DRAFT COMMUNITY POLICE REVIEW BOARD MINUTES — NOVEMBER 15, 2022 CALL TO ORDER: Chair Jerri MacConnell called the meeting to order at 5:30 p.m. MEMBERS PRESENT: Ricky Downing, Melissa Jensen, Jerri MacConnell, Saul Mekies, Amanda Remington, Orville Townsend, Stuart Vander Vegte MEMBERS ABSENT: None STAFF PRESENT: Staff Tammy Neumann, Legal Counsel Patrick Ford OTHERS PRESENT: Iowa City Police Chief Dustin Liston RECOMMENDATIONS TO COUNCIL (1) Accept the proposed addition to section 8-8-3(B) of the CPRB Ordinance. See memo from CPRB attached. CONSENT CALENDAR Motion by Townsend, seconded by Vander Vegte, to adopt the consent calendar as presented. • Minutes of the meeting on October 11, 2022 • ICPD Use of Force Review/Report— May 2022 Motion carried 7/0. NEW BUSINESS Discussion of Draft Ordinance 8-8 Amendment: At the October 11, 2022 meeting, MacConnell requested that the Board discuss adding a clarification to the CPRB Ordinance 8-8 to state that complaints filed based on what is gathered from social media, television, or other media outlets do not meet the required requisite of personal knowledge. Counselor Ford drafted a memo from the Board to City Council requesting the following addition to section 8-8-3(B) of the CPRB ordinance as follows: "A person who observes an incident solely on social media, television, or other media outlets does not have the requisite "personal knowledge" needed to authorize such person to file a complaint." MacConnell suggested this addition also apply to CPRB members who may want to file a complaint. Ford explained this change does not include the Board, however, if there is a concern about something a Board member saw on social media, the Board would need a majority vote to move forward in filing a complaint. Remington stated she would not agree to a motion that would remove any power from the Board. Motioned by Mekies, seconded by Jensen, to approve the proposed addition to section 8-8-3(B) of the CPRB ordinance as written and forward to City Council. Motion carried 7/0. CPRB Meeting Minutes November 15, 2022 Page 2 Ford will communicate with the City Attorney's office letting them know that the Board has passed the requested addition to the ordinance and are asking City Council to make the amendment. OLD BUSINESS None PUBLIC DISCUSSION None BOARD INFORMATION Vander Vegte requested an item for discussion to the December 13, 2022 agenda. He asked if it would be possible for the board members to receive training regarding citizens' rights during an arrest and information regarding police procedures. MacConnell noted the invite in the CPRB packet regarding the 2023 Community Police Academy. Townsend asked for input from Chief Liston regarding Vander Vegte' s request. Chief Liston stated he appreciated that it may be difficult to form an opinion of what is on a video without knowing these policies. He too encouraged all to apply for the Academy. He further noted that all the general orders are available online and added that members are welcome to request a ride -along with a police officer at any time. Jensen noted some necessary changes to the CPRB member list to include adding the title of chair to MacConnell and removing vice -chair from Townsend. STAFF INFORMATION Neumann pointed out the flyer in the packet inviting members to participate in the "Iowa Public Records and Open Meetings Law Training" on Thursday, December 8, 2022 via Zoom. Neumann asked the board to review the members list, included in the meeting packet, for any necessary changes. MEMORANDUM DATE: November 16, 2022 TO: City of Iowa City Council FROM: Community Police Review Board Members Re: proposed amendments to Ordinance 8-8 requested by the Community Police Review Board •+r�»�.rwrrr�.»»rrr.rrrw»rr:».rr»r.xa»x».»»x+r.»�x»:»»xxxsxwxrra,rrwxrrxrrxx»sr»»rrxs,.:r�x The members of the Community Police Review Board request that the City Council consider adopting the following proposed revision to section 8-8-3(B) of the CPRB ordinance (with suggested additions shown with underlined text): Any person with personal knowledge of the alleged police misconduct may file a complaint with the board. In order to have personal knowledge", the complainant must have been directly involved in the incident or witnessed the incident. A person who observes an incident solely on social media, television or other media outlets does not have the requisite "Personal knowledge" needed to authorize such person to file a complaint. If the person with personal knowledge is underage or otherwise unable to complete a complaint form, the complaint may be filed by such person's designated representative. The City Manager, the Police Chief, the City Council or the board itself may file a complaint based on a reasonable belief that police misconduct has occurred regardless of personal knowledge. The person or official filing the complaint may hereafter be referred to as the "complainant". TO: Chief Dustin Liston FROM: Sgt. Andrew McKnight RE: June 2022 Use of Force Review DATE: December V, 2022 The Iowa City Police Department policy requires an employee to complete a written report for any reportable use of force. Reportable use of force is defined in the Department's General Order 99-05, which is titled Use of Force and available for public viewing on the department's website. This policy provides employees with guidelines on the use of deadly and non -deadly force. Upon