The roll was called and the vote was, AYES: Bailey, Champion, Dickens, Hayek, Mims, Wilburn, Wright NAYS: Whereupon, the Mayor declared the Resolution duly adopted as follows: Resolution No. 10-37 RESOLD"TION FIXING DATE FOR A MEETING ON THE AUTHORIZATION OF A LOAN AGREEMENT AND THE ISSUANCE OF NOT TO EXCEED $17,750,000 SEWER REVENUE REFUNDING CAPITAL LOAN NOTES, SERIES 2010, OF THE CITY OF IOWA CITY, STATE OF IOWA, AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF WHEREAS, it is deemed necessary and advisable that the City of Iowa City, State of Iowa, should provide for the authorization of a Loan Agreement and the issuance of Sewer Revenue Refunding Capital Loan Notes, Series 2010, in the amount of not to exceed $17,750,000, as authorized by Sections 384.24A, 384.82, and 384.83, Code of Iowa, as amended, for the purpose of providing funds to pay costs as hereinafter described; and WHEREAS, the Loan Agreement and Notes shall be payable solely and only out of the net earnings of the Municipal Sewer Utility and shall be a first lien on the future net earnings of the Utility; and shall not be general obligations of the City or payable in any manner by taxation and the City shall be in no manner liable by reason of the failure of the net revenues to be sufficient for the payment of the Loan Agreement and Notes; and WHEREAS, before a Loan Agreement may be authorized and Sewer Revenue Refunding Capital Loan Notes, Series 2010 issued to evidence the obligation of the City -2- thereunder, it is necessary to comply with the provisions of the City Code of Iowa, as amended, and to publish a notice of the proposal and of the time and place of the meeting at which the Council proposes to take action for the authorization of the Loan Agreement and Notes and to receive oral and/or written objections from any resident or property owner of the City to such action. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THF. CITY OF IOWA CITY, STATE OF IOWA: Section 1. That this Council meet in the Emma J. Harvat Hall, City Hall, 410 E. Washington, Iowa City, Iowa, at 7:00 o'clock P .M., on the 2nd day of March , 2010, for the purpose of taking action on the matter of the authorization of a Loan Agreement and the issuance of not to exceed $17,750,000 Sewer Revenue Refunding Capital Loan Notes, Series 2010, to evidence the obligations of the City thereunder, the proceeds of which will be used to provide funds to pay the costs of the refunding of outstanding sewer revenue indebtedness, including the Series 2001 Sewer Revenue Bonds, dated December 1, 2001, and the Series 2002 Sewer Revenue Refunding Bonds, dated April 1, 2002. Section 2. The Clerk is authorized and directed to proceed on behalf of the City with the negotiation of terms of a Loan Agreement and the issuance of Sewer Revenue Refunding Capital Loan Notes, Series 2010, to a principal amount of not to exceed $17,750,000, to select a date for the final approval thereof, to cause to be prepared such notice and sale information as may appear appropriate, to publish and distribute the same on behalf of the City and this Council and otherwise to take all action necessary to permit the completion of a loan on a basis favorable to the City and acceptable to the Council. Section 3. That the receipt of electronic bids by facsimile machine and through PARITY® competitive bidding is hereby found and determined to provide reasonable security and to maintain the integrity of the competitive bidding process, and to facilitate the delivery of bids by interested parties in connection with the offering of the Notes. Section 4. Washington St., Iowa City, IA 52240 (319) 356-5149 RESOLUTION NO. 10-39 RESOLUTION AUTHORIZING MAILING AND PUBLICATION OF NOTICE OF INTENT TO COMMENCE PUBLIC IMPROVEMENT PROJECT TO CONSTRUCT THE 2010 SIDEWALK INFILL PROJECT AND TO ACQUIRE PROPERTY FOR THE PROJECT; AND SETTING DATE OF PUBLIC HEARING ON MARCH 23, 2010 WHEREAS, under the provisions of Sections 6B.2A and 66.26 of the Iowa Code, a governmental body which proposes to acquire property under power of eminent domain fora public improvement project is required to give notice of intent to commence the project to all property owners whose properties may be acquired in whole or in part for the project; and WHEREAS, the City Council of the City of Iowa City intends to commence a project to construct the 2010 Sidewalk Infill Project, which includes installation of sidewalk along Rochester Avenue and Dubuque Road, which project is to be known as the 2010 Sidewalk Infill Project; and WHEREAS, before the City of Iowa City can proceed with said project, the City Council must: a. Hold a public hearing, providing the opportunity for public input on the question of proceeding with the public improvement and on the acquisition or condemnation of property interests for the project; and b. Adopt a resolution declaring its intent to proceed with said project and authorizing the acquisition of property interests required for the project by negotiation or condemnation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: 1. Documentation showing the proposed location of the 2010 Sidewalk Infill .Project shall be placed on file in the office of the City Clerk and made available for public viewing. 