Washington St., Iowa City, IA 52240; 4e 1 319-887-6065 RESOLUTION NO. l0-2 RESOLUTION SETTING A PUBLIC HEARING FOR MARCH 2, 2010 THE IOWA CITY HOUSING AUTHORITY'S FIVE (5) YEAR PLAN FOR 2010- 2015 AND THE ANNUAL PLAN FOR FISCAL YEAR 2010 AND DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING. WHEREAS, the .City Council of the City of Iowa City functions as the Iowa City Housing Authority and the Department of Housing and Urban Development requires adoption of an updated Annual Plan; and, WHEREAS, the Iowa City Housing Authority is required to update the 5-Year Plan and Annual Plan under the Quality Housing and Work Responsibility Act of 1998 ("QHWRA"); and, WHEREAS, the 5-Year Plan is submitted every 5th fiscal year and the Annual Plan is submitted yearly; and, WHEREAS, the 5-Year Plan and Annual Plan are comprehensive guides to the Iowa City Housing Authority's policies, programs, operations and strategies for meeting local housing needs and goals; WHEREAS, The Annual Plan also serves as the annual application for grants to support improvements to public housing buildings (Capital Fund Program); and WHEREAS, the QHWRA requires that the plans be made available to the public for review not later than 45 days before the public hearing is to take place. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: A public hearing for the Iowa City Housing Authority's Five (5) Year Plan for 2010-2015 and Annual Plan for Fiscal Year 2010 should be and is hereby set for 7:00 PM, March 2, 2010, in Emma Harvat Hall of City Hall, 410 E Washington Street, Iowa City, Iowa or if said meeting is cancelled, at the next meeting of the City Council thereafter as posted by the City Clerk. 2. The City Clerk is hereby authorized and directed to publish notice of the public hearing for the above named proposal in a newspaper published at least once weekly and having a general circulation in the City, in accordance with applicable laws. 3. WHEREAS, the City Council of the City of Iowa City functions as the Iowa City Housing Authority and the Department of Housing and Urban Development requires the adoption of a Housing Choice Voucher (HCV) Administrative Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: 1. WHEREAS, the City of Iowa City is the owner and holder of two Agreements and a Mortgage in the total amount of $249,332, executed by the owner of the property on December 10, 2003, and recorded on December 11, 2003, in Book 3677, Page 148 through Page 157, and in Book 3677, Page 158 through Page 169, and in Book 3677, Page 170 through Page 173, in the Johnson County Recorder's Office covering the following described real estate: The north 65 feet of lot 5 and the north 65 feet of the west 20 feet of lot 6, all in block 73, in Iowa City, IA, according to the recorded plat thereof WHEREAS, Hills Bank and Trust Company has refinanced a loan in the amount of $168,746.22 to the owner of the property located at 716 North Dubuque Street and is secured the loan with a mortgage covering the real estate described above; and WHEREAS, it is necessary that the Agreements and Mortgage held by the City be subordinated to the loan of Hills Bank and Trust Company secured by the mortgage; and WHEREAS, Hills Bank and Trust Company has requested that the City execute the attached subordination agreement thereby making the City's lien subordinate to the lien of said mortgage with Hills Bank and Trust Company; and WHEREAS, there is sufficient value in the above-described real estate to secure said lien as a second, which is the City's intended position. NOW, THEREFORE, in consideration of the mutual covenants and promises of the parties hereto, the parties agree as follows: 1. Subordination. The City hereby covenants and agrees with the Financial Institution that the above noted Agreements and Mortgage held by the City is and shall continue to be subject and subordinate to the lien of the mortgage about to be made by the Financial Institution. 2. Consideration. The City acknowledges receipt from the Financial Institution of One Hundred and Fifty Dollars ($150.00) and other good and valuable consideration for its act of subordination herein. 3. The Eastside Loop transit route serves the proposed subdivision with three stops along Arlington Drive approximately 0.2 miles east. 2 BACKGROUND INFORMATION: The applicant, Arlington Development, Inc., is requesting approval fora 58-lot, single-family residential subdivision with one outlot, on approximately 25.78 acres of land located on Buckingham Lane, south of Cumberland Lane, north of Newcastle Drive, and west of Fairway Lane. Previously, a preliminary plat, which included parts One through Three, was approved (2005), however the plat expired in 2007 with only Part One (the southern portion of the development) having an approved final plat. Preliminary Plats expire after two years. This is to assure that changes to zoning and subdivision codes are applied to subdivisions that have not yet begun to develop. The applicant is now seeking to have the remainder of the Windsor West preliminary plat reapproved. Therefore, the subdivision regulations adopted in September 2008 apply to the plat. The applicant has indicated that they have chosen not to use the "Good Neighbor Policy" and have not had discussions with neighborhood representatives. ANALYSIS: Compliance with Comprehensive Plan The property is located within the Southeast Planning District. The 1997 Iowa City Comprehensive Plan identifies this area as suitable for low density residential development. Thus, the proposed subdivision complies with the comprehensive plan. Zoning and Subdivision Design The existing