receipt of the report, the supervisor is responsible for completing an administrative critique of the force. This process includes interviews with involved employees, body worn and in -car camera review, review of any additional available video, and review of written reports. The employee's use of force report and the supervisor's critique is then forwarded to the Captain of Field Operations and the Chief of Police for final review and critique. On a monthly basis, the previous month's use of force reports and supervisor critiques are reviewed by an administrative review committee consisting of a minimum of three sworn personnel. This Use of Force Committee consists of two supervisors as designated by the Chief of Police and one officer, typically a certified use of force instructor. The Use of Force Review Committee met on December 1 st, 2022. It was composed of Sgt. McKnight, Sgt. J. Fink, and Officer Colin Fowler. For the review of submitted reports in June, the Review Committee documented the following: • 39 individual officers were involved in 20 separate incidents requiring use of force. • There were no documented cases of an officer exercising his/her duty to intervene and the review of the incidents did not indicate that an officer failed their duty to intervene. • Out of the 20 uses of force, 18 involved force being used against people. There were two animals euthanized by officers. • Out of the 39 officers involved in the 28 uses of force against people, 1 superficial injury was sustMt``i+ed by a suspect and 5 superficial injuries were sustained by officers. • No violations of policy were noted during this review period. • Out of the 18 uses of force against people, arrests were made 16 times (88%). • Mental health was identified by officers as being a factor in seven of the uses of force used against persons - —o (38%). _ • Drugs and/or alcohol was identified by officers as being a factor in fifteen of the 18 uses.ofTorce against persons (83%). cst • Out of the 18 times force was used on persons, three were identified as white females (15%), six * to e identified as white males (33%), six were identified as black males 33(%) and two were identified as black females (11%). • Out of the 20 uses of force, the average number of officers involved in the force was 1.9. • In total during this time, the ICPD had 5,860 calls for service with 18 calls for service resulting in force being used on persons. Upon arrival, the subject refused medical attention and attempted to ride away from officers. The subject was found to have an active arrest warrant. One officer stood in front of the subject who was attempting to leave on her bike. Another officer pulled the subject's arms behind her back and placed handcuffs on to each wrist. The subject was then told to get off of her bike, but she refused. One officer took hold of the subject's leg with their hand and the subject continued to pull away. This caused the subject to fall to the ground. Officers then lifted the subject by taking hold of the subject's left arm and lifting her to her feet. The subject refused to walk and so one officer continued to hold her left arm and left leg, while another officer took hold of her right legand right arm, June 2022 placing the subject into a waiting police vehicle. For a brief second the subject braced herself in the doorway refusing to get into the vehicle, however, an officer pressed the subject's upper body towards the vehicle, and she sat in the vehicle with minimal assistance. The subject was transported to jail without injury to the subject. One officer received minor injuries. Evening 6T1 2O22004120 Mental Health Y Officers responded to Watch — Crisis youth shelter for a subject Two who had stated that she Officers had a plan for suicide. The subject was violent and aggressive towards officers, throwing a box fan at an officer, fighting with others in the shelter, and refusing to go to the hospital for treatment. One officer controlled her left arm by holding her upper wrist while the subject pulled away and flailed around attempting to escape their grasp. Another officer placed their hand on to the subject's right arm, directing the subject to a nearby cot. At one point the subject threw herself to the ground and officers continued to hold the subject's arms, lifting the subject on to the cot, holding the subject's arms and legs. The subject was transported to the hospital for a mental health evaluation. There were no June2022 injuries to the subject or officers. Late Night 6/3 2022004153 Public Y Officers observed a highly Watch — Intoxication intoxicated subject One Officer stumbling in the street holding an open container of alcohol. Officers attempted to check the welfare of the individual however the individual ran from officers. An officer placed both hands on the subject's shoulders and pushed the subject to place the subject on the ground. The subject continued to run a short distance and was caught and handcuffed without incident. There were no injuries to the subject or officers. The female was seen punching and kicking the glass window, yelling profanity at the patrons inside the bar. A decision was made to arrest the subject and one officer took hold of her left wrist, telling her to place her hands behind her back. The subject pulled away, hit the officer in the forearm and grabbed the officer's hand to force the officer to