2. A public hearing on the City's intent to proceed with the 2010 Sidewalk Infill Project and to acquire property rights therefore is to be held on the 23~d day of March, 2010, at 7:00 p.m. in the Emma J. Washington St., Iowa City, IA 52240 (319) 356-5251 RESOLUTION NO. 10-42 A RESOLUTION AMENDING THE COMPREHENSIVE PLAN TO ADJUST THE LONG-RANGE PLANNING GROWTH AREA BOUNDARY TO INCLUDE APPROXIMATELY 132 ACRES OF LAND PROPOSED FOR ANNEXATION NEAR THE INTERSECTION OF HIGHWAY 1 AND INTERSTATE 80 WHEREAS, the Iowa City Comprehensive Plan serves as a land-use planning guide by illustrating and describing the location and configuration of appropriate land uses throughout the City, provides notification to the public regarding intended uses of land; and illustrates the long range growth area limit for the City; and WHEREAS, if circumstances change and/or additional information or factors come to light, a change to the Comprehensive Plan may be in the public interest; and WHEREAS, the growth area limit was established in 1997 to coincide generally with the area that can be served by the existing sanitary sewer system, which basically follows watershed boundaries; and WHEREAS, the watershed boundaries are not well defined in the North Corridor; and WHEREAS, it was acknowledged at the time the Comprehensive Plan was adopted that capacity existed within the River Corridor Trunk line to serve an additional 700 acres beyond the designated growth area limit, but it was decided at that time to draw the growth area limit along Rapid Creek until such time as development pressure increased in this area, such that an expansion of the growth area limit was warranted; and WHEREAS, the City received a request to annex property along Rapid Creek to facilitate the construction of an extension of Oakdale Boulevard, a major arterial street anticipated in the City's adopted long-range transportation plan; and WHEREAS, it is in the City's interest to control land along this future arterial street to ensure property develops in a manner that meets urban standards and the goals of the Comprehensive Plan; and WHEREAS, the Planning and Zoning Commission has reviewed this amendment and determined that circumstances have changed to the extent that an amendment to the comprehensive plan is warranted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: 1. It is in the public interest to expand the City's growth area limit in the North Corridor. 2. The City's Growth Area Limit is hereby amended as illustrated on the attached map and shall be incorporated into the Iowa City Comprehensive Plan. MAYOR: Approved by: City Attorney's Office City of Iowa City MEMORANDUM Date: December 30, 2009 To: Planning and Zoning Commission From: Karen Howard, Associate Planner RE: Comprehensive Plan amendment to adjust the growth area limit to include area requested for annexation (ANN09-00001) The City's growth policy articulated in the 1997 Comprehensive Plan indicates that voluntary annexations should be viewed positively if certain conditions exist, one of which is that the area under consideration falls within the City's adopted long-range planning boundary. As was discussed at your December 17 meeting, a significant portion of the land requested for annexation (ANN09-00001) is outside the City's current growth area limit. When the Comprehensive Plan was adopted in 1997, the growth area limit was established to coincide generally with the area that can be served by the existing sanitary sewer system, which basically follows watershed boundaries. However, there are a few areas were watershed boundaries are not clearly defined. One of these areas is in the North Corridor, located north of Interstate 80. While it was acknowledged at the time that capacity existed within the River Corridor Trunk line to serve an additional 700 acres beyond the designated growth area limit, it was decided that drawing the line based solely on sewer capacity in this area was difficult and that other factors should be considered. These factors included consideration of what areas could be served most efficiently with roads and city services and what areas would allow for the most compact development in relation to the rest of the city. In the end it was decided that the line should be drawn to coincide with Rapid Creek, a defining feature of the area, with the acknowledgement that in the future the growth area limit line would have to be re-examined and defined more specifically as development pressure increased. Any significant adjustment to the growth area limit in the North Corridor should involve a broader public discussion and agreements between the City, Coralville, and Johnson County, which could occur when the City conducts a more detailed district planning process for the North Corridor District. In the meantime, as stated in the staff report for the subject annexation, a limited adjustment to the growth area limit may be warranted to allow Oakdale Boulevard to be extended from Highway 1 to the Moss property so that land already with the city's corporate limits can be developed. The JCCOG Arterial Street Plan, an element of the City's Comprehensive Plan, indicates that extending Oakdale Boulevard from Coralville across Dubuque Street and Prairie du Chien Road