FIVE (5) YEAR PLAN FOR 2010-2015 AND THE ANNUAL PLAN FOR
FISCAL YEAR 2010 AND DIRECTING CITY CLERK TO PUBLISH
NOTICE OF SAID HEARING.
Comment: Set a Public Hearing, which is a requirement before the
approval of the Annual Plan can occur. The City Council of the City of
Iowa City functions as the Iowa City Housing Authority and the
Department of Housing and Urban Development requires adoption of an
updated 5-Year Plan and Annual Plan under the Quality Housing and
Work Responsibility Act of 1998 ("QHWRA"). The 5-Year Plan is
submitted every 5th fiscal year and the Annual Plan is submitted yearly
and are a comprehensive guide to the Iowa City Housing Authority's
policies, programs, operations and strategies for meeting local housing
needs and goals. The Annual Plan also serves as the annual application
for grants to support improvements to public housing buildings (Capital
Fund Program). Copies of the plan are available in the Iowa City
Housing Authority offices for review.

Comment: The Department of Housing and Urban Development requires
the adoption of a Housing Choice Voucher (HCV) Administrative Plan.

Comment: On September 18th 2007 a contract was entered into with
Apex Construction of Iowa City, Iowa to construct the above named
facility in Napoleon Park located at 2275 South Gilbert. The final
contract amount is $255,344.13: all work covered by the contract has
been completed, all required paper work has been submitted and all
invoices have been paid. Staff memorandum included in Council
packet.
CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE
WATERWORKS PRAIRIE PARK FISHING PIER PROJECT.
Comment: On September 23, 2008, a contract was entered into with
Peterson Contractors Inc. of Reinbeck, Iowa to construct the above
named project in Waterworks Prairie Park located on North Dubuque at
the Iowa River. The final contract amount is $168,197. All work covered
by the contract has been completed, all required paperwork has been
submitted and all invoices have been paid. See staff memorandum
included with previous item 4f(1).

Comment: Hills Bank and Trust Company has requested that the City
approve a Subordination Agreement for property at 716 North Dubuque
Street. On December 10, 2003, the owner of the property received a
loan from the City of Iowa City through the City's HOME Investment
Partnership Funds. The property has enough equity to cover the City's
lien position.

ITEM 6. PLANNING AND ZONING MATTERS. (Item "a, b" will proceed as outlined in the
City Attorney's memo of 2/28/07 entitled `Rezonings, Due Process and Ex parte

Comment: At its November 19 meeting, by a vote of 5-1 (Koppes no, Eastham
recused), the Planning and Zoning Commission recommended approval of this
rezoning. Staff recommended approval in a report dated November 5.
Approval will allow the construction of five additional townhouse style units on
Lot 1 of the Olde Towne Village subdivision. A protest petition, which
represents more than 20% of the condominiums located on Lot 1, has been
submitted. Therefore a 3/4 vote (6 of 7 members) of the Council is required to
approve this rezoning.

ITEM 17 (Addition) CONSIDER APPOINTMENT OF REGENIA BAILEY TO THE UNESCO
BOARD OF DIRECTORS.
COMMENT: The UNESCO bylaws state that Iowa City may appoint 3 directors who shall
be the Mayor, the City Manager or the Library Director or their designees. Mayor Hayek
would like to accept the offer of Council Member and former Mayor Bailey to continue to
serve on the Board and recommends favorable action on the appointment.

Comment: At its December 17 meeting, by a vote of 7-0, the Planning and
Zoning Commission recommended approval. Staff recommended approval in a
report dated December 17. Approval will allow the development of Windsor
West, Parts Two and Three, a 58-lot, 25.78-acre subdivision located on
Buckingham Lane, north of American Legion Road and south of Cumberland
Lane.

Comment: At its November 2 meeting, by a vote of 6-1 (Plahutnik voting no),
the Planning and Zoning Commission recommended approval of amendment to
the conditional zoning agreement as proposed in the staff report, provided that
the bus stop remains in the same location as shown on the existing concept site
plan and the public access easement is extended along the drive in front of the
proposed new store. Staff recommended approval of the amended agreement
with these same conditions in a report dated November 2. Approval will allow
Walmart to build a smaller store than originally planned and reserve space on
the property to create two additional commercial building lots. The preliminary
plat has been revised to include the access easement recommended by staff
and the Planning and Zoning Commission. The Conditional Zoning Agreement
has been signed by the applicant.

