Draft COMMUNITY POLICE REVIEW BOARD MINUTES —January 10, 2023 CALL TO ORDER: Chair Jerri MacConnell called the meeting to order at 5:27 p.m. MEMBERS PRESENT: Melissa Jensen, Jerri MacConnell, Saul Mekies, Stuart Vander Vegte MEMBERS ABSENT: Ricky Downing, Amanda Remington, Orville Townsend STAFF PRESENT: Staff: Tammy Neumann, Legal Counsel: Patrick Ford OTHERS PRESENT: Iowa Ceti Police Chief Dustin Liston RECOMMENDATIONS TO COUNCIL None CONSENT CALENDAR Motion by Jensen, seconded by Vander Vegte, to accept the consent calendar as presented. • Minutes of the meeting on December 13, 2022 • ICPD Policy 309 (Officer Response to Calls) Motion carried 4/0 (Downing, Remington & Townsend absent) NEW BUSINESS Discussion regarding ICPD Policies Related to Domestic Terrorism Groups: Vander Vegte asked if the Iowa City Police Department has a policy addressing officers potentially being members of domestic terrorism groups. He went on to say there are a growing number of law enforcement officers who are involved in domestic terrorism groups around the nation and world. Chief Liston referred to section 320, "Standards of Conduct', of the ICPD Policy Manual. Specifically, sections 320.5.3, "Discrimination, Oppression, or Favoritism"; 320.5.4(d), 'Relationships"; and 320.5.9(m), "Conduct'. 320.5.3 Discrimination, Oppression, or Favoritism: Unless required by law or policy, discriminating against, oppressing, or providing favoritism to any person because of actual or perceived characteristics such as race, ethnicity, national origin, religion, sex, sexual orientation, gender identity or expression, age, disability„ economic status, cultural group, veteran status, marital status and any other classification o status protected by law, or intentionally denying or impeding another in the exercise or enjoyment of any right, privilege, power, o immunity, knowing the conduct is unlawful. 320.5.4.(d) Relationships: Associating with or joining a criminal gang, organized crime and/or criminal syndicate when the member knows or reasonably should know of the criminal nature of the organization. This includes any organization involved in a definable criminal activity or enterprise, except as specifically directed and authorized by this department. CPRB Meeting Minutes January 10, 2023 Page 2 320.5.9(m) Conduct: Any other on- or off -duty conduct which a member knows or reasonably should know is unbecoming a member of this department, is contrary to good order, efficiency, or morale, or tends to reflect unfavorably upon this department or its members. Vander Vegte asked if there is an ongoing active process in place to identify any officers who may be participating in these groups. Liston noted the department has a social media policy and believes this type of activity would either be reported based on what is seen on social media or by an officer directly making a report. He reminded the board the vast majority of sustained complaints are internally driven. It may also come up during the background check prior to hiring a candidate. Vander Vegte reiterated this situation is increasing among police departments and is pleased there is a policy in place within the Iowa City Police Department. Mekies pointed out while Proud Boys were mentioned, he recommends all violent groups, whether on the far right or far left, be of concern. MacConnell noted the Southern Poverty Law Center newsletter reported the highest prevalence of such activity in southwest Iowa around Des Moines. Discussion re: Police Officers Carrying Business Cards: MacConnell shared her concerns about police officers carrying business cards, noting she feels it may put an officer at risk for targeting. Liston reported while the officers will continue to carry business cards, he would like to implement an incident information card. These cards would include the officers name as well as a case number and a list of agencies and other helpful information. Discussion of the Community Forum: Neumann reminded the board it is time to pick a date for the Community Forum. Group agreed on April 20, 2023 at 5:30 p.m. in Meeting Room A at the Iowa City Public Library. Jensen suggested the Chief be present as there may be items brought up that only he can address. OLD BUSINESS Discussion of Proposed Amendment of Ordinance 8-8-3: MacConnell referred to the recent recommended amendment to the ordinance stating, "a person who observes an incident solely on social media, television, or other media outlets does not have the requisite "personal knowledge" needed to authorize such person to file a complaint." MacConnell recommended this change be extended to the board as well. She further noted that what is viewed on social media or in the news has likely been sensationalized to create a better story. The ordinance currently states, "the City Manager, the Police Chief, the City Council or the board itself may file a complaint based on a reasonable