DRAFT COMMUNITY POLICE REVIEW BOARD MINUTES — JULY 11, 2023 CALL TO ORDER: Chair Jerri MacConnell called the meeting to order at 5:30 p.m. MEMBERS PRESENT: Ricky Downing, Melissa Jensen, Jerri MacConnell, Saul Mekies, Amanda Remington, Orville Townsend MEMBERS ABSENT: None STAFF PRESENT: Legal Counsel Alp Zora and Staff Tammy Neumann OTHERS PRESENT: ICPD Chief Dustin Liston RECOMMENDATIONS TO COUNCIL Accept FY23 CPRB Annual Report CONSENT CALENDAR Motion by Townsend, seconded by Jensen, to accept the consent calendar as presented. • Minutes of the meeting on June 13, 2023 Motion carried 6/0. NEW BUSINESS Meeting Participation for City Board. Commission and Committee Members: This item was deferred until the August meeting. Staff noted that City Council is considering a resolution regarding board members attending meetings via Zoom and would have more information at the next meeting. FY23 CPRB Annual Report: The Board reviewed the draft FY23 CPRB Annual Report. Motion by Townsend, seconded by Remington to forward the FY23 annual report to the City Council as written. Motion carried 6/0. OLD BUSINESS Public Forum Discussion: The Board reviewed the draft flyer for the Public Forum scheduled on October 3, 2023. The board was reminded that during the April Public Forum, a member of the public mentioned that the flyer was confusing as it led him to believe that the only items that were allowed to be discussed at the meeting were items that were submitted via email/mail prior to the meeting. Board revised the sentence "Questions or comments to be addressed at the forum are due..." to "Questions or comments can be addressed in person at the Community Forum. If you are unable to attend in person, please submit items you would like addressed during the forum by email to CPRBna iowa- CPRB Meeting Minutes July 11, 2023 Page 2 city.org or mail to (City Hall address) by..." Neumann will submit these changes to the Communications Department and include a second draft in the August meeting packet. ICPD Core Values: Townsend stated at a previous meeting that he would like to talk about ways the community can help to improve relationships with the Police Department. Chief Liston noted that he is not comfortable in making suggestions to the community, however, the Police Department, through community -based policing, will continue to do what they can to foster these relationships. Townsend suggested that perhaps expanding on some of the existing programs like the Police Department's ride - along program, for example, could assist in going further to improve these relationships. ICPD INFORMATION CARDS: The Board reviewed the draft copy of the ICPD Information Cards included in their meeting packet. Chief Liston shared some revisions to the card with the Board and then asked members for their review and approval as amended. Motion by Jensen, seconded by Downing, to approve the ICPD Information Cards as amended. Motion carried 6/0. Remington suggested that the handing out of these cards become a Police Department policy. Liston said that this will be added to the appropriate policy for the department. PUBLIC DISCUSSION None BOARD INFORMATION Jensen requested that the April Community Forum Summary be added to New Business on the August agenda for Board review. MacConnell asked to add an item to the agenda regarding the need for officers to be recognized for the positive actions viewed on the body warn camera footage. Board members agreed that this is something that would be noted during the review of reports during Executive Session and that all board members are welcome to make comments. There were 5 non -criminal investigations involving 9 ICPD employees that were received externally through on-line CPRB complaints. One of the complaints was the same complainant from a previous 2023 CPRB complaint regarding the same issue. The remaining CPRB complaint investigations remain under review. Jeffrey Fink RE: January 2023 Use of Force Review DATE: April 4, 2023 The Iowa City Police Department policy requires an employee to complete a written report for any reportable use of force. Reportable use of force is defined in the Department's General Order 99-05, which is titled Use of Force and available for public viewing on the department's website. This policy provides employees with guidelines on the use of deadly and non -deadly force. Upon receipt of the report, the supervisor is responsible for completing an administrative critique of the force. This process includes interviews with involved employees, body worn and in -car camera review, review of any additional available video, and review of written reports. The employee's use of force report and the supervisor's critique is then forwarded to the Captain of Field Operations and the Chief of Police for final review and critique. On a monthly basis, the previous month's use of force reports and supervisor critiques are reviewed by an administrative review committee consisting of a minimum of three sworn personnel. This Use of Force Committee consists of two supervisors as designated by the Chief of Police and one officer, typically a certified use of force instructor. The Use of Force Review Committee met on April 4, 2023. It was composed of Lt. Fink, Sgt. K. Bailey, and Officer Chad Fulton. For the review of submitted reports in January 2023, the Review Committee documented the following • 28 individual officers were involved in 17 separate incidents requiring use of force. • There were no documented cases of an officer exercising his/her duty to intervene and the review of the incidents did not indicate that an officer failed their duty to intervene. • Out of the 17 use of force incidents, 15 involved force being used against people. There were two animals euthanized by officers. • Out of the 28 officers involved in the 15 uses of force incidents against people, 1 injury requiring medical attention was sustained by a suspect, and 2 superficial injuries were sustained by officers. • No violations of policy were noted during this review period. • Out of the 15 uses of force against people, arrests were made 13 times (87%). • Mental health was identified by officers as being a factor in 5 of the 15 uses of force used against persons (33%). • Drugs and/or alcohol was identified by officers as being a factor in 9 of the 15 uses of force against persons (60%). • Out of the 15 times force was used on persons, 1 was identified as a white female (6.7%), 4 were identified as white males (26.7%), 6 were identified as black males (40%), 1 was identified as a black female (6.7%), and 3 were identified as Latino males (20%). • Out of the 15 uses of force against people, the average number of officers involved in the force was 1.87. • In total during this time, the ICPD had 4,932 calls for service with 15 calls for service resulting in force being used on persons (.30%). The subject fled when he saw officers and the officers pursued him. Officer 1 caught up to the subject and grabbed his coat, ordering him to the ground, but he refused to comply and instead grabbed the officer's left wrist and put his elbow in the officer's chest. Officer 1 performed a leg sweep and pulled him to the ground. The subject was stood up and refused to identify himself He then began twisting his body in different directions, making furtive movements, and grabbing at Officer 2 who was trying to identify him, so Officer 2 grabbed the subject's right arm to control him and issued him verbal commands to stop reaching for his pockets. The subject continued to struggle and tense up, so Officers 1 and 2 safely lowered him to the ground and helped carry him to the grass where he was placed in his stomach and handcuffed. The subject continued to kick at the officers while on the ground, and then tried to roll away and lay flat when officers tried to photograph him for identification purposes. The subject passively resisted as officers escorted him back to the police department. Inside the police department, the subject continued to struggle with officers and disobeyed commands to remain seated. On two occasions Officer 1 grabbed the subject's right arm and right leg to assist him into the chair, but the subject continued to stand, so Officer 2 gave him verbal commands to sit down, but again he refused and continued advancing at officers. Officer 2 grabbed the subject's shoulder and pushed him back toward a seated position, but the subject tried to stand again, so the Officer 2 placed their hand on the subject's lower neck and head area to prevent him from standing up. The subject was walked to patrol car and sat down on the seat but refused to get in completely. Officer 1 pushed on the subject's chest to get him further in the vehicle, but the subject blocked the door with his leg, so Officer 1 