to Highway 1 will be necessary to provide local access to developable areas within the City's growth area and to fill a gap within the arterial street network that will help to relieve traffic congestion along existing streets. Since construction of this arterial street will involve a significant investment and will undoubtedly increase pressure for development of urban uses along the street corridor, it is in the City's best interest to extend the growth area limit to include the proposed roadway and abutting lands. Although it is a miniscule detail, I have just spent some time trying to research a statement on page 28 of the pdf: COMMUNITY PROFILE History and Development Trends Iowa City was founded by the Legislative Assembly of the Iowa Territory on January 21, 1839. Iowa City was designed to be the new capitol of the territory and was chose for its (at the time) central location. Although one of the oldest remaining buildings in Iowa City is located on the west side of the Iowa River, the majority of the early town developments took place on the east side of the river. My cursory searches for the oldest remaining buildings have identified the Bethel AME Church as the oldest frame building and Old Brick as the second oldest building in Iowa City, both on the east side of the river. I have been unable to imagine where one of the oldest remaining buildings may be on the west side of the river. "One of the oldest remaining buildings in Iowa City ... located on the west side of the Iowa River" is a swell piece of trivia which indicates detailed and thorough considerations in the crafting of the Mitigation Plan. If the unspecified site is accurately described, perhaps it should be parenthetically identified. Congratulations on the creation of a remarkably well organized and lucid document! The city tells us they are going to put backstops on our three drains that drain to the river, arrange for a pumping station either permanent or portable, elevate the intersection of Normandy Dr and Manor and then arrange for some sort of barriers to be used at time of flood danger (to be determined after the deconstruction is finished). I think these things need to be placed on the record of flood mitigation....) think they most definitely need to be included in any record. Property Tax Relief for Residents Along Ralston Creek Mayor Hayek and council members I would like to bring the following statement to your attention. I have prepared copies for you and distribution to the press. I will try to read quickly but doubt that I can meet the constraints of the 5 minute rule. Be it as it may I offer the following and beg your undivided attention. I beg your kind indulgence. Tonight I hope to enlist you assistance on an issue that impacts many properties in Iowa City. I realize that you are nearing completion of and will be endorsing the Hazard Mitigation Plan and that some of the issues addressed are flood control. Sadly the plan does not include a viable solution for the economic hardships endured by the people living in the Ralston Creek watershed. We have not been heard like the tree falling in the forest. No one will carry the sound to the ears of a populous that would be sympathetic to our cause. These unaddressed issues impact more homes and properties than the collective damage of all the 1993 and 2008 flooding which were in a relatively small portion of Iowa City. My home, as are many others in Iowa City is located in the Ralston Creek watershed. This is deemed to be the 100 year floodplain. Making my concerns of these issues known to the appropriate departments of the city has fallen on deaf ears. I get the response that "We have remapped the floodplain." It is my contention that this was not done by a complete study and including an exact engineering update. A study where there was a physical surveying and gathering all the appropriate data. This was done by cursory adjustment to GIS mapping and excluded assessing the impact all of the changes in the development of the properties on the east side of Iowa City. That impact was the result of substantial development having been allowed with a few detention ponds being added. However, the water still runs along the gutters and into drains which then feed into Ralston Creek. This lack of system is symptomatic of the disinterest of previous councilors and staff that did little more than pay lip service to any property outside of the Central Business District. This was a travesty and a failure of our elected officials to act responsibly. The problem was band aid patched by a few additional feet of ineffectual sewer running directly into Ralston Creek when it could have been put into a subterranean system replete with lift stations to carry it to the Iowa River rather than allowing the potential flooding to jeopardize the properties along Ralston Creek and the adjoining neighborhoods. This was tantamount to wanton disregard for ti ie eCunumi% iiiipa%t upon thCise residents that happen to IIVe iii ti ie impacted areas. What in fact has happened is that the city has made it easier for storm water runoff to reach Ralston Creek. Through their actions they ended up making the people living in these lower lying areas the recipients of the rain water from all