belief that police misconduct has occurred regardless of personal knowledge." Ford explained while a board member can suggest a complaint be filed based on social media, etc., it is up to that board member to convince a majority to approve the recommendation prior to filing a complaint. MacConnell stated that she still strongly feels it should apply to both citizens and board members. Vander Vegte said changing the ordinance would eliminate the possibility of the board filing a complaint in those cases where it believed it to be important to further investigate the incident. STAFF INFORMATION Liston shared while the Police Department has a mission statement, they have not identified the core values for the department. The Chief will be implementing these and requested board members provide input at the February meeting. This item will be added to New Business on the February 14, 2023 CPRB meeting agenda. Washington St., Iowa City, IA 52240 (319) 356-5030 Ordinance No. 23-4894 Ordinance amending Title 8, entitled "Police Regulations," Chapter 8, entitled "Community Police Review Board," to clarify a person who observes an incident on social media does not have the requisite personal knowledge to file a complaint. Whereas, Section 8-8-3B of the City Code allows any person with personal knowledge of police misconduct to file a complaint with the Community Police Review Board; and Whereas, in a Memorandum to the City Council dated November 16, 2022, the Community Police Review Board proposes a code amendment to clarify a person who observes an incident on social media, television or other media outlets does not have the requisite personal knowledge to file a complaint; and Whereas, it is in the City's interest to clarify this provision. Now, therefore, be it ordained by the City Council of the City of Iowa City, Iowa: Section I. Amendment. Title 8, entitled "Police Regulations," Chapter 8, entitled "Community Police Review Board," Section 3, entitled "Definition of Complaint; Complaint Process in General," Subsection B is amended by adding the underscore text as follows: B. Any person with personal knowledge of the alleged police misconduct may file a complaint with the board. In order to have "personal knowledge", the complainant must have been directly involved in the incident or witnessed the incident. A person who observes an "personal knowledge" needed to authorize such person to file a complaint. If the person with personal knowledge is underage or otherwise unable to complete a complaint form, the complaint may be filed by such person's designated representative. The City Manager, the Police Chief, the City Council or the board itself may file a complaint based on a reasonable belief that police misconduct has occurred regardless of personal knowledge. The person or official filing the complaint may hereafter be referred to as the "complainant". Section II. Repealer. All ordinances and parts of ordinances in conflict with the provision of this Ordinance are hereby repealed. Section III. Severability. If any section, provision or part of the Ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section IV. Effective Date. This Ordinance shall be in effect after its final passage, approval and publication, as provided by law. Passed and approved this 24thday of January . 2023. Andrew McKnight RE: July 2022 Use of Force Review DATE: January 12", 2022 The Iowa City Police Department policy requires an employee to complete a written report for any reportable use of force. Reportable use of force is defined in the Department's General Order 99-05, which is titled Use of Force and available for public viewing on the department's website. This policy provides employees with guidelines on the use of deadly and non -deadly force. Upon receipt of the report, the supervisor is responsible for completing an administrative critique of the force. This process includes interviews with involved employees, body wom and in -car camera review, review of any additional available video, and review of written reports. The employee's use of force report and the supervisor's critique is then forwarded to the Captain of Field Operations and the Chief of Police for final review and critique. On a monthly basis, the previous month's use of force reports and supervisor critiques are reviewed by an administrative review committee consisting of a minimum of three swom personnel. This Use of Force Committee consists of two supervisors as designated by the Chief of Police and one officer, typically a certified use of force instructor. The Use of Force Review Committee met on January 12th, 2023. It was composed of Sgt. McKnight, Sgt. J. Fink, and Officer Alma Avila. For the review of submitted reports in July, the Review Committee documented the following: • 48 individual officers were involved in 28 separate incidents requiring use of force. • There were no documented cases of an officer