used their leg to press against the subject's leg. Officer I's leg got pinned between the subject's leg and the seat, so the officer manipulated a pressure point on the subject's lower mandible, causing the subject to pull his leg into the patrol car. At detention, the subject refused to get out of the vehicle after multiple requests, so the Officer 1 grabbed the subject's left arm and belt loops of his pants and pulled him from the vehicle. The officer had to escort the subject to the holding room because he passively resisted and refused to walk at times. The officer lowered the subject into the prone position in the holding room due to his aggressive and resistive behavior and removed the handcuffs. The officer observed two individuals physically fighting and proceeded to grab one subject around the waist to pull them away from another participant whom they had in a headlock. The officer trapped the subject's left arm and took them to the ground on their left side, allowing the officer to gain control and calm the subject down. The individual was not placed in handcuffs and cooperated for the duration of the incident. The subject displayed a knife and directed it toward their head as they spoke with firefighters. Both officers drew their tasers and focused the red dots on the subject. One officer holstered their taser once communication was established, and through de-escalation efforts the subject eventually threw the knife away and voluntarily went to the hospital. The officer grabbed the subject's right hand and placed it behind their back, and then grabbed the subject's phone they were holding in thew left hand, prompting the subject to turn around and hit the officer in the chest and push them against a wall. The officer grabbed the subject's sweatshirt with both hands and used a leg sweep to lower them to the ground, at which point the officer was able to get the subject's right hand behind their back. The subject continued to resist and not submit their left arm for handcuffing. The subject swung at the officer, which the officer was able to block with their arm, and then the officer pushed the subject's arm out of the way and pushed them to the ground. Concerned the subject might try to flee, Officer 1 opened the driver's door and continued to give verbal commands for the subject to exit the vehicle. Officer 1 then attempted to pull the subject from the vehicle by his wrists, but the subject pulled back into the seat and refused to comply. When Officer 1 reached under the steering column to remove the keys, the front seat passenger grabbed the officer's hand to pull it away from the keys, and the rear seat passenger pulled on the officer's other arm to try and pull them away. Officer 1 continued to issue verbal commands to gain compliance but was unsuccessful. Additional officers arrived and began dealing with the front and rear seat passengers and extracting them from the vehicle. The rear seat passenger was eventually arrested, but the front seat passenger continued to struggle. During this time, the driver grabbed Officer l's hands and tried to pull them off him. Jeffrey Fink RE: February 2023 Use of Force Review DATE: April 4, 2023 The Iowa City Police Department policy requires an employee to complete a written report for any reportable use of force. Reportable use of force is defined in the Department's General Order 99-05, which is titled Use of Force and available for public viewing on the department's website. This policy provides employees with guidelines on the use of deadly and non -deadly force. Upon receipt of the report, the supervisor is responsible for completing an administrative critique of the force. This process includes interviews with involved employees, body worn and in -car camera review, review of any additional available video, and review of written reports. The employee's use of force report and the supervisor's critique is then forwarded to the Captain of Field Operations and the Chief of Police for final review and critique. On a monthly basis, the previous month's use of force reports and supervisor critiques are reviewed by an administrative review committee consisting of a minimum of three sworn personnel. This Use of Force Committee consists of two supervisors as designated by the Chief of Police and one officer, typically a certified use of force instructor. The Use of Force Review Committee met on April 4, 2023. It was composed of Lt. Fink, Sgt. K. Bailey, and Officer Chad Fulton. For the review of submitted reports in February 2023, the Review Committee documented the following: • 18 individual officers were involved in 10 separate incidents requiring use of force against 10 people. • There were no documented cases of an officer exercising his/her duty to intervene and the review of the incidents did not indicate that an officer failed their duty to intervene. • Out of the 10 use of force incidents, 9 involved force being used against people. There was I animal euthanized by officers. • Out of the 18 officers involved in the 9 use of force incidents against people, 0 injuries were sustained by a suspect, and injuries were sustained by officers. • No violations of policy were noted during this review period. • Out of the 9 uses of force against people, arrests were made 8 times (88.9%). • Mental health was identified by officers as being a factor in 2 of the 9 uses of force used against persons (22.2%). • Drugs and/or alcohol was identified by officers as being a factor in 4 of the 9 uses of force against persons (44.4%). • Out of the 10 times force was used on persons, 1 was identified as a white female (10%), 3 were identified as white males (30%), 3 were identified as black males (30%), 1 was identified as a black female (10%), and 2 was identified as a Latino male (20%). • Out of the 10 uses of force against people, the average number of officers involved in the force was 1.80. • In total during this time, the ICPD had 4,425 calls for service with 9 calls for service resulting in force being used on persons (.20%). Officer 1 used their right hand to throw the subject's left hand away creating space. Officer l grabbed the back of the subject's left triceps and left wrist, using the subject's momentum to take him to the ground. Jeffrey Fink RE: March 2023 Use of Force Review DATE: April 17, 2023 The Iowa City Police Department policy requires an employee to complete a written report for any reportable use of force. Reportable use of force is defined in the Department's General Order 99-05, which is titled Use of Force and available for public viewing on the department's website. This policy provides employees with guidelines on the use of deadly and non -deadly force. Upon receipt of the report, the supervisor is responsible for completing an administrative critique of the force. This process includes interviews with involved employees, body wom and in -car camera review, review of any additional available video, and review of written reports. The employee's use of force report and the supervisor's critique is then forwarded to the Captain of Field Operations and the Chief of Police for final review and critique. On a monthly basis, the previous month's use of force reports and supervisor critiques are reviewed by an administrative review committee consisting of a minimum of three swom personnel. This Use of Force Committee consists of two supervisors as designated by the Chief of Police and one officer, typically a certified use of force instructor. The Use of Force Review Committee met on April 4, 2023. It was composed of Lt. Fink, Sgt. K. Bailey, and Officer Jenny Clarahan. For the review of submitted reports in March 2023, the Review Committee documented the following: 48 individual officers were involved in 24 separate incidents requiring use of force. • There were no documented cases of an officer exercising his/her duty to intervene and the review of the incidents did not indicate that an officer failed their duty to intervene. • Out of the 24 use of force incidents, 20 involved force being used against people. There were 4 animals euthanized by officers. • Out of the 48 officers involved in the 20 use of force incidents against people, 0 injuries were sustained by a suspect, and 1 superficial injury was sustained by officers. • No violations of policy were noted during this review period. • Out of the 20 uses of force against people, arrests were made 15 times (75%). • Mental health was identified by officers as being a factor in 7 of the 20 uses of force used against persons (35%). • Drugs and/or alcohol was identified by officers as being a factor in 14 of the 20 uses of force against persons (70%). • Out of the 20 times force was used on persons, 3 were identified as white females (150/6), 10 were identified as white