ro -'~~ ~° Comment: The preliminary plat was approved by the City Council on January
25, 2010. Staff recommends approval of the final plat subject to approval of
legal papers and construction drawings. It is anticipated that legal papers and
construction drawings will be approved prior to the April 6 City Council
meeting. Approval will allow the development of Wal-Mart Subdivision a 3-lot,
25.16-acre commercial subdivision located 1001 Highway 1 West.

OF COST FOR THE CONSTRUCTION OF THE 2010 MUSCATINE AVENUE WATER
MAIN REPLACEMENT PROJECT, ESTABLISHING AMOUNT OF BID SECURITY
TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO

Comment: This project will include installing DIP water main along the south side of
Muscatine Avenue from 15t Avenue to Arthur Street. The project also includes
installation of new water services, removal and replacement of pavement, driveway,
and sidewalk, and other associated improvements. The estimated construction cost is
$525,000 and will be funded with Water revenues.

Comment: This project involves the reconstruction of Sycamore Street from
Langenberg Avenue to Burns Avenue and pavement repair from Burns Avenue to US
Hwy. 6. The project includes new pavement, storm sewer, and sidewalk along
Sycamore Street. The estimated construction cost is $2,233,000 and will be funded
with $126,795 from Subdivision Development fees and the remaining costs from
General Obligation bond proceeds.

ITEM 7. CONSIDER AN ORDINANCE AMENDING TITLE 1, ENTITLED "ADMINISTRATION,"
CHAPTER 4, ENTITLED "GENERAL PENALTY," SECTION 2D TO PROVIDE THAT
THE CIVIL PENALTY FOR OVER-OCCUPANCY OF A RENTAL UNIT BE $750.00
FOR FIRST VIOLATION AND $1,000.00 FOR SECOND AND SUBSEQUENT
VIOLATIONS UNDER BOTH THE ZONING CODE AND THE HOUSING CODE.
(FIRST CONSIDERATION)
Comment: Both the Zoning Code and the Housing Code limit occupancy. In 2009, the
fine for over-occupancy under the Zoning Code was increased to $750.00 for the first
violation and $1,000.00 for the second and subsequent violations. The 2009 ordinance
did not include an increase in the fine for over-occupancy under the Housing Code.
This ordinance provides that the fines for over-occupancy are the same regardless if
the person is cited under the Zoning Code or the Housing Code.

AGREEMENT FOR THE BRIDGE DECK OVERLAY ON IOWA 1 OVER THE IOWA
RIVER PROJECT [FSSN-1-5(87)--3T-52.
Comment: This is an Iowa Department of Transportation project and involves a
bridge deck overlay on westbound Highway 1 (Burlington Street) over the Iowa River.
The Agreement provides that the City will contribute funds for the installation of upgraded
handrails which will match the recently installed handrails on the Burlington Street
pedestrian bridge. The City's obligation is not to exceed $59,200 and will be funded with
Road Use tax proceeds and/or General Obligation bond proceeds.

COMMUNICATION SERVICES ASSOCIATION OF JOHNSON COUNTY (JECSA)
Comment: The Joint Emergency Communications Center (JECC) is preparing to go "live"
as of July 1, 2010. To facilitate the timely transition from separate County and City
emergency communications centers to a unified center, JECSA desires to begin training
existing County and City dispatchers on JECC equipment on a voluntary basis with
JECSA reimbursing the City and County for any overtime costs associated with that
training (as they will not be employees of JECSA, only the individual locality). This
agreement outlines the terms and conditions of training existing City and County
employees as well as reimbursement for overtime costs.

Comment: With certain exceptions, Iowa City Code currently prohibits persons under
the age of 19 from being present after 10:00 p.m. in a licensed establishment whose
primary purpose is the sale of alcohol. At council's direction, the proposed ordinance
changes the bar entry age to the legal drinking age, which is currently twenty-one (21)