RS-5 zoning allows for residential development with a maximum density of five dwelling units per acre and a minimum lot area of 8,000 square feet. The applicant is proposing a subdivision with lot areas ranging from approximately 11,000 square feet to 28,000 square feet, with a variety of lot sizes within this range. All the lots in the proposed subdivision meet the minimum standards for lot size and lot frontage. The subdivision development is compatible with the zoning and development pattern of the land adjacent to this property. The subdivision regulations adopted in 2008 require 60-foot rights-of-way with 5-foot sidewalks for local residential streets. The wider right-of-way is necessary to provide sufficient room for utilities and street trees. The original preliminary plat reviewed in 2005 included 50-foot rights of way and 4- footsidewalks. Because portions of the roads connecting into the subdivision from the north, east, and south (Cumberland Lane and Buckingham Lane) have already been constructed using the previous 50-foot standard with 4-foot sidewalks, Staff believes it is reasonable to continue development of these streets according to the previous standards. The other streets within the subdivision, Sherwood Drive, Lancaster Avenue, Winnsboro Drive and Norwich Court, conform with the current street standards. Neighborhood parkland or fees in lieu of The Neighborhood Open Space Plan identifies the proposed subdivision as part of the Windsor Ridge Neighborhood Open Space District (SE3). The City's Neighborhood Open Space Ordinance requires the dedication of 1.22 acres of property, or the payment of a fee in lieu thereof, in connection with the land contained within the preliminary plat for all phases of the Windsor West Subdivision. At the time of the previous plat approval for this property the Parks and Recreation Commission chose to accept Outlot C as partial fulfillment for the open space requirement. Oulot C, located between lots 94 and 95, will provide access from Windsor West to Scott Park. In addition to Outlot C, the applicant has agreed to dedicate 3,929 square feet of adjacent land, which he owns, to PCD\Staff Reports\sub09-00010 preliminary.doc 3 connect to Scott Park. Outlot C and the area being dedicated to Scott Park provides 12, 205 square feet (.28 acres) toward the subdivision's open space requirement; therefore, fees equivalent to the value of .94 acres of open space will be required at the time final plat approval. Infrastructure Fees At the time of final plat approval the applicant will be required to pay $395 per acre for water main extension fees, $2,0177.44 per acre for sanitary sewer tap on fees and $1,715.18 per acre toward the improvement of American Legion Road per the Conditional Zoning Agreement that applies to this property. ADVERTISEMENT FOR BIDS MERCER PARK AQUATIC CENTER SOLARIUM REPLACEMENT PROJECT Sealed proposals will be received by the City Clerk of the City of Iowa City, Iowa, before 2:00 P.M. on the 7tn day of January, 2010. Sealed proposals will be opened immediately thereafter by the City Engineer or designee. Bids submitted by fax machine shall not be deemed a "sealed bid" for purposes of this Project. Proposals received after this deadline will be returned to the bidder unopened. Proposals will be acted upon by the City Council at its next regular meeting to be held in the Emma J. The bid security shall be made payable to the TREASURER OF THE CITY OF IOWA CITY, IOWA, and shall be forfeited to the City of Iowa City in the event the successful bidder fails to enter into a contract within ten (10) calendar days and post bond satisfactory to the City ensuring the faithful performance of the contract and maintenance of said Project, if required, pursuant to the provisions of this notice and the other contract documents. Subsequent to execution of the above referenced Agreement and Addendum the DOT intends to install a 2-inch conduit with aDOT-owned 96-strand dark single-mode fiber optic cable, from the Iowa Communications Network's (ICN) S.P. 43 southerly along U.S. 218 to a Fiber Termination Cabinet located at the intersection of U.S. 218 and Melrose Avenue, for the purpose of extending ITS network connectivity, to provide connectivity to DOT cameras, and for the completion of a fiber ring in the Iowa City metropolitan area. See attachment 1 for details on fiber locations. 3. As part of the fiber optic cable installation and subsequent redesign of the DOT's ITS network, the fiber allocated to the CITY in the original agreement has increased. The DOT shall provide to the CITY a total of 12 strands of existing DOT dark single-mode fiber optic cable, from the intersection of Interstate 80 and Iowa 1 westerly to ICN's S.P. 43, for use by the CITY. See attachment 1 for details on fiber allocation. 4. The DOT shall increase the strands of fiber allocated to the CITY in the original agreement along Iowa 965/Coral Ridge Avenue. The DOT shall provide the CITY a total of 12 strands of dark single-mode fiber optic cable from the intersection of Interstate 80 at Iowa 965/Coral Ridge Avenue northerly to the DOT Maintenance Garage at Coralville, Iowa. See attachment 1 for details on fiber allocation. 5. The DOT shall provide the CITY a total of 12 strands of dark single-mode fiber optic cable from the 96 strand fiber optic cable referenced in Item 2. See attachment 1 for details on fiber strand allocation. 