males (50%), 4 were identified as black males (20%), 3 were identified as black females (15%), and 0 were identified as Hispanic or Other races. • Out of the 20 uses of force against people, the average number of officers involved in the force was 2.2. • In total during this time, the ICPD had 4,974 calls for service with 20 calls for service resulting in force being used on persons (.40%). The officer grabbed the subject's left wrist with their left hand and secured his left hand in the cuff. The subject had his right hand in front of him which the officer pulled to his back by grabbing his right wrist with their right hand and then placed it in the right cuff. The officer placed their left hand on the inside of the subject's right elbow and escorted him back to the squad car. The officer had to apply pressure with their right forearm to the subject's upper back to keep him from moving as the officer searched him. As the officer was trying to get the subject into the squad car, he lost his balance and fell to the ground. The officer attempted to get the subject back into a seated position, but he would not comply. The subject started kicking and inching away from the officer while on the ground. The officer knelt down next to the subject and placed their left hand on his left knee to stop him from kicking and placed their right hand on his left shoulder to keep him in place. The officer assisted the subject into a seated position by placing their left hand on the outside of the subject's left bicep and placed their right hand on the subject's left shoulder blade in order to support him as the officer pulled him up. The officer placed their right hand under the subject's left armpit and with assistance of another officer stood him up. At the hospital for making suicidal comments, the subject was sitting in a transport wheelchair with his hands cuffed behind his back and was attempting to stand up and walk away. The officer placed their right hand down on the subject's left shoulder to keep him in a seated position. The subject kept pushing against the officer's hand to stand up. The subject threw a kick which hit the lower portion of the officer's vest. The officer wrapped their left arm over the subject's left leg and then placed their right hand over the subject's left thigh to keep him from kicking. The officer then wrapped their right arm over the top of the subject's left leg due to him continuing to try and kick. The officer applied pressure with the knuckles of their right hand onto the subject's left shin and rubbed them back and forth to gain compliance, and he eventually relaxed his leg. The subject agreed to calm down and was released from the position he was in. The subject was taken back to the officer's squad car in the transport wheelchair. The officer put their left hand under the subject's armpit and with assistance from security stood him up. The subject sat down in the back of the squad car. The officer picked up the subject's right leg with their right hand and assisted placing his leg inside the squad car. The subject resisted, pulling his right arm away and turning and facing towards the officer. Another officer grabbed the subject's right arm and pushed his body against a nearby window, but the subject continued to pull his arms away from officers. The first officer told him if he did not submit his hands, he would be pepper sprayed. The subject continued to refuse to put his hands behind his back. The officer delivered a short burst of pepper spray to the right side of the subject's face. The officer was unable to get anywhere trying to de-escalate the subject as she would not even engage in any sort of dialogue. The officer continued to attempt de-escalation with her until she pulled on the door handle hard enough, breaking the metal door handle into two pieces. The subject then started to swing a substantial piece of metal wildly, mostly toward the door. When she started to swing this metal around, the officer grabbed her right wrist to get control of the door handle, pulling her right arm down with their arms as the subject fell to the ground into a semi -seated position. She then spun away from the officer and grabbed onto a nearby glass railing with her right hand. The officer pulled her hand off the glass by pulling back on her thumb, breaking her grip. The officer then pulled her to a prone position with her right arm and placed their knee beneath her buttocks to try and handcuff her. The subject was able to spin her hips around and lay in a supine position. The officer then had to pull the subject's arm straight above her and roll her into a prone position, again placing their knee below her buttocks. The officer then forced both hands behind her back and was able to get them cuffed. Before the officer was able to double lock the cuffs, the subject was able to pull her left hand out of the cuffs while the officer held onto the cuffs with her right hand still in them. The officer grabbed the subject by her left hand using their right and left hand and placed it over the top of her handcuff, applying pressure in order to gain compliance and get her to start walking forward. The subject said no and refused to get on the ground. The subject turned away from the officer and put his hands behind him but refused to comply with the officer's orders to go to the ground. Officer 1 grabbed ahold of the subject using their right and left hand grabbing the subject's right arm and placed him onto the front of the squad car. Officer 2 grabbed his left hand and applied pressure backwards to have the subject stand up straight as Officer 2's right hand gripped his left bicep. Officer 2 continued to hold him in this position while he forced his way up to a standing position. Officer 2 applied pressure again and the subject bent at the waist with his head over the car The subject had a grip on a suspected meth pipe in a jacket pocket and would not let go. Officer 1 advised the subject if he continued to resist and did not let go of the pipe he was going to get sprayed with pepper spray. The subject again attempted to pull his body weight backward away from officers and was again placed back onto the front of the squad car. To gain compliance, Officer 1 continued to give the subject clear verbal commands to let go of the pipe or he would get sprayed. Officer 1 pulled their pepper spray from its holster and pointed it at the subject again, advising he was going to get sprayed if he did not let go. The subject continued to hold onto his pocket refusing to let go. Officer I sprayed a short burst of pepper spray into the subject's eyes hoping to gain compliance. The subject turned away from officers and continued to grip his jacket pocket. Officer 1 placed their pepper spray back into its holster, grabbed the subject's legs using their right and left hand and pulled them from underneath him. The subject fell backwards and caught himself on his feet. Officer 1 grabbed the subject's legs again in an attempt to get him onto the ground and get his hand away from his pocket. Both officers took the subject to the ground still gripping his pocket. The officer placed their left knee onto the subject's legs to keep him from kicking Officer 2 or getting up and fleeing. Using their right hand, Officer 1 pushed the subject's head down and away from officers and placed their right knuckle into the side of his cheek bone in an attempt to gain compliance. Officer 1 held their knuckle on the subject's cheek. The subject moved his head back and forth to resist the compliance move on his cheek. Using their right hand, Officer I continued to hold the subject's head in place by pushing him towards the ground due to him being sprayed with pepper spray and the worry of officers being spit on while attempting to gain compliance in getting the subject to let go of his pocket. Officers were able to retrieve a clear glass pipe used for smoking methamphetamine with burnt meth residue from the subject's jacket pocket. Officer 3 sprayed the subject with pepper spray to try and incapacitate him without using more force. The pepper spray did not have the desired effect and the subject continued to thrash. The three officers dragged the subject out of the elevator by the arm, and Officers 2 and 3 again tried to move his arms behind his back. Officer 1 entered the victim's apartment with their department issued firearm drawn due to the aforementioned known weapon information involving the subject. The victim confirmed the subject was in the apartment and he was located behind the door of a closet and was given multiple commands to produce his hands from behind the door. The subject refused to comply with these commands multiple times, and Officer 1 continued to point their firearm at the subject and