exercising his/her duty to intervene and the review of the incidents did not indicate that an officer failed their duty to intervene. • Out of the 28 uses of force, 22 involved force being used against people. There were six animals euthanized by officers. • Out of the 48 officers involved in the 22 uses of force against people, 3 superficial injuries were sustained by suspects and 2 superficial injuries were sustained by officers. • No violations of policy were noted during this review period. • Out of the 22 uses of force against people, arrests were made 17 times (77%). • Mental health was identified by officers as being a factor in six of the uses of force used against persons (27%). • Drugs and/or alcohol was identified by officers as being a factor in twelve of the 22 uses of force against persons (54%). • Out of the 22 times force was used on persons, there were no black or white females. Nine were identified as white males (41%), twelve were identified as black males 55%). • Out of the 28 uses of force, the average number of officers involved in the force was 1.7. • In total during this time, the ICPD had 6125 calls for service with 22 calls for service resulting in force being used on persons. Upon arrival an officer observed a suspect on the sidewalk matching the description of the male. The officer pointed their rifle at the subject while giving him commands to put his hands in the air and face away from the officer. The subject complied. Another officer exited their vehicle with a police K9, and the subject kneeled to the ground and an officer handcuffed the subject by placing a handcuff on each wrist. While the subject was being detained, the female half of the altercation attempted to leave the house to place herself in the middle of the arrest. Since officers July 2022 had not located the firearm at this point, an officer pushed the female subject down on to the grass, then took hold of her arms and escorted her to a waiting police vehicle until the arrest was made and the scene was safe. There were no injuries to the subject or officers. Day Watch 7/2 2022005081 Aggressive N An officer responded — One Animal to an area where Officer there were several reports of a coyote behaving in an unusual manner. The Coyote barked aggressively towards an officer and attempted to circle the officer showing no signs of fear or flight. The officer determined a safe backdrop and shot one round towards the animal. Late Night 7/2 2022005096 Disorderly Y Officers responded to Watch — Conduct a bar for reports of an Two intoxicated male Officers bothering people in and around the bar, including enticing bar staff to fight. The male subject had been the cause of issues several times previously that same day. Upon seeing that the subject was attempting to fight staff, an officer spoke to the subject and he July 2022 agreed to leave. On the way out, the subject turned towards officers and acted as if he was refusing to leave. The subject attempted to run away so an officer took hold of the subject around his waist and trapped the subject's right arm with their forearm and lowered the subject to the ground. Once on the ground the subject continued to pull away. One officer placed a handcuff onto the subject's left wrists, while another officer took hold of the subject's right arm, pulling it behind the subject's back several times as the subject continuously struggled by pulling his arm to the front of his body. Eventually, an officer was able to pull the subject's arm behind his back, place a handcuff on the right wrist completing the handcuffing process. The officers were uninjured, and the subject reported superficial injuries. The subject was transported to 'ail. Evening 7/3 2022005133 Warrant Y An officer observed a Watch — Service suspect on a bicycle One Officer that was known to have active felon July 2022 arrest warrants. The officer attempted to stop the subject and he rode away. An officer followed the subject then located the subject hiding behind a van. An officer removed their service weapon from their holster, pointed the weapon at the subject and ordered the subject to show their hands and get on the ground. The subject complied and the officer was able to place handcuffs on to each wrist and transport the subject to jail without injury to the subject or officer. Evening 7/4 2022005158 Warrant Y After receiving Watch — Service permission from a One Officer resident, officers looked around the residence and located a wanted subject hiding in the crawl space. An officer pointed their service weapon at the subject and another officer pointed their taser at a subject in order to provide less lethal cover. The subject exited the closet and was taken into custody without issue. The subject was transported to jail with no injury to the subject or officers. July 2022 Day Watch 7/4 2022005151 Mental Health N Officers responded to — One Crisis a residence for Officer