Comment: In partnership with Shelter House, the Iowa City Housing Authority has received 78 "Mainstream' Housing Choice Vouchers for people exiting homelessness who have a disabling condition. The Housing Authority will provide $139,008 in CARES Act funding to Shelter House to provide additional case management services for Mainstream Housing Choice Voucher participants. (SUB20-0002) Comment A preliminary plat of West Side Estates— Phase Two Subdivision - was approved on June 16th, 2020. Staff recommends approval of the final plat subject to approval of legal papers and construction drawings by the City Attorney and City Engineer. It is anticipated that legal papers and construction drawings will be approved prior to the October 6th City Council meeting. Approval will allow the development of West Side Estates— Phase Two Subdivision, a 13.10 -acre subdivision consisting of 39 residential lots located north of Rohret Road SW and West of Yuma Dave. Tegler Second Subdivision Resolution accepting the work for the storm sewer, sanitary sewer, water main, and paving public improvements for Tegler Second Subdivision, and declaring public improvements open for public access and use. Comment This item will accept the public improvements for Tegler Second Subdivision, generally located south of Rochester Avenue and east of Eastbury Drive. 6.e. Zoning Code Amendment - Commercial Reuse Exception Ordinance Motion setting a public hearing for November 2, 2020 on the Commercial Reuse Exception ordinance to amend Title 14 Zoning to allow exceptions to regulations for existing buildings in certain commercial zoning districts. (RE720-0006) Comment At its October 1 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of this amendment Approval will allow exceptions to zoning regulations for alternations and expansions to existing buildings due to building and/or site constraints in the Mixed Use (MU), Commercial Office (CO -1), Neighborhood Commercial (CN -1), Community Commercial (CC -2), Central Business Service (CB -2), and Central Business Support (CB -5) zoning districts. 7.b. (DRC20-00005) Comment The Staff Form -Based Code Committee has reviewed the proposed building design and finds that the proposal meets the requirements of the Riverfront Crossings Form -Based Code. Staff recommends approval subject to the following additional requirements: 1) The building shall be designed, constructed, and maintained to at least LEED Silver standards under the National Green Building Standard or the LEED Green Building Rating System. Confirmation of this must be supplied by the developer's architect. Although LEED certification is not required, at least eight points must be achieved from the LEED-NC Optimize Energy Performance credit 2) The developer must install and maintain rooftop solar to generate at least 42,000 kWh annually, and 3) The developer must install and maintain only low flow fixtures in the residential units and common bathrooms. Amend Water Collection Ordinance FY20 U "`t g �C - Ordinance amending Title 3, "City Finances, Taxation and Fees", Chapter 4, "Schedule of Fees, Rates, Charges, Bonds, Fines and Penalties", Section 3, entitled "Potable Water Use and Service," of the City Code, to increase or change water service charges and fees in Iowa city, Iowa and amending Title 16, entitled "Public Works", Chapter 3A, entitled "General Provisions", Sections 5, 6 and 7, entitled "Establishing City Utility Accounts; Deposits Required", "Billing and Collection Procedures; Delinquent Accounts" and "Discontinuation and Restoration of Service" to make delinquent account collection fees and procedures more equitable and just. (Pass & Adopt) Comment The proposed ordinance is intended to provide for updates that pertain to the Citys initiatives in racial and social equity. The ordinance changes include an elimination of the shutoff carding notice and the associated fee, a reduction of the service reconnection fee, and a 5% increase in the late fees to provide for the cost to send customers a delinquent letter and the ability to communicate notices to customers electronically via email and text messaging. Short -Term Rentals 20 `f8 Ordinance amending Title 17, entitled "Building and Housing," Chapter 5, entitled "Housing Code," to provide rental permit requirements for short- term rental properties. (Second Consideration) Comment: In June the Iowa legislature passed a bill limiting the ability of local governments to regulate short-term rentals, such as Airbnb. The bill does allow the City to regulate for health and safety as well as property maintenance and nuisances if short-term rentals are treated the same as similar properties and no fees are charged. Comment: An Amendment is proposed to the FY20 Annual Action Plan to fund activities to aid in a community response to COVID-19. The City of Iowa City has been allocated an additional $424,128 in CDBG-CV funds for this purpose. Comment The City has the authority under Iowa Code §364.136 to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. This assessment is being pursued only after the City took many steps to resolve the matter. The City notified the homeowners to abate the nuisance (for example, to remove snow from the sidewalk) and after the homeowner did not take action to abate the nuisance, the City abated the nuisance and billed the owner. After being Uilled at least twice, these owners stil have not paid the abatement costs. The City has sent a letter to the homeowner gMng them notice that this resolution would be on the agenda, a copy of which is attached to the resolution. No interest will be charged if the owner pays within 30 days of the first required publication.