the other properties sitting high and dry. Consider for example the 3000 blocks of East Washington Street or East Court Street. All high and dry but sending their water down the streets and into Property Tax Relief for Residents Along Ralston Creek the few storm sewers which ultimately empty into Ralston Creek. If the City of Iowa City were to undertake a program to flood proof all of residential areas in the city's east side this would be living up to the mandate to serve the entire community. By building a storm sewer replete with lift stations to take the water over such areas as the higher elevated areas of Summit Street the property owners in the other less desirable areas of the east side would not have to pay over $1,000 per annum for flood insurance. They also would not be in the potentially dangerous situation of having to be in a floodplain. These properties pay substantial property taxes based upon an arbitrary evaluation system that does not even take into consideration the diminished value of a property that has to pay flood insurance. Even though the board of appeals has been approached on this matter they closed their eyes, ears and minds to the appeal. Feedback came in the manner of "Would you sell your house for X number of $?" This was not the point. To wit: The assessed value of a typical lot on East Washington Street where I built three homes is $35,500. These lots are 10,300 square feet with shrubs, trees and not in the floodplain. They are also in excellent proximity to Helen Lemme Grade School and City High School as well as within walking distance of Regina. They are located on a bus route and the construction is high quality. The square foot value of these lots according to the city assessor's evaluation is approximately $3.50 per square foot. Conversely the land values of my home and others located on Rundell St. that are designated in the 100 year floodplain are assessed at a value of $48,000. This is a number which approaches $8.00 per square foot per lot. These are narrow lots of 50 feet in width extending back 125 feet to either an alley or Ralston Creek. This is a prime example of the lack of the government of Iowa City to have any idea of what is going on in the assessor's office. Or to even care in regard to areas in which they do not reside. This is also an example of unfair taxation that favors the more affluent neighborhoods of Iowa City and disregards the plight of people having to pay flood insurance because the city will not install a storm sewer system that does not contribute to the potential flooding of Ralston Creek. The city will obviously object on financial reasons even though they have catered to the areas that were in the flood plain and did suffer damage from the 2008 and the 1993 flooding. This as an example of the city responding to the peopie in iJiic area vJhere ii ie Citji ~ilould accept ti Ie blame for allowing the development to proceed and not accepting the responsibility for the areas where they had no control over the development which occurred in the 1930s or before. It is time for the City of Iowa City to either allow the reduction of property values in this area to reflect the decrease in value due to the fact the property owners have to pay flood insurance in excess of $1000.00 per annum. Or on the other hand the city could opt to undertake a program of construction for a storm sewer system that will protect the entire city. Property Tax Relief for Residents Along Ralston Creek I would like to suggest that the entire area of Iowa City be placed into a formula that would produce a cost for complete flood insurance covering the entire city based upon the potential for flooding. That the cost be prorated to all taxable properties of the city through the property taxation system. Once a value is established for all properties within the tax district adjusted for the type of property the city could approach FEMA with a suggested plan. This problem should be rectified either by actions of the Iowa City Council and the City Assessor's office or through petition and litigation through the courts. I should like to add that in one conversation with a FEMA employee I was informed that a substantial problem with the flood mapping is due to the fact that the College and Muscatine Avenue bridges impede the flow of water in times of substantial rain and pose the potential for that water to back up onto the properties up creek from them. We that have this problem in our neighborhoods will not go quietly down the crick while the City of Iowa City ignores our plight for which the city is contributory. It is time that the City Council of Iowa City and the powers that be wake up and start serving the entire city not just the developers and Down Town Business Association. If you go forward with the Hazard Mitigation Plan without addressing the needs of the entire city you will be remiss in your duties as councilors. Mitigation means along with other definitions to make less harsh, soften or to make less hostile. It would definitely make the potential of flooding in the Ralston Creek watershed less hostile by alleviating the situation. Thank you for your time and attention to this serious matter. It is important to get public comment but when the