reports of a male subject who had taken pills and was armed with a knife. One officer located a male subject holding a knife to his throat, then moving the knife down his body, motioning that he was going to stab himself. One officer drew their taser then fired their taser at the subject to prevent the subject from harming himself. The taser had the desired effect and the subject dropped the knife. An officer moved the knife away then placed the subject into handcuffs without issue. The officer was uninjured and the subject sustained superficial injuries. Evening 7/4 2022005165 Mental Health N Officers responded to Watch — Crisis Capitol Street Ramp Two for reports of a Officers suicidal subject siting on a ledge. An officer was able to wrap their arms around the subject's body underneath his arm pits and pull him to safety. An officer pulled the subject's arms behind their back and placed the subject into handcuffs for the safety of the July 2022 subject. The subject was transported to hospital for a mental health evaluation. There were no injuries to the officer or subject. Day Watch 7/5 2022005177 Assault Y Officers responded to — Two mental health service Officers center for reports of a subject assaulting staff. It was reported that the subject previously had a machete and that staff had taken it away from the subject. An officer located the subject outside the building. The subject had a large butane lighter in his hand and was not following officer commands to stay outside. The subject attempted to go back into the building where an officer stepped towards the subject to prevent him from going into the building. The subject spat on the officer and punched the officer striking them in the face causing them to bleed. The officer took hold of the subject's left arm and pulled him to the ground. While on the ground the subject continued to flail around kicking the officer. An officer laced their hand onto July 2022 the back of the subject's head, holding it in place to prevent the subject from getting into a fighting position on his back. An officer pulled the subject's arms behind his back and placed handcuffs onto the subject. The subject was transported to jail without injury. The officer sustained superficial injuries. When officers arrived, they were told that the subject had left and was walking north on Maddison St. The subject was located inside the Old Capitol Mall where he ran from officers. During the brief chase the subject thew various tables and chairs at officers in order to avoid arrest. Officers took hold of the subject's arms and guided the subject to the ground. Once on July 2022 the ground, officers pulled the subject's arms behind his back and placed handcuffs onto each wrist. The subject was transported to jail without injury to the subject or officers. Evening 7/13 2022005464 Trespass Y Officers responded to Watch — an emergency shelter One Officer for reports of an intoxicated subject refusing to leave. The subject was belligerent and continued to refuse to leave so a decision was made to arrest the subject. An officer took hold of the subject's left arm, pulled it behind his back and placed handcuffs on his wrist. An officer pulled the subject's right arm behind his back and completed the handcuffing process. An officer took hold of the subject's left arm and walked with them towards a waiting vehicle. The subject continued to yell at officers and pull away. One officer placed the subject's left wrist into a lock and placed the subject into a vehicle. The subject ended up face -down and was not in a safe position to transport so an officer took hold of the July 2022 subject's left arm with both hands and pulled him out of the vehicle. The subject was then repositioned into the vehicle as an officer pushed on the subject's back with both hands placing him into the vehicle. An officer took hold of the subject's legs and placed them into the vehicle. The door was closed, and the suspect transported to jail. There were no injuries to the officer and superficial injuries to the subject. Evening 7/15 2022005510 Vehicle Crash N Officers responded to Watch — a motor vehicle Two accident where it was Officers reported that a male subject had been injured. officers assisted paramedics in their attempts to remove the subject from the vehicle. The subject was combative and attempted to bite officers and paramedics. Officers used their hands to take hold of the subject's arms and pull him out of the vehicle, guiding him to a cot. Once on the cot, the subject kicked out towards officers. An officer held the subject's legs while he was placed into soft July 2022 restraints. The subject was then transported to the hospital. An officer rode with the subject in the ambulance and they held the subject's head preventing him from biting paramedics. Once at the hospital paramedics administered a sedative and the subject calmed. There were no injuries to