let go of her wrist. The subject then dropped to the round and pulled away June2022 from the officer. An officer took hold of the subject's left wrist and pulled her to a standing position where she continued to pull away from officers. The subject was pulled forward where she laid face down on the ground. One officer pulled the subject's left arm behind her back while kneeling on the back of her thighs to hold her arms in place so that another officer could complete the handcuffing process. The subject continued to verbally abuse and kick out towards officers. The subject was lifted to a standing position by her left arm pit and walked towards a waiting squad car. The subject would take several steps towards the vehicle then stop, digging her heals into the ground preventing officers from walking her to the vehicle, trying instead to become a dead weight, kicking at officers and kicking the vehicle. One officer told the subject that she would be sprayed with a chemical irritant if she didn't stop her assaultive behavior. The subject continued to resist entering the vehicle, pulling away from officers until officers were able to place her into the vehicle. The subject continued to thrash her body around, the result of which was that she fell out of the stationary June 2022 vehicle. An officer slid their hands under her right arm pit pulling her back into the squad car while another officer pushed her back towards the vehicle while she continued to kick out towards officers. An officer attempted to spray the subject, but the chemical failed to disperse. The subject reached back towards an officer and placed her hands on their taser device. The officer instructed her to let go of the taser however she ignored all commands. The officer delivered three closed fist strikes to her right oblique muscles to get her to release her grip. This had no effect. An officer rolled the subject on to her stomach then delivered 5 rapid closed fist strikes to her back, imploring her to let go of their taser. The subject let go and the officer was able to close the door despite her continuously kicking out. The subject was transported to jail where she continued to assault jail staff. There were no injuries to officers or subject as a result of this use of force. Evening 6/4 2022004208 Domestic Y Officers responded to a Watch — Fight residence for reports of a Four domestic fight. Upon Officers arrival, officers encountered a male who was thought to have been involved. When June 2022 approached, the subject adopted a fighting stance, clenched his fists and turned towards officers. Officers had identified the male as having violated an order of protection. Officers told the subject that he was under arrest and the subject back peddled away from officers ignoring commands to place his hands behind his back. An officer used their left hand to take hold of the subject's right wrist and right elbow. Another officer took hold of the subject's left arm and pulled him closer. The subject continued to pull away and twist his body. One officer sprayed the subject in the eyes with a chemical irritant. An officer then placed their feet in front of the subject's feet in an attempt to trip the subject, but the attempt failed, and the subject continued to pull away and flail around. An officer used their right arm to grab around his shoulders, spinning him around causing him to land on his knees in the grass. Officers pulled the subject's arms back behind his back and handcuffs were placed on to each wrist. The subject declined medical treatment and was transported to jail after flushing the subject's eyes with water. There were no June2022 injuries to the subject or officers. Late Night 6/5 2022004213 Trespass Y Officers were dispatched to Watch — a bar for a trespass issue. Two Upon arrival, officers Officers located an intoxicated male outside the bar. It was discovered that the male had been assaultive towards staff. Due to his high level of intoxication the male was on all fours on the ground. The male was told by officers that he was under arrest and that he should stay on the ground. The male attempted to get up ignoring all commands. Officers used their hands to take hold of the subject's wrists, pulling his hands behind his back and securing handcuffs. At the subject's request he was transported to the hospital where he fought with medical staff members. Officers were asked to assist getting him into soft restraints. Officers held the subject's legs in place while restraints were placed around his ankles. There were superficial injuries to both the officer and subject. Day Watch 6/6 2022004251 Trespass Y Officers responded to a — Two residence for reports of a Officers subject trespassing on the property and refusing to leave. The subject was offered rides to the Guide Link Center or Shelter House but refused to leave. The subject was June 2022 told that she was under arrest and to place her hands behind her back. The subject complied at first and an officer placed one handcuff on her left wrist before she began pulling away. After the subject continued to pull away an officer pushed the subject facedown on to a nearby couch. An officer pulled the subject's right wrist behind her back and completed the handcuffing process. An officer placed their hands under the subject's left armpit and helped the subject to her feet. The subject walked to a nearby squad car