time comes to get public input, the City of Iowa City should not rely on just placing the notice in the public notice section of newspapers. Although placing such a notice might fulfill the legal obligations, it does not show that the city really wants to hear from the public. (How many people are looking at that particular section of the paper?) We live in the flood zone and from past experience the City of Iowa City has not reached out to proactively get input from those who may directly affected by floods and what should be done to mitigate things. There are neighborhood associations and these should be used to help get the word out. In addition the city should also use the news media (radio/tv) to provide public service am~ouncements of public meetings and to stress the importance of obtaining public input. I am not sure if it is the city administrators or if it is the Iowa City Council that directs activities of what should/should not be done when it comes to public input. We have been residents of Iowa City since 1975 and have lived on the flood plain since 1992. During all the years here, the public perception for some city offices is not very good. If you have questions please contact me Sincerely, Catherine (Cathy) Wilcox 119 Taft Speedway St Iowa City, IA 52242 319-354-5879 2/16/2010 Comments on the draft 2009-10 Iowa City Hazard Mitigation Plan I am a resident of Iowa City and am really glad that Iowa City finally has a draft mitigation plan. I begin my comments by thanking FEMA for: a) allowing Iowa City time till September 2009 to prepare this plan (and thus qualify for post- disaster assistance after the 2008 flood). b) providing almost $12,000 dollars to defray the cost of preparation of this plan - a not insignificant amount for a small community like Iowa City. c) and more generally for the excellent response in short- and long-term recovery efforts in Iowa City following the 2008 flood. I also thank the City of Iowa City for the excellent work that they have done in the wake of the 2008 floods. City staff members in the Planning and Public Works departments have really stepped up to the plate to respond to the challenges posed by the flood -all Iowa Citians should be proud of them. The draft Iowa City Hazard Mitigation Plan (hereafter the Plan) prepared by ECICOG and the Planning Committee is fairly comprehensive in its sweep. This Plan: a) provides an overview of the history, geography and context in which the Plan was prepared b) describes the background, purpose and process of plan preparation c) describes the framework by which hazards and their risk levels are identified d) prioritizes different hazards using a matrix e) and finally the Plan lists certain mitigation strategies Overall, given the small budget that the City allocated for this Plan and the time spent in preparing this Plan, it is a reasonably good document. However, it has several limitations that I think if addressed would make it a meaningful and useful document and have value beyond satisfying a 1'EMA condition for post-disaster assistance. I describe some of these limitations below. Plan Process: On page ii, the Plan notes that the planning committee was composed of seventeen members from the community. This seems to suggest that the planning committee had representation from the public -however, the list of planning committee members shows that all members are employees of local government, the university or the school district. On page iii, the Plan states that " ...the City assembled the above mentioned Planning Committee, made up of members of the general public and persons with professional experience in city affairs ...." 1`his statement is not completely true. As far as one call tell, there were no members of the "general public" on this committee and the general public had no knowledge of this Plan, its content and the process used in preparing it till the draft was unveiled to the public in January 2010. Even if the consultant (ECICOG) or the City did not want to include the "general public" in the committee, at least members of public bodies -- such as Iowa City's Planning & Zoning Commission, the Zoning Board of Adjustments, or Housing & Community Development Commission -that oversee the development process in Iowa City should have been included. Plan Content: 1. The Plan seems to be based on a template, perhaps provided by FEMA or Homeland Security, and has some noticeable errors that point to this observation. One example: On page 22 at the bottom of the page in describing "Age of Housing", the text repeatedly refers to Coralville's housing stock. Another example: On page 25 while discussing "Value of Housing" again the Plan mentions the value of housing in Coralville. At the very least, errors like this make one wonder about the data presented in those sections -are they data for Coralville or Iowa City? 2. On page 1, it is stated that the committee "completed the HARA process" for natural hazards. Table 6 on page 34 -titled "HARA results overview" -seems to suggest that the HARA process was used to prioritize hazards and then choose the high priority hazards for mitigation efforts. If so, this is a good approach and the HARA process seems to be a fairly comprehensive and reasonably