RESOLUTION NO. 10-29
RESOLUTION SETTING A PUBLIC HEARING ON FEBRUARY 16, 2010 TO
DISCUSS THE PROPOSED OPERATING BUDGET FOR THE FISCAL YEAR
JULY 1, 2010, THROUGH JUNE 30, 2011, THE PROPOSED THREE-YEAR
FINANCIAL PLAN, AND ALSO THE MULTI-YEAR CAPITAL IMPROVEMENTS
PROGRAM THROUGH FISCAL YEAR 2014.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, that a public
hearing on said proposal should be and is hereby set for February 16, 2010, at 7:00 p.m. in Emma
J. Harvat Hall of the Iowa City City Hall, 410 East Washington Street, Iowa City, Iowa, or if said
meeting is cancelled, at the next meeting of the City Council thereafter as posted by the City Clerk,
and that the City Clerk be and is hereby directed to cause notice of said public hearing to be
published as provided by law, to permit any taxpayer to be heard for or against the proposed
FY2011 Operating Budget and the Proposed FY2011-FY2013 Financial Plan and also the multi-
year Capital Improvements Program through Fiscal Year 2014.

RESOLUTION N0. 10-30
RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK
TO ATTEST TO THE RELEASE OF LIENS REGARDING TWO MORTGAGES
FOR THE PROPERTY LOCATED AT 1416 PLUM STREET, IOWA CITY,
IOWA.
WHEREAS, on March 16, 2005, the owners executed a mortgage with the City of Iowa
City to secure a loan; and
WHEREAS, on January 9, 2006, the owners executed another mortgage with the City;
and
WHEREAS, the loans have been paid off; and
WHEREAS, it is the City of Iowa City's responsibility to release the liens.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
IOWA CITY, IOWA that the Mayor is authorized to sign and the City Clerk to attest the
attached Release of Liens for recordation, whereby the City does release the property
located 1416 Plum Street, Iowa City, Iowa from a Mortgage recorded April 14, 2005,
Book 3863, Page 571 through Page 575, and from another Mortgage recorded January
13, 2006, Book 3982, Page 799 through Page 803 of the Johnson County Recorder's
Office.

RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK
TO ATTEST A RENEWAL OF A LICENSE AGREEMENT FOR TEMPORARY
USE OF PUBLIC RIGHT-OF-WAY BETWEEN THE CITY OF IOWA CITY,
LANDOWNER LUBIN TRUST, AND TENANT MOTIF, LTD D/B/A BO-JAMES,
FOR A SIDEWALK CAFE
WHEREAS, the City of Iowa City is the custodian and trustee of the public right of way within
the City; and
WHEREAS, Lubin Trust, as landlord, and Motif, Ltd, d/b/a Bo-James, as tenant, applied for a
renewal of a temporary use of the public right-of-way agreement at 118 Washington St., Iowa
City, Iowa for a sidewalk cafe and anchored fencing thereon; and
WHEREAS, City staff has reviewed the application, location, and specifications for the proposed
sidewalk cafe and found these to be in compliance with City Code 10-3-3; and
WHEREAS, such use of the public right-of-way is compatible with the public use thereof;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA
THAT:
The Mayor and City Clerk are hereby authorized and directed to respectively sign the
2010 renewal of License Agreement for Temporary Use of Public Right-of-Way, copy of
which is on file with the Public Works Department.
2. The Public Works Department is hereby directed to record this Resolution and license
agreement with the Johnson County Recorder at Applicant's expense.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA
THAT:

RESOLUTION APPROVING PLANS, SPECIFICATIONS, FORM OF CON-
TRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE IOWA
CITY KICKERS SOCCER PARK RENOVATION PROJECT, ESTABLISHING
AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY
CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE
FOR RECEIPT OF BIDS.
WHEREAS, notice of public hearing on the plans, specifications, form of contract and estimate of
cost for the above-named project was published as required by law, and the hearing thereon held.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA THAT:
1. The plans, specifications, form of contract and estimate of cost for the above-named
project are hereby approved.
2. The amount of bid security to accompany each bid for the construction of the above-
named project shall be in the amount of 10% (ten percent) of bid payable to Treasurer,
City of Iowa City, Iowa.
3. The City Clerk is hereby authorized and directed to publish notice, not less than 4 and not
more than 45 days before the date for filing the bids, for the receipt of bids for the
construction of the above-named project in a newspaper published at least once weekly
and having a general circulation in the city.
4. Sealed bids for the above-named project are to be received by the City of Iowa City, Iowa,
at the Office of the City Clerk, at the City Hall, before 2:30 p.m. on the 23`d day of
February, 2010. At that time, the bids will be opened by the City Engineer or his designee,
and thereupon referred to the City Council of the City of Iowa City, Iowa, for action upon
said bids at its next regular meeting, to be held at the Emma J. Harvat Hall, City Hall, Iowa
City, Iowa, at 7:00 p.m. on the 2nd day of March, 2010, or at a special meeting called for
that purpose.

RESOLUTION NO. 10-35
RESOLUTION ESTABLISHING NEW GENERAL GUIDELINES TO ASSESS FIRE
DEPARTMENT FEES AND RESCINDING RESOLUTION N0.08-61.
WHEREAS, on March 4, 2008 Council passed Resolution No. 08-61 to establish one schedule
for all Fire Department fees for services; and
WHEREAS, the Fire Department wishes to establish new guidelines to assess fees based on
recovery of the actual costs at the time the services are provided; and
WHEREAS, the equipment costs will be assessed at the time of recovery per the Federal
Emergency Management (FEMA) Agency Schedule of Equipment of Costs; and
WHEREAS, City Code allows for all Fire Department fees to be set by resolution; and
WHEREAS, the City Council finds that the "Fees for Fire Department Services" attached and
incorporated herein, are based on the actual costs incurred by the Fire Department.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA:
1. Resolution No 08-61 is hereby rescinded.
2. The attached "Fees for Fire Department Services" is adopted.

CITY OF IOWA CITY
FEES FOR FIRE DEPARTMENT SERVICES (Rev. 12/09)
GENERAL GUIDELINES
Fees are based on actual costs and the Federal Emergency Management Agency (hereinafter
"FEMA") Schedule of Equipment Rates.
Cost Recovery will be sought in the following circumstances:
1. False Alarms
2. Hazardous Materials Incidents or Transportation-related Incidents:
a. If we are involved for an hour or more, or
b. If we use more than $50.00 worth of materials, or
c. If our equipment/replacement/repair/cleaning costs add up to more than $50, or
d. If the response requires us to call back off-duty personnel.
3. Specialty/Confined Space Rescue (if there is no prior agreement on file)
4. Reinspections by the Fire Prevention Bureau
5. Training fees
Other Guidelines:
• Labor costs will be based on the average budgeted wages (including all benefits) as
of the beginning of the existing fiscal year for all firefighters, lieutenants, captains,
and battalion chiefs responding. Labor will be billed on the quarter hour, rounding
up. Overtime labor required for a response will be billed at the average budgeted
overtime wages (including all benefits) as of the beginning of the existing fiscal year
for all firefighters, lieutenants, captains, and battalion chiefs responding.
• Equipment costs will be assessed per the FEMA Schedule of Equipment Rates then
in effect.
• Materials will be billed at current replacement cost and shipping.
• Damaged equipment will be billed at current replacement cost and shipping.
• Equipment repair and/or cleaning will be billed at parts and labor.
FALSE ALARM FEES
The following excessive false alarm fee policy is established:
Two (2) false alarms in an Iowa City fiscal year - no charge.
Third and subsequent false alarms in an Iowa City fiscal year -labor, equipment, and material
fees will be assessed, as outlined under General Guidelines above.
HAZ-MAT ORTRANSPORTATION-RELATED INCIDENT RESPONSE FEES
All labor, equipment, and material fees will be assessed per the General Guidelines above.
CONFINED SPACE/SPECIALTY RESCUE FEES
The following confined space/specialty rescue fee policy is established:

Annual Agreement $300.00/year

FIRE PREVENTION BUREAU REINSPECTION FEES
No charge for initial reinspection. Fee applies to second and each subsequent reinspection.
