October 2020 Disbursements Motion to approve disbursements in the amount of $12,086,464.61 for the period of October 1 through October 31, 2020, as recommended by the Finance Director subject to audit. Disbursements are published and permanently retained in the City Clerk's office in accordance with State Code. 6.b. Iowa City Downtown District Budget Motion to accept the proposed FY22 budget for the Iowa City Downtown District, as approved by the Iowa City Downtown District Advisory Board. Comment Per the Operating Agreement between the Iowa City Downtown District (TCDD) and the City of Iowa City, the TCDD Advisory Board must hold a public meeting to approve the proposed budget and submit it to City Council by December 1 each year. The organization requested an extension of the December 1 deadline to December 15. 6.c. 2020 Water Pavement Patching - Z7 Lo Resolution accepting the work for the 2020 Water Pavement Patching Project. es 3O -Z111 Comment: The project has been completed by All American Concrete, Inc. of West Liberty, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. • Project Estimated Cost: $ 150,000.00 • Project Bid Received: $ 129,735.00 • Project Actual Cost: $ 312,562.75 Sidewalk Cafe Fees Resolution waiving the annual fees for sidewalk cafes for the 2021 season. Comment The sidewalk cafe policy approved by Council includes an annual fee to use the ped mall and right of way for commercial purposes. Because of the impact of COVID- 19 on businesses, this resolution will waive the fees for the 2021 season except for the fee to record the agreement December 15, 2020 Iowa City City Council Agenda Page 3 6.e. Camp Cardinal Dedication to Right -of -Waw 20 - 2-7 g Resolution approving the dedication of approximately 4 square feet of property west of Camp Cardinal Road to the City of Iowa City Camp Cardinal Road right-of-way. Comment At its meeting on 10/15/2020, the Planning and Zoning Commission recommended approval of a vacation of approbmately 2,815 square feet of Camp Cardinal Road right-of-way to help facilitate development on an adjacent property to the west, owned by Jon Harding. To maintain a consistent, 66 ft wide right-of-way, approArnately 4 square feet of the adjacent parcel needs to be dedicated to the City. The City Council approved the vacation of Camp Cardinal Road right-of-way on 12/01/2020. Approval of this resolution will allow for a consistent 66 ft. wide right-of-way on Camp Cardinal Road. 6.f. Partial Vacation of Conservation Easement Agreement -2-0 "�29 Resolution authorizing the Mayor to sign and the City Clerk to attest a Partial Vacation of Conservation Easement Agreement for Lot 97, Walnut Ridge, Part 10. Comment Brian and Heather Stevens ("Applicant'), owners of 70 Aller Court, desire to install a swimming pool, landscaping and hardscaping within an area currently encumbered by a conservation easement agreement with the City. Staff finds that reducing the conservation easement area on their property will not have a material impact on the sensitive areas. 7. Setting Public Hearings 7.a. Rezoning at 410 and 412 N. Clinton Street Motion setting a public hearing for January 5, 2021 on an ordinance rezoning approximately 12,000 square feet of land located at 410 and 412 N. Clinton Street from High Density Multi - Family Residential (RM -44) to High Density Multi -Family Residential with a Historic District Overlay (OHD/RM-44). (RE720-0009) Comment At its meeting on December 10, 2020 the Historic Preservation Commission will be considering this local landmark rezoning. Scott Boulevard Trunk Sewer Extension 20 -2-80 Resolution setting a public hearing on January 5, 2021 on project manual and estimate of cost for the construction of the Scott Boulevard Trunk Sanitary Sewer Extension Project, directing City Cleric to publish notice of said hearing, and directing the City Engineer to place said project manual on file for public inspection. Comment The project generally includes the extension of a 24inch sanitary sewer from the Iowa Interstate Railroad northward along the North Branch of Snyder Creek to American Legion Road. Fringe Area Rezoning - Rapid Creek Road NE Letter to the Johnson County Planning and Zoning Commission in support of a rezoning from County Agricultural (A) to County Residential (R) for approximately 40.62 acres of property located in e, -WG`' unincorporated Johnson County, south of the Rapid Creek Road NE and Rapid Creek Trail NE intersection in Fringe Area A - outside of Iowa City's Growth Area. Comment At its December 3 meeting, by a vote of 6-0 (Craig absent) the Planning and Zoning Commission recommended approval of the proposed rezoning. Although the proposed rezoning is not consistent with the policies in the adopted Fringe Area Agreement, the Commission recommended approval since the rezoning is consistent with the Countys Future Land Use Map, surrounding land uses, and City staff is working with County staff on amending the Fringe Area Agreement in a way that would be consistent with this application. Idyllwild Drainage Diversion 2-0-2-81Resolution approving project manual and estimate of cost for the construction of the Idyllwild Stormwater Drainage Diversion Project, establishing amount of bid security to accompany each bid, directing City Clerk to post notice to bidders, and fixing time and place for receipt of bids. Comment: The Idyllwild Drainage Diversion Project includes the construction of new storm sewers under Foster Road and Taft Speedway and a drainage swale along the west side of No Name Road to the Iowa River. The project will also include a bid aftemate for a new pump station at the outlet of the Idyllw ld Subdivision stormwater management system. The estimated cost for this project is $559,000 and will be funded by Account #P3976- Idyllwild Drainage. 1. (Pass & Adopt) Comment: Iowa City policy has long prohibited biased based policing and the Iowa City Police Tj Department is committed to the equitable treatment of all individuals. This ordinance was developed collaboratively with the NAACP and takes the important step to codify the Citys Q commitment to unbiased policing and details the complaint process for the public.