dragging her feet intermittently. The subject was transported to jail without injury to the subject or officers. Day Watch 6/6 2022004256 Injured Animal N Injured raccoon, shot and — One killed by officer. Officer Evening 6/7 2022004294 Weapons Y Officers assisted another Watch — Offense agency by conducting a One Officer felony traffic stop on a subject driving a vehicle thought to have been involved in pointing a gun at another motorist. Officers drew their service weapons and pointed their weapons at two subjects as they were ordered out of the vehicle. The subjects were taken into custody without issue. The officers put their weapons back into their holsters and roceeded to clear the June 2022 vehicle where two handguns were recovered. There were no injuries to the subject or officers. Evening 6/16 2022004582 SRT Warrant N As part of an investigation Watch — Service into a shooting, the Special Two Response Team was Officers utilized to perform a surround and call out warrant service to secure a residence. Officers surrounded the residence with weapons drawn as subjects were lead from the house. Officers had weapons on display as residents were escorted from the house. There were no injuries to subjects or officers. Evening 6/18 2022004660 Domestic Y Officers were dispatched to Watch — Fight reports of a male who had One Officer been involved in a physical altercation with a female. An officer located the male half of the altercation walking along the sidewalk. The subject ran from the officer and continued to reach in his waistband while running. The officer tackled the subject by wrapping their arms around the subject and laying him face down on the ground. The officer pulled the subject's arms behind his back and the officer placed handcuffs onto the subject's wrists. The subject was arrested without injury to the subject or officers. Late Night 6/19 2022004672 Weapons Y Officers observed a subject Watch — Offense throw a firearm underneath a nearby vehicle and June 2022 Two attempted to walk away Officers from officers. One officer ordered the male subject to stop, however the subject ran from the officer. After a brief foot chase one officer placed both of their hands on the subject's hands and pulled the subject s arms behind his back. The subject pulled away and began running from the officer again. The officer caught the subject, placed both of their hands on the subject's shoulders and pushed the subject to the ground. The subject got back up again and started to run when another officer wrapped their arms around the subject and pulled the the subject to the ground. An officer told the subject to place their hands behind his back and handcuffs were placed on to the subject's wrists. The subject was not injured, and one officer sustained superficial injuries. The subject was transported to jail. Late Night 6/19 2022004674 Public Y Officers responded to a bar Watch — Intoxication for an intoxicated subject Three who was knocking on the Officers door after hours, refusing to leave. The subject was arrested, handcuffed, and walked towards a patrol car where the subject refused to enter the vehicle. After several attempts to convince the subject to enter the vehicle were unsuccessful, one officer June 2022 used a pressure point technique behind the subject's ear in order to get his body to bent. Once bent, officers attempted to push the subject into the vehicle. One officer used their hands to push the subject's upper body and legs into the vehicle, while another officer pulled the subject placing their right hand underneath the subject's left arm in an attempt to pull the subject into the vehicle. The door was closed, and the subject was transported to jail. There were no injuries to the subject or officers. Evening 6/21 2022004736 Traffic stop Y During a traffic stop a male Watch — subject attempted to Four swallow an unknown Officers substance and refused to comply with officers' commands during the stop. When told to open his mouth the subject refused and elected to drop to one knee. Officers moved him on to his stomach as he flailed around, refusing to be handcuffed, pulling his arms away from officers. One officer took hold of the subject around the lower head and applied pressure to the subject's jaw line in an attempt to get the suspect to spit out the contraband that he had ingested. Officer's took hold of the subject's arms and pulled them behind his back. The subject continued to pull away and Jme 2022 a chemical irritant was sprayed into the subject's eyes. Officers continued to pull the subject's arms behind his back placing on handcuff onto the subject's right wrist. The subject's right arm was then pulled behind the subject's back while an officer -maintained pressure on the subject's head, keeping the subject from getting to his feet. Handcuffs were secured and the subject was decontaminated by JCAS and transported to hospital. There were no injuries to the officers and superficial injuries to the officer. Evening 6/21 2022004740 Domestic Y Officers responded to a Watch — Fight residence for reports of a Two domestic fight. A male Officers subject was arrested and placed into handcuffs without incident. Once at the back of the vehicle he refused to enter the vehicle, backing away from the vehicle. One officer took hold of his left arm and pulled him back towards the vehicle. The subject continued to pull away, tensing