issue commands as Officer I could not confirm he did not have a weapon behind the door. Officer 2 deployed pepper spray and the subject showed his hands and moved from behind the door. Officers 1 and 2 grabbed ahold of his right hand and pulled him from behind the door before placing his arm behind his back. Officers 1, 2, and 4 pushed the subject toward the bed and directed him onto it and held him in place as he was yelling and attempting to kick his legs. Officer l placed the subject into handcuffs while holding onto his upper right arm. Officer 5 used their hands to physically pull his hand cuffed hands out from under his stomach and away from his waist band. While conducting a search incident to arrest, the subject refused to open his hand for officers. Officer 2 placed their left hand on top of the subject's head and their right index finger knuckle on his cheek bone and applied pressure in an attempt to gain compliance. Officer 2 held her left wrist while Officer 1 attempted to get her right hand free. Officer 2 bent her wrist back to try and get her to comply by pain compliance, but it did not appear that she was feeling any pain. Officer 2 instructed her to stop resisting but she did not comply. Officer 1 placed a cuff around the subject's left wrist and double locked the cuff. Officer I tried to pull the subject's right hand from underneath her with their right hand, but she would not release it. Officer 1 continued to pull on the subject's right arm, who had balled herself up in the fetal position and put her right hand down in-between her legs. The subject continued to ignore all commands to give her hand to Officer 1. Officer 1 pulled their pepper spray out and told the subject to submit her hand or she would be sprayed. The subject then relaxed her right arm at which this point Officer 1 put their pepper spray back in its holster and pulled her right arm behind her back. The subject then rolled onto the left side of her body trying to conceal her left hand under her, and then transitioned into the fetal position by pulling her right hand away from Officer 1 and again put her right hand back in between her legs. The subject got up from her seated position at which point Officer 1 wrapped both of their arms around her in a bearhug and tried to use body weight to lay her flat. The subject was sprayed with pepper spray by Officer 2. Officer 1 got up in a standing position behind the subject and placed both of their hands in the middle of her upper back, at which point the subject rolled into the fetal position again. Her left arm came free which Officer 1 grabbed using their left and right hand, trying to drag the subject out of the garage due the limited space available. The subject was now on her back with her right hand on her face. Officer 1 had a hold of the subject's left wrist and elbow to keep her from moving her arm. The subject was now laying on the right side of her body with her arm underneath her again. Officer 2 grabbed the subject's left arm while Officer 2 instructed the subject to submit her right hand. The subject did not listen to the command. Officer I then warned the subject two more times she was going to get sprayed with pepper spray if she did not submit her hand. Officer 1 then sprayed the subject once in the face with pepper spray, causing the subject to release her hand from underneath her which she brought to her lower back. Officer 1 then double locked the handcuff on the subject's right hand. Officer 1 placed their left hand on the outside of the subject's left bicep and helped her roll over on to her side. Officer 1 caught the subject's foot before she could put it back on the ground, then stood up, wrapped her up in a bear hug, and swept her legs out from beneath her to take her to the ground. The officer held the subject on the ground in the recovery position until another unit arrived and took custody of her. The subject was directly in front of the officer. As soon as the subject stepped outside of the door, he attempted to inn. The subject mined southbound down the alley, which is a dead end. The officer grabbed the subject as he was attempting to run, and pushed him up against an outdoor table, telling him he was under arrest. When the officer saw the subject, he was grabbing at electronics on the desk and trying to destroy items in the mom. The officer moved close to get him to stop destroying property and gave him clear instructions to stop. He laid on the sofa a little while longer and then, without provocation, he stood up and charged toward the officer before taking an aggressive stance with his fist raised in the air like he meant to punch the officer. The subject then picked up a chair, presumably to hit the officer with, so the officer swatted the chair out of his hand and stepped toward him, the officer then putting their open hand against the middle of the subject's chest and pushing him down to the sofa, giving him a clear command to sit down. The subject laid on the sofa for a brief while longer before he got up and declared he would be leaving. The officer stepped in front of him as he walked toward the door. He attempted to push through the officer, but the officer used their left hand to push him back to the couch. While doing this the subject hit the officer's arm once. When he sat on the couch, he tried to stand up again multiple times and strike the officer, who was able to block these strikes. The officer pushed him back to the sofa and then he tried to stand back up again 3 times, and when the officer pushed him back to the sofa, he attempted to bite the officer multiple times. The subject then swung at the officer, not landing with any of these assaults. The subject then tried to slam his head into the window, prompting the officer to grab the subject and pin him to the sofa by trying to hold both of his wrists. While doing this, the subject tried to bite the officer multiple times and then grabbed the officer's right wrist with their left hand and dug his fingernails into the officer's wrist, breaking the skin. He did this while trying to bite the officer as well. After he tried to bite the officer, the officer pulled him up to his feet with both of their hands on his right wrist and then grabbed his left shoulder with their left hand and swept his legs with their right leg, causing him to fall to a prone position. While in a prone position, the officer knelt on his buttocks region with their right knee and forced his hands behind his back. The subject laid there cooperatively for some time but still being aggressive verbally, threatening to assault the officer further. Because of his aggression the officer placed him in handcuffs and requested an ambulance for transport to the hospital. Jeffrey Fink RE: April 2023 Use of Force Review DATE: June 1, 2023 The Iowa City Police Department policy requires an employee to complete a written report for any reportable use of force. Reportable use of force is defined in the Department's General Order 99-05, which is titled Use of Force and available for public viewing on the department's website. This policy provides employees with guidelines on the use of deadly and non -deadly force. Upon receipt of the report, the supervisor is responsible for completing an administrative critique of the force. This process includes interviews with involved employees, body worn and in -car camera review, review of any additional available video, and review of written reports. The employee's use of force report and the supervisor's critique is then forwarded to the Captain of Field Operations and the Chief of Police for final review and critique. On a monthly basis, the previous month's use of force reports and supervisor critiques are reviewed by an administrative review committee consisting of a minimum of three sworn personnel. This Use of Force Committee consists of two supervisors as designated by the Chief of Police and one officer, typically a certified use of force instructor. The Use of Force Review Committee met on May 22, 2023. It was composed of Lt. Fink, Sgt. Rob Cash, and Officer Jenny Clarahan. For the review of submitted reports in April 2023, the Review Committee documented the following • 43 individual officers were involved in 27 separate incidents requiring use of force. • There were no documented cases of an officer exercising his/her duty to intervene and the review of the incidents did not indicate that an officer failed their duty to intervene. • Out of the 27 use of force incidents, 21 involved force being used against 26 separate individuals. There were 6 animals euthanized by officers. • Out of the 43 officers involved in the 21 use of force incidents against people, 0 injuries were sustained by a suspect, and 1 superficial injury was sustained by officers. • A