well-thought out one. The result of the process ranks threats. However, when the Plan lists the highest priority threats for mitigation (Priority One threats) it identifies some that are not ranked as high by the HARA process and ignores some higher ranked ones. For example, although a tornado ranks lower than seven other hazards (transportation incident, hailstorm, grass or timber fire, extreme heat, rail transportation incident, thunderstorm and lightning, and pipeline incident) per HARA process score, it is identified as Priority One hazard and these seven are not. Why is this so? It seems that ECICOG and the Planning Committee choose to use the HARA process and then not follow through and use its findings? If they do not have faith in the HARA process, then perhaps this process should not have been used or another used in its place. Perhaps I have misread the document and missed something. If a modified version of HARA could be considered, I would recommend adding "ease of recovery" as a criteria in the ranking matrix. This is because some hazards result in damage that cannot be easily replaced -for example, an earthquake can destroy all infrastructure while an energy disruption may not; therefore recovery from an earthquake would take much longer than recovery from an energy disruption. 3. One is disappointed by the mitigation section of the Plan. It is too brief (relative to the rest of the Plan) and consists of too many generalities. For example, on page 165 item 1 lists zoning as a loss mitigation technique but the section describing zoning on pages 170 thru 171 does not describe specifically how this will happen (or even whether the current zoning ordinance will be modified to reflect the intent of this Plan). Moreover the links between the hazards identified and the strategies proposed are not very clear (although the action plan is somewhat helpful in understanding these links). For example: One of the Capital improvements project is "Airport Runway Rehabi'litation''. How is this connected to the hazard threats identified in the first 160 pages -how does this project minimize any of those threats? The Plan also does not seem to have any specific proposals for areas in Iowa City have been hit by multiple natural disasters in recent decades - a spatial emphasis in mitigation strategies will reduce loss risk. Perhaps here again I may have missed something in reading the document - if so please let me know. 4. Data sources: The Plan uses Wikipedia and CityData as data sources. Neither of these is a very well regarded data source for professional policy efforts. The errors in Wikipedia information are well known. CityData is not usually transparent about the methods employed in producing the information that it provides for free on the Internet. On the other hand, data that the City has -such as housing data from the 2008 Affordable Housing Study -- are surprisingly not used in the analysis. All in all, this draft Plan is good first step. I hope you will consider the concerns raised by me and others as you move forward with the next draft. I also hope that the strategy will have abuy- in from neighboring entities such as the University of Iowa -since it is well-known for many disasters such as the 2008 floods, a mitigation strategy that is not regional will have very limited effectiveness. If the City Council approves the assessment against your property, the amount will be collected by the Johnson County Treasurer in the same manner as a property tax. If you pay the amount due in full before the City Council meeting, the resolution will not include an assessment against your property. You can make the payment by mailing or coming in person to the City Clerks office, 410 East Washington Street, between the hours of 8:00 a.m. and 5:00 p.m. If property is assessed and the amount is not paid within the specified 30 days, interest will accrue at a rate set by the City Council. Washington St., Iowa City, IA 52240 (319) 356-5041 RESOLUTION NO. 10-47 RESOLUTION ESTABLISHING A RULE FOR ELECTRONIC PARTICIPATION IN CITY COUNCIL MEETINGS WHEREAS, electronic participation by absent City Council members fully comports with the policy considerations underlying Chapter 21 of the Iowa Code, the Iowa Open Meetings Law, the purpose of which is to assure that the City's decision making occurs in public session to which all members of the public are afforded participatory access to the extent reasonably possible; and WHEREAS, there are many issues where because of the statutory voting requirements, or the importance of the subject matter to the public, it is necessary or desirable to arrange for participation of as many of the council members as possible even through a majority but not all members can be physically present at the meeting; and WHEREAS, under no circumstances will a quorum of the City Council be participating electronically in such meetings. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Iowa City, Iowa: That it shall be the local rule of this City Council to secure electronic participation by absent members whenever it is physically feasible where such participation is necessary or desirable because of statutory voting requirements or the importance of the subject matter to the public.