the subject or officer. Late Night 7118 2022005608 Trespass Y Officers were Watch — dispatched to a bar for Three reports of an Officers intoxicated male who refused to leave the premises. Officers located the male in the parking lot and provided multiple opportunities for the subject to identify himself and provide an address where he could be safely dropped off. The subject refused to answer questions and was arrested. Officers stood on both sides of the subject placing their hands on the subject's arms and pulling them behind his back. Another officer placed handcuffs on to the subject and the subject was escorted July 2022 to a nearby vehicle. The subject continued to pull away, tense his body and refuse to enter the vehicle. The subject was held in place facing the vehicle while he was searched. The subject attempted to kick out towards officers and an officer placed their leg between the subject's legs and placed the leg into a leg lock. The subject was then placed into the back of a vehicle while officers pushed down on the subject's upper body and another officer pulled the subject into the vehicle from the opposite side. The subject continued to kick out as the door was closed. The subject was transported to jail without injury to the subject or officers. Evening 7/19 2022005625 Weapons Y Officers responded to Watch — Offense a residence for One Officer reports of shots fired and an armed subject with a gun who had engaged in an armed robbery. Upon arrival, officers surrounded the location and attempted to engage subjects inside a residence. Officers displayed their July 2022 weapons and pointed their weapons at the suspect as he came out of the residence, was searched and was taken into custody. There were no injuries to the subject or officers. Officers pointed their weapons at the occupants as they ordered them out of the vehicle. Both subjects complied and were handcuffed and searched before being transported to the police department. There were no injuries to the subject's or officers. Late Night 7/22 2022005718 Trespass Y An officer responded Watch — to a bar for reports of One Officer an intoxicated male who had refused to leave and was causing issues. This was the second call of the evening for the subject. An officer located the subject outside the bar and told the subject to leave. The subject argued with the officer and attempted to re- enter the bar. The subject was instructed to place his hands behind his back, and July 2022 he refused to do so, instead electing to ball his fists in a manner that suggested he was about to fight. An officer placed their hands on the subject's chest and swept the subject's feet lowering him to the ground. The subject continued to pull his hands away from the officer. An officer was able to place one handcuff on to the subject's right wrist, however, he continued to hold his left hand close to his chest. An officer sprayed the subject in the eyes with a chemical irritant and an officer was able to complete the handcuffing process. The subject walked to the patrol vehicle and refused to enter the vehicle. An officer pushed the subject's upper body in order to assist him into the vehicle. The door was closed, and the subject transported without injury to the subject or officers. Late Night 7/23 2022005730 Trespass Y Officers responded to Watch — an emergency shelter Two for reports of a subject Officers causing problems and generally attempting to fight residents. The subject also refused to leave the premises July 2022 when told to do so. Officers decided to arrest the subject and they each used their hands to take hold of the subject's arms, place them behind his back and another officer placed handcuffs on to each wrist. The subject then resisted being searched by tensing his body and pulling away from officers. An officer pulled the subject to the ground by taking hold of their left hand and left shoulder area and pulling them to the ground. Once on the ground the search was completed, and the subject stood up. An officer then placed their left hand on to the subject's right shoulder and placed them into the vehicle. The subject continued to push back, picking their legs up as if they were about to kick out. An officer sprayed the subject with a chemical irritant, then picked their legs up and placed them into the vehicle. There were no injuries to the subject or officers. Late Night 7/24 2022005763 Theft Y Officers responded to Watch — a gas station for reports of a theft. A July 2022 Four decision was made to Officers arrest the subject and officers pulled the subject's arms behind his back. Acuff was placed onto the subject's left wrist then he pulled away. The subject tensed his arms and continued to pull away from officers. One officer pushed the subject backwards and another officer placed their leg across the subject's legs causing him to fall. The subject placed his hands in front of his body and