A resolution to annex approximately 196.17 acres of land located west of Highway 218 and south of Rohret Road. Whereas, Thomas L. Carson and Linda A. Carson Revocable Living Trust, James T. Carson Revocable Trust, Rebecca Albertson Revocable Trust, Steven M. Carson are the owners and legal titleholders of approximately 196.17 acres located at Eastbrook Street and American Legion Road;and Whereas, the applicant, MMS Consultants, with the consent of the owners, has requested annexation of the approximate 196.17 -acre tract into the City of Iowa City, Iowa; and Whereas, the aforementioned property is located within the Long -Range Planning Boundary of the City of Iowa City, and Whereas, control of the area proposed for annexation is in the City's best interest because it will allow development in a manner consistent with the Comprehensive Plan; and Whereas, pursuant to Iowa Code 368.5 and 368.7 (2020), notice of the application for annexation was sent to the Johnson County Board of Supervisors, Johnson County departments of Attorney, Auditor, Engineer, Planning and Zoning, each affected public utility,' Union and West Lucas Townships, the Metropolitan Planning Organization of Johnson County, and the East Central Iowa Council of Governments; and - Whereas, none of these entities have objected to the proposed annexation; and Whereas, the Planning and Zoning Commission has reviewed the proposed rezoning and has recommended approval. Section IV. Certification And Recording. Upon passage and approval of the Ordinance, the City Clerk is hereby authorized and directed to certify a copy of this ordinance and to record the same, at the office of the County Recorder of Johnson County, Iowa, at the owner's expense, all as provided by law. Section V. Repealer. All ordinances and parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section VI. Severability. If any section, provision or part of the Ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Owner and Applicant acknowledge that the City wishes to ensure conformance to the principles of the Comprehensive Plan. Further, the parties acknowledge that Iowa Code §414.5 (2020) provides that the City of Iowa City may impose reasonable conditions on granting a rezoning request, over and above the existing regulations, in order to satisfy public needs caused by the requested change. 3. In consideration of the City's rezoning the subject property, Owner and Applicant agree that development of the subject property will conform to all other requirements of the Zoning Code, as well as the following conditions: a. The developer satisfies the Comprehensive Plan's Annexation Policy, as stated in Resolution 18-211. 4. The conditions contained herein are reasonable conditions to impose on the land under Iowa Code §414.5 (2020), and that said conditions satisfy public needs that are caused by the requested zoning change. 5. This Conditional Zoning Agreement shall be deemed to be a covenant running with the land and with title to the land, and shall remain in full force and effect as a covenant with title to the land, unless or until released of record by the City of Iowa City. The parties further acknowledge that this agreement shall inure to the benefit of and bind all successors, representatives, and assigns of the parties. In the event the subject property is transferred, sold, redeveloped, or subdivided, all development will conform with the terms of this Conditional Zoning Agreement. 6. Nothing in this Conditional Zoning Agreement shall be construed to relieve the Owner or Applicant from complying with all other applicable local, state, and federal regulations. This Conditional Zoning Agreement shall be incorporated by reference into the ordinance rezoning the subject property, and that upon adoption and publication of the ordinance, this agreement shall be recorded in the Johnson County Recorder's Office at the Applicant's expense. M ,res .r o.r• • In 2012 HDR completed the Taft Speedway Flood Mitigation Study which further evaluated the feasibility and impacts of constructing various flood mitigation alternatives • From the results, HDR recommended rerouting off-site drainage to alleviate pumping needs and reduce the risk of flooding caused by locally heavy rains • Council directed staff to evaluate the drainage area flowing into Idyllwild and the determine the best method to reroute off-site stormwater Current Project • HR Green completed a study of the Idyllwild drainage system and stormwater bypass alternatives in 2016 • Evaluated the watershed north of Foster Road and identified deficiencies within the existing storm sewer • Two (2) alternatives were developed at a preliminary level • HR Green hired in 2017 to evaluate the results of the 2016 study, determine the best alternative, and design the desired alternative • Project includes new storm sewer under Foster Road and Taft Speedway and a drainage swale along the west side of No Name IOM • The project also includes a small pump station as a bid alternate w, t ♦- YIIAYY 4-1[4R .�a .�a Project Coordination • City Staff has conducted public meetings throughout the study phase • City Staff also met with Idyllwild and the Forest View developers to discuss stormwater concerns related to existing and anticipated post -development stormwater management • As a part of these discussions, there was particular interest from the neighborhood to include a pump station with the project as part of a larger flood mitigation system Funding Scenarios • The stormwater diversion portion of the project is funded by Stormwater Utility funds • The City plans to include a small pump station as a bid alternate • If bids on the diversion come in low, extra funds will be used to construct the pump station if budget allows • If there is a funding shortfall for the pump station bid alternate, the City has discussed a potential funding agreement with the Idyllwild HOA to cover the difference Questions?