Comment: This action is being taken to maintain safe vehicle travel speeds on Old
Highway 218 and South Riverside Drive due to increased traffic and collisions in the
corridor since opening the McCollister Boulevard bridge over the Iowa River.

ITEM 8. CONSIDER AN ORDINANCE AMENDING TITLE 7, "FIRE CODE", BY CREA ING

INCIDENTS", TO ALLOW FOR RECOVERY OF COSTS ASSOCIATED WITH
RESPONSE TO HAZARDOUS MATERIALS AND TRANSPORTATION-RELATED
INCIDENTS, AND ALLOW SUCH FEES FOR RECOVERY TO BE SET BY
RESOLUTION. (SECOND CONSIDERATION)
Comment: This ordinance will allow for cost recovery for Fire Department responses to
hazardous materials incidents and transportation-related incidents, both of which can be
costly both in terms of equipment used, labor expended, and damage to equipment. The
ordinance will allow for fees to be set by resolution, just as False Fire Alarms (chapter 3)
and Confined Space Rescues (chapter 4) are now. Following adoption of the ordinance
a resolution will be offered to rescind Resolution No. 08-61 and establish new general
guidelines to assess the fees for Fire Department Services based on the recovery of
actual costs. The circumstances for cost recovery and the guidelines for assessing the
costs to be recovered, i.e. labor costs, materials, and damaged equipment replacement,
repair and/or cleaning, will be based on actual costs at the time of recovery. Equipment
costs will be assessed per the Federal Emergency Management Agency (FEMA)
Schedule of Equipment Costs at the time of recovery.

ITEM 9. CONSIDER A RESOLUTION ESTABLISHING A REVISED SCHEDULE OF FEES
~~_ ~4- AND CHARGES FOR PARKS AND RECREATION SERVICES AND PROGRAMS
Comment: The Parks and Recreation Commission and staff review fees and charges
annually and increases are considered in order to help support the Recreation
Division's budget. Athree-year plan has been established with FY11 fee changes
being recommended for adoption at this time, and FY12 and FY13 increases
tentatively identified. Some of the FY11 changes may actually be implemented in
FY10 because the summer season begins in FY10, but continues into FY11. The
Parks and Recreation Commission reviewed and adopted the proposed changes at its
meeting of December 16, 2009. Detailed information is included in the Council packet.

ITEM 11.
Comment: The Recreation Division had a retirement in the MW I Pools position (3/4
time) in Dec. 2009. After a review of staffing needs and requirements, it was
determined that we no longer needed that position to hold the Certified Pool Operator
(CPO) license since we already had four other positions that held that certification. The
need was for more maintenance requirements and less pool requirements. Staff
recommends making this position from MWI Pools (AFSCME Grade 2) to MWI
(AFSCME Grade 1). The budget impact will result in a cost savings of approximately
$1,190.

Comment: The Iowa Department of Transportation (IDOT) has installed cameras,
sensors, fiber optic cables and other related technology within the City, mainly along I-
80, I-380 and US Hwy 218 and the IDOT has provided access to this technology and
use of conduits to the City. This addendum will provide the City with an additional 12
strands of fiber optic cable. The City will pay the IDOT $20,000 for the additional cable
and work related to its installation. This will be paid for through the ITS fund balance.

Comment: This amendment authorizes Howard R. Green Company to provide
additional engineering services for project design modifications and project plan design

with General Obligation Bond proceeds. Amendment # 2 will bring the total consultant
services fees to $280,921. Estimated construction cost for the North Dodge Street
Pedestrian Bridge over Interstate 80 Project is $3,213,000. The construction of the
project is eligible for federal economic stimulus funding.

ITEM 17 (Addition) CONSIDER APPOINTMENT OF REGENIA BAILEY TO THE UNESCO
BOARD OF DIRECTORS.
COMMENT: The UNESCO bylaws state that Iowa City may appoint 3 directors who shall
be the Mayor, the City Manager or the Library Director or their designees. Mayor Hayek
would like to accept the offer of Council Member and former Mayor Bailey to continue to
serve on the Board and recommends favorable action on the appointment.