violation of the Department's vehicle pursuit policy was noted during this review period. • Out of the 21 uses of force against people, arrests were made 19 times (90.4%). • Mental health was identified by officers as being a factor in 8 of the 21 uses of force used against persons (38.1%). • Drugs and/or alcohol was identified by officers as being a factor in 14 of the 21 uses of force against persons (66.7%). • Out of the 26 times force was used on persons, 1 were identified as white females (3.8%), 6 were identified as white males (23.1%), 10 were identified as black males (38.5%), 3 were identified as black females (11.5%), and 6 (23.1%) were identified as Hispanic or Other races. • Out of the 26 uses of force against people, the average number of officers involved in the force was 1.65. • In total during this time, the ICPD had 5393 calls for service with 21 calls for service resulting in force being used on persons (.39%). He walked to a nearby parking lot where Officer 1 instructed him to stop, and he took off running toward a trail behind an apartment complex. Officer 1 eventually caught up to the subject and instructed him to stop. He continued running. Officer 1 pursued the subject on foot. Officers 2 and 3 approached the subject in a squad car with the lights and siren activated. The subject stopped and sat on a utility box in front of a residence. Officers 2 and 3 instructed the subject to get on the ground, and he did not comply. Officer I approached him from behind and instructed him to get on the ground, and he did not comply. Officer 1 instructed the subject to place his hands behind his back. Officer 1 grabbed his left wrist and Officer 2 grabbed his left arm, but he pulled his arm away and stood up. Officer 1 placed their right hand on his right shoulder grabbed his left forearm. Officer 1 applied downward pressure, using their right foot to trip him, causing both to fall to the ground. The subject was face down on the ground. He tensed up, and he would not place his hands behind his back. Officer 1 placed their right knee on the back of his right thigh to keep him from rolling over. Officer 2 was able to get the subject's left arm behind his back. Officer 1 placed a cuff on the subject's left wrist. Officer 1 assisted Officer 2 with getting the subject's right arm behind his back. Officer 1 was able to get a cuff on his right wrist. Officers escorted the subject to Officer 2's squad car and was instructed to sit in the squad car several times, but he would not comply. He had one foot on the floor of the squad car, and his other foot was on the ground outside of the vehicle. The subject had the side of his head against the top of the door frame. Officers 1 and 2 attempted to push the subject into the squad car. The subject tensed up, and he refused to sit down. Officer 1 went to the driver's side of the squad car and got in the back seat. The subject was found in a delusional state and was having a disconnect with reality believing his mother and brother were not his family. It was determined the subject needed to receive care at the hospital due to his mental state and out of concern he was unable to care for himself. The subject was located in a bedroom of the apartment in a seated position on the floor of the bedroom and refused to voluntarily go to the hospital. The subject was given several opportunities to stand on his own and walk to theparamedic's cot but he refused. The officer took hold of his hand and assisted him to his feet and walked him to the cot. The officer was standing and reached down toward the subject and grabbed hold of his right arm. The subject stood up but slightly tensed his body and would not walk on his own. He was then carried through the bedroom and out to the living room where paramedics had their cot. While being carried, the officer had a hold of the subjects right arm while other officers held his left arm and both legs. The subject did tense his body and attempt to pull his arms and legs free while being carried. He was not able free his anus or legs. He did not assault anyone or seem like he was intending to assault anyone at this time. The subject was instructed to remain still during this time. He was laid on the cot in the living room and secured to it with soft restraints. The subject was kept in soft restraints on the cot and transvorted to the hosoital by ambulance. Officer 1 arrived on scene and encountered the subject in the front yard. The subject was covered in blood and began advancing toward Officer 1 with balled fists. Officer 1 began to move away and attempted de-escalation, but he did not listen to commands to stop walking. Officer 2 arrived on scene and deployed his taster in the subject's back, which caused the subject to get angrier, clench his fists, and flex his muscles, still screaming at officers. Officers 3 and 4 also deployed tasers, but again they were unable to achieve neuro-muscular incapacitation (NMI). Officers continued to issue commands for the subject to comply and calm down, but he continued with his aggressive behavior and advanced toward Officers 1 and 3, prompting Officer 1 to tale the subject, which had the desired effect, causing the subject to fall to the ground where he submitted and was handcuffed. The subject was treated by paramedics on scene and transported to the hospital. Officer I grabbed the subject from his right arm using both hands with the intention of picking him up and transporting him to the squad with the assistance of Officer 2 who held the subject's left arm in the process. Once at the squad car, Officer I lowered the subject's body to the ground using both anus and placed him on the ground, face down with the intention of freeing the officer's hands and unlocking the squad car, while Officer 2 remained by the subject. The officers approached the subject, but he ran from them through the downtown area. Officer 1 attempted to tackle the subject; however, his shoe came off and he continued running. Officer I deployed both laser cartridges toward the subject, all of which were ineffective. All three officers chased the subject through the Ped Mall, by the library and back up an alley, giving the subject verbal commands to get on the ground. The subject ignored these commands. With the knowledge of the subject previously possessing a firearm in his satchel/fanny pack and with him running from officers immediately when they made contact with him, Officer 2 assumed the subject had possession of the firearm. The subject was placed onto the ground next to another individual, then placed onto his stomach and advised to place his hands behind his back. The officer pulled pepper spray from its holster as a crowd was starting form around the officers. The officer pointed the pepper spray at the subject on the ground and again at the crowd in an attempt to gain compliance and get the crowd to disperse. While attempting to take one of the individuals into custody, the subject approached officers from behind and refused commands to back away. Officer 1 pushed the subject away twice and he came back at Officer 1 aggressively each time. Officer 1 took his right wrist and held it behind his body as he attempted to overpower Officer 1 and break free. As Officer 1 held his right wrist in a wristlock, Officer 2 attempted to place him in handcuffs. Jeffrey Fink RE: May 2023 Use of Force Review DATE: June 15, 2023 The Iowa City Police Department policy requires an employee to complete a written report for any reportable use of force. Reportable use of force is defined in the Department's General Order 99-05, which is titled Use of Force and available for public viewing on the department's website. This policy provides employees with guidelines on the use of deadly and non -deadly force. Upon receipt of the report, the supervisor is responsible for completing an administrative critique of the force. This process includes interviews with involved employees, body worn and in -car camera review, review of any additional available video, and review of written reports. The employee's use of force report and the supervisor's critique is then forwarded to the Captain of Field Operations and the Chief of Police for final review and critique. On a monthly basis, the previous month's use of force reports and supervisor critiques are reviewed by an administrative review committee consisting of a minimum of three sworn personnel. This Use of Force Committee consists of two supervisors as designated by the Chief of Police and one officer, typically a certified use of force instructor. The Use of Force Review Committee met on June 15, 2023. It was composed of Lt. Fink, Sgt. Kevin Bailey, and Officer Arcenas. For the review of submitted reports in May 2023, the Review Committee documented the following: • 33 individual officers were involved in 19 separate incidents requiring use of force. • There were no documented cases of an officer exercising his/her duty to intervene and the review of the incidents did not indicate that an officer failed their duty to intervene. • Out of the 19 use of force incidents, 16 involved force being used against 20 separate individuals. There were 3 animals euthanized by officers. • Out of the 33 officers involved in the 20 use of force incidents against people, 1 superficial injury was sustained by a suspect, and 3 superficial injuries were sustained by officers. • No violations of policy were noted during this review period. • Out of the 20 uses of force against people, arrests were made 16 times (80%). • Mental health was identified by officers as being a factor in 4 of the 20 uses of force used against persons (20%). Drugs and/or alcohol was identified by officers as being a factor in 9 of the 20 uses of force against persons (45%). • Out of the 20 times force was used on persons, 2 were identified as white females (10%), 6 were identified as white males (30%), 5 were identified as black males (25%), 5 were identified as black females (25%), and 2 (100/*) were identified as Hispanic or Other races. • Out of the 20 uses of force against people, the average number of officers involved in the force was 1.65. • In total during this time, the ICPD had 5630 calls for service with 20 calls for service resulting in force being used on persons (.36%). The subject started to walk away after the officer arrived on scene. The subject then fell on the ground and began punching himself in the head. The officer decided to place the subject in handcuffs to prevent him from hurting himself When the officer approached the subject, he was lying on his left side. The officer grabbed the subject's right wrist and attempted to place his arm behind his back. The subject attempted to roll away from the officer, and he attempted to pull his arm away. The officer placed their right knee lightly on the back of the subject's left thigh to keep him from rolling away. The officer was able to get the subject's right hand behind his back and handcuffed. The officer grabbed the subject's left wrist and placed it behind his back. The subject pulled his arm away, and he attempted to bite the officer. The officer grabbed his left wrist again and placed it behind his back. The officer placed a cuff on his left wrist. The subject was complaining that he couldn't breathe. The officer sat him up and requested an ambulance. While waiting for the ambulance the subject was yelling, kicking, and attempting to pull away. Prior to the ambulance arriving the subject's mother arrived on scene. The mother refused to let ambulance staff evaluate her son, and he was eventuallv released to her. Officers 1 and 2 decided to put the subject in handcuffs and leg restraints to stop him from kicking the window so he would not hurt himself. Officer 2 opened the back door and the subject jumped out. The officers had to grab ahold of him to stop him. Officer 1 held onto his left wrist and with Officer 2's assistance. Officer 1 placed the subject in handcuffs. The subject tried pulling away, so Officer 1 had to push him up against the back of the squad car. The officer held him against the squad car while Officer 2 put the leg restraints on him. The subject tried to headbutt Officer 1 by throwing his head back but missed. After Officer 2 got the leg restraints on the subject, both officers had to pick him up to put him in the back of the squad car. The subject refused to get into the squad car, so the officers lifted him in. After the officers got the subject in the back of the squad car, he started kicking his feet. Officer 1 was holding onto his legs and in the process of him kicking his feet Officer I's left thumb was jammed up against something. Officer 1 told the subject multiple times to get onto the ground. Officer 2 ran up to assist and grabbed onto the subject's left side/arm. The officers were able to pull the subject's weight to the ground. The subject laid onto his stomach. Officer 1 mounted him from behind, straddling his lower waist and was able to get control of his right hand, placing it behind his back. Officer 2 grabbed his left arm and pulled it behind big back. Officer 1 placed the subject into handcuffs. The subject was wearing a backpack which Officer 1 could feel had heavy/bulky items inside. The subject was extremely intoxicated and refusing medical care, which paramedics informed her was not an option. After several attempts to get her into the ambulance by persuasion, she was placed in handcuffs and escorted onto the ambulance (after assaulting the paramedic by grabbing her breast). The subject calmed down after a while and paramedics stated she could be let out of the cuffs. While being transported to the hospital, paramedics alerted the officer that they needed assistance and requested the officer handcuff her,l which the officer did. While at the hospital, the subject attempted to get up and leave and had to be corralled by hospital staff. She attempted to leave a second time and the officer grabbed her by the back of her clothes to stop her and also got some of her hair in the officer's hand, pulling her head backwards inadvertently. The subject was handcuffed to the rail of her bed. Once released from the hospital, the officer informed the subject she was going to jail and placed her in handcuffs. The officer had to push her arms behind her back by force as she resisted by attempting to lock her arms out to the side and turn toward the officer. The subject then started running from the officer, who continued to order him to stop and identify as the police. The officer also yelled at him that he was under arrest. The subject then started to cut through a yard and fell down at one point. The officer then ordered him to get on the ground or else he would be tased. He got on the ground. The officer ordered him multiple times to put his hands behind his back, but he did not. The officer had to use their hands to pull his left wrist behind his back, continuing to order him to put his hands behind his back and to stop resisting. The officer secured his left wrist in a hand cuff and then pulled his right wrist behind his back. The officer then secured his right wrist in the other cuff. The subject refused to leave after several warnings and continued to yell. Eventually she started down the stairs, and about halfway down, she mined around. Officer I told the subject she needed to keep walking down the stairs. The subject yelled at the officer and told them to shut the fuck up. When they got to the bottom, the officer went to place the subject under arrest. While trying to put the subject in handcuffs, a friend of hers tried to get in the way. The officers were eventually able to get the friend out of the way and get the subjects in handcuffs, after which she sat on the ground. The subject then refused to stand up. The officers had to grab Williams under her arms to stand her back up on her feet. Officer 1 grabbed the subject under her left arm and started to walk her around the comer to get her out of the alley. As they got around the alley, the subject stopped walking and eventually sat down. Officer 1 told the subject several times she needed to walk and stand up but she refused. When a patrol car arrived, the officers picked her up from under her arms again to get her on her feet. The officers got the subject to the squad car and she refused to get in. Officer 1 had to push the subject to get her to sit down and Officer 2 went around to the other side of the squad car to pull her in. While Officer 2 was pulling the subject in, Officer lgrabbed her legs around the knees and lifted them up to get her in the squad car. When the officer placed their left hand on her arm, the subject slapped the officer's hand. The officer then grabbed the subject's left arm and told her she was under arrest. The subject then kept her hands in front of her and would not place them behind her back. The officer pulled on her arm with both hands but did not gain compliance. When she continued to interfere, the officer then tripped the subject and guided her to the round. When the subject was on the ground, in a supine position, the officer forced her hands behind her back and cuffed. The officer pushed the subject away to face the car and maintained a grip on the back of his sweatshirt. Officers had made attempts to place the subject into handcuffs behind his back, but the subject tensed his body up and attempted to walk towards officers who were actively fighting with another involved subject on the ground. The officer grabbed the subject by his left wrist and still had a hold of the back of his