refused to place them behind his back. One officer sprayed the subject in the eyes with a chemical irritant and officers pulled the subject's arms behind his back and placed the subject into handcuffs. The subject was transported to jail without injury to the subject or officers. Evening 7/26 2022005848 Felony Traffic Y Officers attempted to Watch - Stop perform a Felony One Officer traffic stop on a vehicle and the vehicle began to creep slowly towards officers. Officers drew their side arms and pointed them at the vehicle's driver, telling him to stop his July 2022 vehicle. The driver ignored commands and fled the scene at a high rate of speed. Officers holstered their weapons and located the vehicle later that evening. There were no injuries to the subject or officers. Late Night 7/27 2022005863 Assault Y Officers were Watch — dispatched to a Two convenience store for Officers reports of an assault. Officers were able to identify the subject involved through watching video and talking to witnesses. A decision was made to arrest the subject. An officer placed a handcuff on the subject's left wrist and pulled the subject's arm behind his back. An officer pulled the subject's right arm behind his back and completed the handcuffing process as the subject tensed up and pulled away from the officers. As the subject walked towards a waiting vehicle, he shrugged his shoulders towards an officer and the officer put their hands under the subject's right shoulder and guided him to the patrol vehicle. As the subject was being July 2022 searched, he continued to pull away from officers. An officer pushed the subject against a vehicle and another officer held on to the subject's left bicep as the searching process was completed. The subject began to hit his head off of the vehicle's hood, causing damage to the vehicle. The subject was guided into the vehicle in order to prevent harm to the subject. An officer pulled the subject into the vehicle holding the subject's left arm with their right hand. Another officer pushed the subject's upper body into the vehicle and closed the door. One officer used their hands to pull his left arm behind his back and two officers placed their hands on the subject's right arm and attempted to pull the subject's arm behind his back. The subject continued to tense up and prevent officers from handcuffing the subject. One officer sprayed the subject in the eyes with a chemical irritant and officers were then able to place handcuffs on to each wrist. He was transported to jail without injury to the subject or officers. Late Night 7/30 2022005974 Domestic N While investigating a Watch — Abuse 911 call and possible One Officer domestic, officers encountered a subject in a residence who retreated into the home as officers were seeking to check the welfare of his spouse. An officer pulled the subject from the doorway and used their hands to pull the subject's arms behind his back and place him into handcuffs. A female was located who claimed that 911 was called b July 2022 mistake. The subject was removed from handcuffs without injury to the subject or officers. Late Night 7/36 2022005996 Suspicious N Officers responded to Watch — Activity a 911 call where it One Officer was mentioned that there was a subject displaying a gun. Officers arrived and an officer held their patrol rifle at the low ready as officers attempted to locate an armed subject. After investigation an individual admitted to referencing a male with a gun, however, no gun was present. They stated that the mention of a gun was a "prank" and that they just wanted an individual in the household to go to rehab. A subject was located who had active arrest warrants and was transported to jail without injury to the subject or officers. Late Night 7/31 2022005999 Armed Subject Y Officers were Watch — dispatched to a bar for Four reports of a subject Officers armed with a handgun. Officers located the subject and found a gun on his person which he attempted to conceal from officers. The subject immediately began pull away and fight with officers. July 2022 One officer used their hands to pull the subject's left arm behind his back and another officer used their hand to pull the subject's right arm behind his back. The subject continued to pull away and attempt to run. An officer held on to the subject's arm and pulled him to the ground. Another officer sprayed the subject in the eyes with a chemical irritant. Officers then took hold of the subject's arms again, pulled them behind his back and an officer placed handcuffs on to each wrist. The subject appeared to go unconscious and so handcuffs were removed and the subject placed into the recovery position. It was unclear if the subject was unconscious or pretending. As a precaution the subject was checked out at the ER and released into police custody. The subject was transported to jail. There were no injuries to the subject or officers.