his arms. An officer guided him into the vehicle by taking hold of his left wrist and right elbow, placing him inside the vehicle. An officer placed their right arm on the center of the subject's back, holding him inside the vehicle. The subject continued to attempt to stand up, so an officer June 2022 continued to push down on the subject's shoulders pushing him down into a seated position. Another officer grabbed the subject under both arms and pulled him into the vehicle then closed the door. The subject continued to place his foot in the other doorway. An officer went over to the driver's side rear door and pulled the subject's upper body into the vehicle so that the door could be closed. There were no injuries to the officers or subject. Evening 6/23 2022004808 Suspicious Y Officers encountered an Watch — Activity individual riding a bike with Two no lights, and the bike Officers turned out to be stolen. Once the subject got off the bike he ran from officers. After a brief chase the subject laid down on the ground. One officer kneeled beside the subject and took hold of his right wrist with both of his hands and held it behind his back. One officer took hold of the subject's left arm and used their right hand to place the subject into an arm bar position. An officer placed a handcuff on the subject's left wrist, however, the subject continued to pull his arm to the front of his body. One officer used both hands and their right knee to pry the subject's hands from the front of his body. Handcuffs were then laced onto the subject's June 2022 wrists. One officer helped the subject to his feet lifting the subject off the ground by placing their hand underneath the subject's right arm pit. The subject was searched then placed into a patrol car for transport to jail. There were no injuries to the subject or officers. Evening 6/24 2022004846 Domestic Y Officers located a male Watch — Fight subject who had been One Officer involved in a fight with a female subject. The male provided a false name to police and it turned out that the male subject had an active arrest warrant and was violating an order of protection. An,officer placed the subject under arrest, took hold of the subject's right wrist with both of their hands, and placed the subject into a wrist lock in order to pull the subject's left arm behind his back. The subject tensed his arms and pulled away from the officer. An officer told him that he would be sprayed with a chemical irritant if he continued to refuse to comply. The officer pulled the subject's arms behind his back and handcuffs were placed on to each wrist. An officer kept hold of the subject's left arm while walking to the vehicle as he continued to pull away from the officer. While officers were searching the suspect, he June2022 gestured that he was going to spit in their faces. An officer grabbed him on his right arm and used their left hand to place it on to the back and shoulder area, placing him into the vehicle. The subject braced his feet in the doorway and an officer pulled the subject's feet into the doorway. The subject sat up and spat in the officer's face. An officer placed the palm of their hand into the subject's face pushing him down into the vehicle so that the door could be shut. Before the door could be shut, he kicked the officer in the chest. The subject was transported to jail without injury to the subject or officer. Evening 6/26 2022004879 Disorderly Y Officers responded to Watch — Conduct reports of subjects One Officer throwing fireworks off the top of a parking structure. Upon arrival, the subjects began to run from an officer. After a brief foot chase an officer caught up with a male subject, placed their hands on to the subject's shoulders and placed their foot in front of the subject causing him to fall to the ground. While on the ground the subject refused commands to place his hands behind his back. An officer took hold of the subject's arms, using their hands to pull the subject's arms behind his June2022 back. Handcuffs were placed on to each wrist. There were no injuries to the subject or officers. Day Watch 6/30 2022005019 Mental Health N Officers were dispatched to — One Crisis a residence where a Officer female subject was throwing objects from her porch, while having a mental health crisis. Officers attempted to de- escalate the female for about 90 minutes until it became apparent that the subject needed to be taken to the hospital for a mental health evaluation. An officer took hold of the subject's left arm as she held on to the porch railing. The paramedics on scene decided to administer a calming sedative. Prior to that, the subject dropped to her knees and pulled her arms in front of her body. An officer guided her to the ground, laying her on her back. While doing so, the subject pulled her arm towards her face which brought the officers arm close to her face. The subject then bit the officer's wrist. An officer placed their hand on the subject's head, puling her head back away from their wrist. An officer held the subject's left wrist close to her body while paramedics administered the sedative. The subject spat on officers. An officer covered the subject's mouth with her shirt to prevent being June 2022 spat on. An officer then assisted paramedics with carrying the subject to a cot in the ambulance. There was an injury to one officer and no injuries to the subject.