sweatshirt. The officer pulled the subject backwards, sweeping his feet from underneath him. The subject landed on his back. The officer gave the subject instructions to put his hands behind his back, but he clutched his arm to his chest refusing commands. The officer removed pepper spray from its holster and pointed it at the subject, delivering a short burst across his eyes in an attempt to gain compliance. The subject turned over to his stomach where he was placed into handcuffs behind his back. The officer then pulled the subject back to his feet. The officer maintained a grip on the subject's left arm and escorted him to a squad car. The subject made an attempt to plant his feet into the ground and stop his momentum from going forward and tensed his body up so officers could not place him into the back of the squad car. The officer used their left hand and placed the subject into the back of the squad car. The subject was transported to the Johnson County Jail where he was seen by medical staff for OC exposure. As Officer 1 still had hands on her left bicep, she ducked and backed away. Officer 1 lost their grip and immediately grabbed the subject's right forearm while simultaneously pushing her against the vehicle. Officer 1 continued their grip on her forearm as she was assisted to the ground with the assistance of Officer 2. The subject then spit at Officer 1. The subject kicked the officer away as the officer answered the radio from JECC. Officer 1 advised they were fighting and grabbed her feet with their hands. Once her right arm was produced from behind her back by Officer 2, Officer 1 placed a handcuff on that wrist. Officer 1 gave verbal commands to roll over. Once she was on her stomach, the subject grabbed the other side of the handcuffs with her left hand. Officer 1 gave verbal commands to let go, and when she did, Officer 1 placed that wrist in the other cuff. Officer 1 assisted the subject to her feet and walked her over to a squad car. Officer 1 had ahold of the subject's right arm as she continued to resist by dragging her feet and squirming to get away. Officer 1 opened my car door and pushed her into the back of the car by her right arm. Yes (Nights) No 0 No ❑ 2 No ❑ symp ils: During the course of an OWI investigation, the subject tried to leave the processing room and enter the hallway after being told multiple times not to leave, and at one point Officer 1 had to block her from leaving. Officer 1 told her to go to the bench and sit, as she was going to be secured to the bench. She refused to do so. Officer 1 ordered her to sit down on the bench multiple times, but she refused. Officer 1 then grabbed onto her right arm and pushed her pack towards the bench, placing another hand on her shoulder and pushing her down onto the bench. She then slapped the Officer 1's hand away and stood back up. Officer 1 told her to turn around and face the wall as she was going back into handcuffs. Officer 1 attempted to grab her left arm and spin her around. The subject was able to squirm out of Officer 1's grip and punch towards their face. She then continued to try and punch Officer 1, who had to use both hands on her wrists to prevent her from punching. Officer 1 then pulled her back out of the comer of the room, in order to get her on the ground for control. Officer 1 pulled her backwards, where they hit the desk. Officer 1 performed a controlled takedown getting her onto the ground, wrapping both arms around her body and trapping her right arm. Once on the ground the subject landed on her back. She then began kicking and trying to punch Officer 1. Officer 1 controlled both of her wrists while doing so by holding them with both hands. She then was able to grab at Officer 1's radio mic, which was secured to their chest, and rip it off. During her kicking and squirming she was able to turn Officer 1's radio off completely. Once on the ground in the hallway, Officer 1 attempted to call for help on the radio, but Officer 1's earpiece had been ripped out and the mic was flying around where Officer 1 could not hear a response. Once in the hallway, Officer 1 was attempting to just keep the subject on the ground so backup could assist with controlling her flailing anus. The subject continued to fight, attempting to get up and away. Officer 1 attempted to mount her from her waist for control on the ground but was unable to do so because of her flailing legs. Officer 1 and the subject slid down the hallway with her on her back. Officer 1 attempted to hit the emergency tones, but nothing was heard. Officer 1 was able to pin her up against a closed doorway, by mounting on top of her, keeping her body pushed against the door. Officer 1 used the stationary object of the door to hold her in a fixed position to wait for assistance. She was able to sit somewhat up right and get in Officer 1's face. Officer 1 used their left arm to control the subject's head back to the ground, by grabbing the back of her head and pushing it back to the floor. Officer 1 used their right arm to hold her arras, attempting to keep her from continuing to punch. While grabbing her head, Officer 1 noticed their hand was close to the back of the subject's neck, and repositioned to her head, by opening the palm of their hand and sliding it more towards her head. Officer 1 told her to turn around and put her hands behind her back. She refused saying to get off her. Officer 1 was eventually able to turn the radio back on and request assistance. Officer 2 arrived and attempted to pull the subject's right arm over to get her on her stomach. When Officer 2 did so, her body weight trapped his foot under her body. Officer 2 fell to the ground, awkwardly twisting a leg. Both the subject and Officer 1 went down on top of Officer 2's leg, which was turned sideways. Officer 2 yelled from pain from his leg. Officer 1 had to let up pressure on the subject's back in order for Officer 2 to get their leg out. Officer 2 was attempting to get her wrist behind her back, and unknowingly was bending her shoulder/arm the wrong way. Officer 1 said to stop, and Officer 2 repositioned her arras and was able to secure it behind her back. Officer 1 was then able to secure her hands into handcuffs. The subject stayed on her side/stomach. Paramedics responded to check on the subject's shoulder, but she refused assistance from pazamedics. The officer gave additional commands for him to stop. The officer then exited through the front door and grabbed the subject's left arm as he was facing away. Once the officer grabbed hold of the subject, he stopped running and did not pull away or resist once the officer grabbed him. Officer 1 began to walk towards the subject advising him to stop. The subject said he was hit by one of the females. Officer 1 again advised the subject to stop walking, and he did. Officer 1 advised the subject to put his hands behind his back, but he said "no" and began running eastbound. Officer 1 pursued the subject on foot advising he was going to get tased in an attempt to gain compliance and get him to stop running. Officer 2 advised the subject to stop reaching into his waistband and drew the laser from its holster in an attempt to gain compliance and get the subject to stop running. The subject turned the comer at some apartments, stopped, and turned towards Officer 2, who still had a taser pointed at him. Due to observing the subject strike another female and non-compliance taking flight from officers, Officer 1 pushed the subject to the ground, not knowing if he was going to become violent with officers or take off running again as Officer 2 was attempting to re -holster the taser. Once on the ground, the subject tucked both of his hands under his stomach and was given several verbal commands to place his hands behind his back. Officer 1 grabbed the subject and attempted to push her into the wall to gain compliance. The subject began to swing her fists at the arrestee, striking Officer 1 in the face. Officer 1 grabbed the subject by her left and right triceps and pulled her to the ground. Officer 1 placed the subject onto the ground and placed a hand on the back of her head to keep her in place and to not be able to stand up and continue fighting with officers. Officer 2 grabbed the subject's hands and placed her into handcuffs. The subject continued to thrash back and forth and attempt to go back towards the arrestee while officers were escorting her to a squad car. Officer 1 grabbed the subject by her right arm and assisted Officer 2 in placing her onto the ground in an attempt to gain compliance. Officer 1 placed a hand onto the subject's head and pulled pepper spray from its holster, advising the subject she was going to get sprayed in an attempt to gain compliance. Officers stood the subject up and she attempted