6. The DOT shall provide for the splicing of CITY fiber optic cable, to aDOT-provided 12- strand fiber optic cable, to extend the CITY's fiber from the DOT installed 96-strand fiber referenced in Item 2 and Item 3 and Item 4 to CITY hand holes located off of DOT right of way. The DOT shall provide splicing and/or terminations at the following locations: • Interstate 80 at Iowa 1; • Interstate 80 at Dubuque Street; • Interstate 80 at First Avenue; • U.S. 218 at Melrose Avenue. See attachment 2 for additional details. 2 7. The DOT shall provide for the termination of CITY fibers referenced in Item 2 in the FTC located at U.S. 218 at Melrose Avenue referenced in Item 2. See attachment 2 for additional details. 8. The DOT shall provide a fiber termination cabinet (FTC), in DOT right of way, along U.S. 218 adjacent to S.P. 43, including splice trays, and provide for the splicing of the CITY's fiber optic cable for CITY access to CITY fiber within the FTC. The CITY may have recurring access to the FTC referenced in this Item with advance notice to, and approval by, the DOT. See attachment 2 for additional details. 9. The CITY shall reimburse the DOT for cost of the fiber optic cable, conduit, splices and termination cabinet referenced in this agreement. The amount to be reimbursed shall not exceed $20,000. Any costs exceeding $20,000 shall be negotiated by an addendum to this agreement. 10. When accessing CITY fiber optic cable located within DOT right of way, the CITY shall be responsible for providing the appropriate traffic control measures consistent with the current DOT Road Standards for Traffic Control (RS) Series. General Provisions 11. The DOT will bear all costs except those allocated to the CITY under other terms of this Addendum. 12. In the event this project is financed with federal funds, the CITY will take whatever action may be necessary to comply with applicable federal laws and regulations which includes but is not limited to Title 23 CFR (Code of Federal Regulations). 13. Any costs incurred by the CITY in performing its obligations hereunder will be borne exclusively by the CITY without reimbursement by the DOT, except as specifically noted in this Addendum. 14. The CITY will comply with all provisions of the equal employment opportunity requirements prohibiting discrimination and requiring affirmative action to assure equal employment opportunity as required by Iowa Code Chapter 216. No person will, on the grounds of age, race, creed, sex, color, national origin, religion or disability, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for which State funds are used. Miscellaneous Provisions 15. All previously executed agreements (see Section 1 herein) will remain in effect except as amended herein. 16. It is the intent of both (all) parties that no third party beneficiaries be created by this Addendum. 17. If any section, provision, or part of this Addendum shall be found to be invalid or unconstitutional, such finding shall not affect the validity of the Addendum as a whole or any section, provision, or part thereof not found to be invalid or unconstitutional, except to the extent that the original intent of the Addendum cannot be fulfilled. 18. This Addendum maybe executed in two counterparts, each of which so executed will be deemed to be an original. 19. This document; as well as the unaffected provisions of any previous agreement(s), addendum(s), and/or amendment(s); represents the entire Agreement between the CITY and DOT regarding this project. THIS AGREEMENT, made and entered into this ~ Z day of ~ u~1L 2u~o , is an AMENDMENT (AMENDMENT #2) to the CONSULTANT REEMENT dated February 10, 2009 between the City of Iowa City, a municipal corporation, hereinafter referred to as the CITY and Howard R. Green Company, of Cedar Rapids, Iowa, hereinafter referred to as HR Green. WHEREAS, the CITY has secured the services of HR Green to prepare construction documents for a new pedestrian bridge over Interstate 80 (I-80) along North Dodge Street in Iowa City, Iowa according to Iowa Department of Transportation and American Association of State Highway and Transportation Officials guidelines. WHEREAS, this AMENDMENT is intended to supplement the original CONSULTANT AGREEMENT and AMENDMENT #1, and in no way is it intended to otherwise modify said agreement other than as set forth herein. NOW THEREFORE, it is agreed by and between the parties hereto that the CITY does now contract with the Consultant to provide services as set forth herein. SCOPE OF SERVICES Work will be completed as outlined in the original consultant agreement and Amendment #1 and as modified herein. Items not listed in this AMENDMENT will remain unchanged. Task 5 -Final Design 5.3.3 Adjacent Property Access to Sidewalk Develop access alternatives to the hotel and athletic club from the proposed sidewalk to each parking facility. The existing sidewalk terminated at the hotel parking lot. The reconstructed sidewalk will not allow the same connect to remain without alteration. 5.3.4 Plan Modification Issues The Iowa DOT requested significant changes to the trail alignment after final plan submittals on two occasions. These changes include modifications near Pearson Industries and at Northgate Drive. All changes required quick resolution to meet the DOT project schedule requirements. Task 10 -Force Main and Water Main Design 10.2.1 Cathodic Protect Design for Water Main Based on the soil information and existing utility issues, the proposed Ductile Iron Water Main will be cathodically protected. HR Green will use subconsultant CP Solutions to evaluate the site conditions, provide installation details, and special provisions. Installation details and special provisions will be incorporated into the construction documents for the water main. For additional items provided under this task, see attached CP Solutions, Inc.
