COMMUNITY POLICE REVIEW BOARD MINUTES — April 11, 2023 CALL TO ORDER: Chair Jerri MacConnell called the meeting to order at 5:30 p.m. MEMBERS PRESENT: Ricky Downing, Melissa Jensen, Jerri MacConnell, Saul Mekies, Amanda Remington (arrived at 5:38 p.m.), Orville Townsend, (left at 6:30 p.m.) Stuart Vander Vegte MEMBERS ABSENT: Remington arrived at 5:38 p.m.; Orville Townsend left at 6:30 p.m. STAFF PRESENT: Staff: Tammy Neumann, Legal Counsel: Patrick Ford OTHERS_ PRESENT: Chief Dustin Liston, Councilor Laura Bergus RECOMMENDATIONS TO COUNCIL Accept CPRB #23-04 report. (Remington Absent) � vv ac�'. - 'Z - -c7-- 'v'-- ti.uw wuui "aura 11%4u0 Councilor Bergus presented to the Board a summary of the Strategic Plan that was adopted by City Council in 2022. The entire plan is available at www.tcgov:orgistrategicolan. Bergus explained the process to the Board. She noted that this Strategic Plan is a five-year plan. Values of the plan include Racial Equity, Social Justice and Human Rights, Climate Action, and Partnerships and Engagement and the four impact areas include Neighborhoods and Housing, Mobility, Economy, and Safety and Well-being. Following the presentation, Bergus asked the Board to speak about how it can contribute to the goals of the Strategic Plan. Townsend expressed his concern regarding affordable housing, stating that affordable housing is not affordable. He further noted that he would like to see an expansion or elimination of the length of time a unit is to remain affordable where after a certain period, the rent could increase substantially. Vander Vegte agreed stating that with a rise in property taxes comes a rise in rental fees. Mekies said he would like to have seen a statement committing to providing a safe community for our citizens and our children. Bergus referred to the section titled Safety & Well Being in the handout. She believes this is covered in the statement that reads "implement and expand innovative public safety models and facilities to improve outcomes and relationships within the community." Mekies stated he feels this only covers the social service aspects of safety. Bergus explained that there was a lot of conversation about what safety is. She said CPRB Meeting Minutes April 11, 2023 Page 2 while emergency response is one piece of the definition, safety also includes things like how a person feels safe in their home, in their school, on their block, in their body, etc., providing a broader definition of safety. Jensen suggested that it may be best to address City Council with these concerns rather than discussing it at the meeting. Bergus asked for feedback from CPRB should they see elements of safety concerns when investigating cases. Remington said she believes everything the Board does includes elements of the value titled "Racial Equity, Social Justice, & Human Rights," by making sure that police policies are fair, that people of the community are being treated fairly, etc. Vander Vegte asked if Mekies was familiar with the Attorney General cutting payments for the morning after pill and abortions for rape victims. Mekies did not feel this was germane to the discussion and asked Chairperson MacConnell to call this statement out of order. MacConnell expressed this is a safety concern and Vander Vegte was not out of order. Bergus ended by asking the Board to keep the Strategic Plan values in mind moving forward. Discussion pf CPRB FY23 and EY24 CPRB 8udaet'— Remington reviewed the budget included in the CPRB meeting packet with the Board. Remington asked Chief Liston if the information cards had yet been printed. He noted that they have not and that there has been discussion about what to be included. He will have a draft of those available soon. Remington pointed out that there is money in the budget to provide accessibility to CPRB meetings through Zoom and live -streaming and would like to see this start as soon as possible. Neumann will follow-up. Remington noted that she did not see CPRB brochures in the Police Department. Neumann will provide brochures to them. OLD BUSINESS ICPD Mission Statement Discussion - At the March CPRB meeting, Jensen asked for a copy of the ICPD Mission Statement (General Order 95-02-Mission Statement and Department Goals and Objectives). Jensen explained she wanted to review this document prior to moving forward with suggesting any core values. Chief