to ran away, but Officer 2 still had a hold of her and nulled her toward the natrol car. The subiect was then placed into the back of a sound car. The subject threatened bodily harm multiple times and tried to provoke a violent response from officers. After officers arrested another individual pursuant to their investigation, the subject tried to get the individual to walk away with him. She did not wish to walk with him. The subject was then given a lawful order to walk away from the individual. The subject then threatened Officer 1 again with bodily harm. At this time, Officer 1 drew a laser and pointed it at the subject. He was told he was under arrest. He then backed away from Officer 1 and started to run. When he was surrounded by other officers, Officer 1 holstered the taser and grabbed his left arm to assist in cuffing. Officer 2 was able to place him into handcuffs. While searching the subject, he attempted to pull away from Officer 2. who pushed him forward into the squad car to keep him from moving. The subject continued to push back and started to tense up. Officer 2 attempted to put the subject inside the squad car, but he would not sit down. The subject was facing Officer 2 when Officer 2 placed a hand on his chest in order to push him inside of the squad car. The subject partially sat back up and continued to yell. Officer 2 grabbed pepper spray from its holster and sprayed a steady stream into the subject's face. After spraying the subject, Officer 2 grabbed the inside of his right elbow and grabbed his right leg and pushed the subject in sideways to the back seat of the squad car. The officer walked up and asked staff to help lower the subject to the ground. Staff said they were not allowed to take the subject to the ground, so the officer grabbed the subject by her right leg and lowered her to the ground so that she was on her back. The officer then took control of the subject's wrists so that she could not grab anything to hurt herself or others and used the mount position to control her body. The subject was on her back facing up and the officer was sitting on top of her with legs on either side of her body. This allowed the officer to use gravity to control her with very little effort. The officer used both hands to pin the subject's arms to the ground above her head, as she was actively trying to hit and grab at the officer. The subject remained in this position until ambulance. fire. and another officer arrived. Paramedics sedated her and transported her. The officer located the subject in a parking lot, and then he got out of the vehicle and walked to the back to greet the officer, who advised the subject of his warrants and advised him to place his hands behind his back. The subject began to argue and was visibly upset advising he did not have a warrant. The officer advised the subject to place his hands behind his back grabbed his right arm. The subject used his right elbow to push the officer's hands away in an attempt to resist, gain distance, and flee on foot. The officer lost grip of the subject's arm after he elbowed the officer's hands away from him and turned to run. The officer began to chase on foot taking their taser from its holster advising the subject he was going to get tased, in an attempt to gain compliance and not knowing if the subject would continue to fight after he was caught. The officer fired the laser once at the subject observing one probe striking him in the back. The subject slowed down and the officer fired the taser a second time to get full neure muscular incapacitation on him so he could not continue to flee or attempt to fight with officers when he was caught. The subject fell to the ground where the officer had given him verbal commands to place his hands behind his back. The subject did so without incident and officers were able to secure him into handcuffs. The subiect was seen by EMS on scene and declined medical services. The officer drew their sidearm and pointed it at the subject. The officer told the driver not to move, and warned him that if he reached for anything, the officer would shoot him. Another officer arrived on scene and it quickly became apparent that the subject was not the person wanted on outstanding warrants and was not going to flee anymore. The Iowa City Community Police Review Board (CPRB) held the annual Community Forum on Thursday, April 20, 2023, at 5:30 p.m. 1. Board Chair Jerri MacConnell called the meeting to order. 2. Board members introduced themselves. 3. Two email correspondence were received pertaining to the Forum. First email asked to explain how "Drug Recognition Officers" are trained, what drugs they are trained to look for and recognize, and under what circumstances they work. Second email asked if ICPD tickets cars with dark tinted windows. Both email correspondences were accepted. 4. Jensen shared how to communicate with the CPRB, who we are and what we do. • Board is comprised of seven members appointed by City Council. • Reviews reports after investigation of complaints about alleged misconduct and then issues its own reports that contain detailed findings of fact & conclusions that explain why and to the extent complaints are sustained or not sustained • CPRB reviews police, policies, procedures, & practice, and may recommend modification to them. • CPRB only has limited civil administrative review powers & has no power or authority over criminal matters or police discipline. • All complaints to the Board must be filed within 180 days. • Any person with personal knowledge of alleged misconduct may file a CPRB complaint with the board. • Process — Complaint is filed, copy goes to the Chief for an internal affairs investigation, a copy also goes to the Equity Director. Chiefs investigation completed within 90 days, with a detailed written report with the findings. Copies of the report go to the CPRB, complainant, officers, & City Manager. • CPRB reviews the report & may conduct an additional investigation, the board then issues a written report with findings. Copies pf the board public reports are sent to the complainant, the police officers, City Manager, Equity Director, & the City Council. 5. ICPD Chief Dustin Liston shared information about the ICPD defining their core values or guiding principles. Officers should be able to look at core values, and be able to think of them when they're making decisions in the field. CPRB has been asked to provide input, and this is an opportunity for the public to provide input as well. Community member asked if there were any proposed core values that could be viewed. Chief Liston gave multiple examples - partnership, engagement, inspire change, etc. to name a few. Community member asked if transparency would be considered, and referenced tension and the importance of things being public. Further discussion about the importance of transparency but also the reality of having to deal with confidentiality on some issues. 6. Public Discussion: o Discussion on the submitted question on window tint. Requirement is to let 70% of the light through, and tickets can be written. o 2n° submitted question was on drug recognition. Several members of ICPD have participated in nationwide training program that is over three weeks in length. There is also annual retraining. The training is provided by the National Highway Traffic Safety Administration. o A community member asked if officers determine whether or not an investigation is made. Chief Liston responded the officers are trained to check if someone is under the influence of alcohol. If someone blows and they're not under the influence, but still show signs of impairment. The officer will typically call for a drug recognition expert. o Community member asked how many complaints are made annually and how much authority does the board have. Discussion from board was while the power is limited, the board makes public recommendations, and public can reach out to council and respond. o In reference to number of complaints for 2022, the board received 18 complaints, 16 were not sustained, and 2 were sustained. Comment from board member, that doesn't mean the board believes everything in the 16 encounters was acceptable; a complaint is only not sustained if there was a policy violation. If there is no policy violation, the board can use the comment section on the public report to make recommendations and isn't shy about doing so. The board also has access to a lot of information including reports, and body camera footage. It's a community effort with the board, the chief & city council member at the meetings as well. o The board commented about objectivity, the board members come from a wide range of backgrounds, and have a wide range of opinions, with multi -faceted, multi different points of view.
