowa City and Shive-Hattery, Inc. to provide
engineering consultant services for the Orchard Street
Reconstruction Project.
Comment This resolution authorizes an agreement for consultant services for the
Orchard Street Reconstruction Project. The total cost of the servioes is $109,050 and
will be funded by the Orchard Street Reconstruction Account #53954.

Comment At the Planning and zoning Commission's August 20, 2020 meeting, the
motion to recommend approval of the conditional use permitfailed by a vote of 3-3
(Townsend, Signs, and Craig dissent). The Commission recommended denial of the
proposed kennel and daycare facility due to the pro)dmity of neighboring residences
within City4imits. [Deferred from 09/01/2020]

10. Amend Water Collection Ordinance FY20
Ordinance amending Title 3, "City Finances, Taxation and Fees', Chapter
4, "Schedule of Fees, Rates, Charges, Bonds, Fines and Penalties",
Section 3, entitled "Potable Water Use and Service," of the City Code, to
increase or change water service charges and fees in Iowa city, Iowa and
amending Title 16, entitled "Public Works", Chapter 3A, entitled "General
Provisions", Sections 5, 6 and 7, entitled "Establishing City Utility
Accounts; Deposits Required", "Billing and Collection Procedures;
Delinquent Accounts" and "Discontinuation and Restoration of Service"
to make delinquent account collection fees and procedures more
equitable and just.
Comment The proposed ordinance is intended to provide for updates that pertain to the City's
initiatives in racial and social equity. The ordinance changes include an elimination of the shutoff
carding notice and the associated fee, a reduction of the service reconnection fee, and
a 5% increase in the late fees to provide for the cost to send customers a delinquent letter and
the ability to communicate notices to customers electronically onically via e-mail and text messaging.

11. Prohibition on Feeding Deer
�o -`-4g- Ordinance amending Title 8, entitled "Police Regulations," Chapter 4,
entitled "Animal Services," to prohibit feeding of deer. (Pass & Adopt)
Comment The CitVs Long -Term Deer Management Plan calls for consideration of amending the
City Code to prohibit intentionallyfeeding deer. This ordinance prohibits such feeding. ISU
Extension and Outreach, among other entities, recommends against feeding deer.

Comment Creation of an Ad Hoc Truth and Reconciliation Commission is one of the
commitments made by the City Council in Resolution No. 20-159 to address the Black Limes

13. State CDBG-CV Funding
2-0 _"-2-z--9 Resolution approving an application to the Iowa Economic Development
Authority for State CDBG-CV funds.
Comment The City of Iowa City anticipates receiving $686,610 in CDBG-CV funds from the
State of Iowa to prevent, prepare for, and respond to the COVID-19 pandemic. The City Council
will hold a public meeting and consider a resolution approving the application to the state and
proposed uses of funds.

14. Riverfront Crossings Affordable Housing Requirement - Fee -in -Lieu
2-0--2-30 Update
Resolution establishing the fee an owner may opt to pay in lieu of
providing affordable housing in the Riverfront Crossings District and
rescinding Resolution No. 18-213.
Comment The RKefront Crossings Affordable Housing Requirement allows for an owner to
oontribute a fee as a means to meeting the affordable housing requirement The ordinance
requires that the fee shall be determined biennially by resolution, based on a formula that
analyzes the difference between market rate units and units subject to the affordability
requirement The fee was set at $94,652 per unit in August of 2018. Based on this analysis
method, the proposed fee, effective after passage of this resolution, shall be $112,853.