Liston said the goal is to align these core values with the Strategic Plan values and would like to get input from the public at the forum. The Board agreed to add the item to the forum agenda. MacConnell asked board members if they had any suggestions to add to the core values. No suggestions were mentioned. Chief Liston will share suggested core values from ICPD staff with the Board. ICPD Letter and Referral List from Cagt. Denise Brotheitorl'- Mekies explained to Chief Liston his reason for asking for the list and shared that his hope is to by offering services to repeat offenders, there would be fewer repeat calls. Chief Liston addressed his concerns by reiterating some of what Capt. Brotherton had mentioned at the March 2023 meeting. He agreed that repeat calls do become, frustrating, however the person must agree to take advantage of the services offered. Mekies asked if the Police Department follows up with these referrals. MacConnell stated these agencies cannot share information about a client due to HIPAA laws. Chief Liston said that there is not always a cause for an arrest and ICPD cannot make a person act on the referrals given to them. The Board discussed asking the public for their input regarding suggested core values for the Police Department. Remington and Jensen will write a summary following the meeting. PUBLIC DISCUSSION None BOARD INFORMATION Vander Vegte announced he may have to resign from the CPRB in July as there is a chance, he may be hired for a new position that is not in Iowa City. Motion carried 6/0 (Townsend absent) Motion by Jensen, seconded by Remington, to change the initial level of review set at the March 14 meeting for CPRB Complaint 22-12 from 8-8-7(B)(1)(d) — Request additional investigation by the Police Chief or City Manager, or request police assistance in the Board's own investigation to 8-8-7(13)(1)(a) — On the record with no additional investigation for complaint 22-11. Motion carried 6/0 (Townsend absent) Motion by Jensen, seconded by Vander Vegte, to summarily dismiss CPRB Complaint 23-04 per City Code Section 8-8-3(E), "Only those complaints to the board which do not involve the conduct of an Iowa City sworn police officer or are not filed within one hundred eighty (180) days of the alleged misconduct may be subject to summary dismissal by the board." The Board concurred with the findings of the Chief of Police that the complaint did not concern the conduct of an Iowa City police officer. City Code, Section 8-8-3 (A) provides: A "complaint to the board" is an allegation of misconduct lodged against a sworn police officer ("police officer" or "officer,`fi emlo sXhr't� s?f' gtjv a Cttypolice dppatr menr, where the complained of activity occurred while the officer was acting in the capacity of a sworn police officer. (Emphasis added.) City Code Section 8-8-3 (E), provides: "...those complaints to the board which do not involve the conduct of an Iowa City sworn police officer or are not timely filed may be subject to summary dismissal by the board." In accordance with these code provisions, Complaint CPRB #21-08 was summarily dismissed. CALL TO ORDER Chair Jerri MacConnell called the meeting to order at 5:34 p.m. MEMBERS PRESENT: Ricky Downing, Melissa Jensen, Jerri MacConnell, Saul Mekies, Amanda Remington, Orville Townsend, Stuart Vander Vegte MEMBERS ABSENT: None STAFF PRESENT: Legal Counsel Patrick Ford and Staff Tammy Neumann OTHERS PRESENT: Police Chief Dustin Liston, City Council Member Laura Bergus WELCOME & INTRODUCTION OF BOARD: Each member introduced themselves and shared how long they have been on the board. Ford, CPRB Legal Counsel, introduced himself as well. All welcomed the public to the meeting. CONSIDER MOTION TO ACCEPT CORRESPONDENCE AND/OR DOCUMENTS MacConnell read the correspondence received into the record. Motion by Mekies, seconded by Jensen to accept correspondence and or /documents. Motion carried, 7/0 COMMUNICATING WITH THE CPRB — WHO WE ARE AND WHAT WE DO Jensen shared an overview of the responsibilities and powers of the Community Police Review. Jensen also explained how to file a CPRB complaint as well as the complaint review process. IOWA CITY POLICE DEPARTMENT CORE VALUES DISCUSSION Iowa City Police Chief Liston explained that he is in the process of rewriting the core values for the police department and invited the public to share their ideas.
