CONSIDER A MOTION SETTING A PUBLIC HEARING FOR MAY 10, 2010 REGARDING IOWA CITY'S CITIZEN PARTICIPATION PLAN. Comment: A public hearing regarding the Citizen Participation Plan is being set for May 10, 2010. The Citizen Participation Plan sets forth the steps Iowa City uses to encourage citizen participation in the development of the Consolidated Plan (a.k.a. CITY STEPS), Annual Action Plan, any substantial amendments and the Performance Report. A 30-day public comment period started on April 9, 2010. 3. CONSIDER A MOTION SETTING A PUBLIC HEARING FOR MAY 10, 2010 REGARDING IOWA CITY'S FY11 ANNUAL ACTION PLAN, THAT IS A SUB-PART OF IOWA CITY'S 2011-2015 CONSOLIDATED PLAN (a.k.a. CITY STEPS) AND AMENDMENTS TO THE FY08, FY09 & FY10 ANNUAL ACTION PLANS. Comment: A public hearing regarding the FY11 Annual Action Plan, which contains the proposed Community Development Block Grant (CDBG) and HOME Investment Partnerships Program funded projects, and amendments to the FY08, FY09 and FY10 Annual Action Plans is being set for May 10, 2010. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON MAY 10, 2010 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE LANDFILL FY09 STAGE 1 CELL CONSTRUCTION PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project consists of constructing a new landfill cell at the landfill site to meet current state and federal landfill rules. The estimated construction cost is $5,700,000 and will be funded with Landfill revenues. ~a- ~a5 5. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON MAY 10, 2010 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE SANDUSKY STORM SEWER IMPROVEMENTS PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project involves storm sewer improvements to help eliminate neighborhood flooding to the Sandusky Drive and Briar Drive area. The project will include new pavement, storm sewer, and grading along Sandusky Drive and Taylor Drive, as well as storm sewer and grading north of Sandusky Drive. The estimated cost of the project is $542,557 and is to be funded by the stormwater utility fund. April 27, 2010 City of Iowa City Page 4 6. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON MAY lb -lab 10, 2010 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE SENIOR CENTER BUILDING ENVELOPE ROOF REPAIRS AND MEMBRANE REPLACEMENT PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: The project will involve removing the existing roof membrane and replacing with a new roof membrane on the Senior Center. The work will also require masonry repairs and cleaning coping caps, balustrades, and brick masonry on parapet walls. The project will require the provision and installation of new roof deck insulation and 60 mil adhered PVC membrane. The contractor will be responsible for providing support for associated plumbing and electrical work. The estimated construction cost is $152,767 and will be funded with GO Bonds. _ [ O - /a 7 7. CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR MAY 10, 2010, ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 1516 SHERIDAN AVENUE. Comment: In 2000, the City allocated FY01 CDBG funds to anon-profit to acquire a child care facility at 1516 Sheridan Avenue which would offer affordable child care services to income-eligible households. In 2005, the child care business failed and the non-profit deeded the property to the City in lieu of foreclosure. After leasing the property for three years, the City listed the property for sale. The City now proposes to sell 1516 Sheridan Avenue to an income eligible buyer. The amount of the sale will be $130,000, less a $4,000 roof repair allowance. This sale will provide the opportunity for an income eligible family to obtain ownership of their own home. Comment: The North Airport Development Subdivision -Part Two includes commercial lots, which have been marketed for sale to the general public. The City has negotiated a purchase agreement with Van Meter Industrial, Inc. which requires City Council approval. This resolution sets a public hearing on the purchase agreement for May 10. The purchase agreement is attached to the resolution. Comment: Bids for this project were opened on Thursday, April 22, 2010 and the following bids were received: Aqua Logic Inc. Waconia, MN Calacci Construction Iowa City, IA Tricon General Construction Dubuque, IA Engineer's Estimate Base Bid Alt. #1 $169,000.00 $38,250.00 $220,400.00 $39,100.00 $228,800.00 $39,100.00 $250,000.00 Public Works and Engineering recommend award of the contract to Aqua Logic Inc. of Waconia, MN for the Base Bid and Alternate #1 in the amount of $207,250. Comment: Hills Bank and Trust Company, Hills, Iowa has requested that the City approve a Subordination Agreement for 1973 Sherman Drive in order for them to be the owner's primary lender and with the City in second position. The owner of the property received assistance for the Single Family New Construction Program through the City of Iowa City in conjunction with the Iowa Department of Economic Development. Comment: The owner of the property located at 1911 H Street received assistance through the City of Iowa City's Housing Rehabilitation Program. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO AMENDMENT TO TWO AGREEMENTS BETWEEN CITY OF IOWA CITY AND STANLEY CONSULTANTS, INC. Comment: The City has entered into two contracts with Stanley Consultants, Inc. to provide flood protection plans and recommendations for the Parkview Terrace and Idyllwild neighborhoods. The City is using federal Hazard Mitigation Grant (HMGP) funds to pay for the services, and FEMA requires that contracts include the HMGP procurement requirements. This amendment adds the procurement requirements to both agreements. All other provisions of the agreements remain the same. i o -- t ~rj 7. Comment: This utility easement is being dedicated to the City by E&L Prybil Limited Partnership to allow the provision of utilities to the City's land leased to JECSA for its communications tower located north of 420th Street. AUTHORIZING THE FILING OF AN APPLICATION WITH THE IOWA DEPARTMENT OF TRANSPORTATION FOR FY2011 IOWA DOT STATE TRANSIT ASSISTANCE AND FEDERAL TRANSIT ADMINISTRATION FUNDING Comment: JCCOG will be filing an application on behalf of Iowa City Transit with Iowa DOT for State Transit Assistance (STA) and Federal Transit Administration (FTA) funding for FY11. Iowa City Transit will be receiving approximately $405,489 in Iowa DOT SWTA formula funds and is applying for $19,598,268 in FTA capital funding and approximately $1,319,742 of FTA operating funds. The attached memorandum lists the capital projects that will be applied for in FY11 by Iowa City Transit. a) PUBLIC HEARING Action: /O- 13b b) CONSIDER A RESOLUTION Action: ITEM 9. DETERMINING AN AREA OF THE CITY TO BE AN ECONOMIC DEVELOPMENT AREA, AND THAT THE REHABILITATION, CONSERVATION, REDEVELOPMENT, DEVELOPMENT, OR A COMBINATION THEREOF, OF SUCH AREA IS NECESSARY IN THE INTEREST OF THE PUBLIC HEALTH, SAFETY OR WELFARE OF THE RESIDENTS OF THE CITY; DESIGNATING SUCH AREA AS APPROPRIATE FOR AN URBAN RENEWAL PROJECT; AND ADOPTING THE MOSS GREEN URBAN VILLAGE URBAN RENEWAL PLAN THEREFOR. Comment: The proposed Moss Green Urban Village Urban Renewal Plan has been prepared for 242 acres north of I-80 and east of Highway One. (FIRST CONSIDERATION) Comment: Smoking is currently prohibited in City Plaza, a/k/a the ped mall, generally from the fountain to Linn Street. The Downtown Association recommends that the City prohibit smoking throughout the ped mall except for the alleys. This ordinance also makes some minor amendments to the no-smoking provisions in light of recent changes in the hours of operation of the Farmers Market and its expansion onto Washington Street. (FIRST CONSIDERATION) Comment: This action is being taken to maintain safe vehicle travel speeds on Taft Avenue between Lower West Branch Road and American Legion Road due to increased traffic by vehicles, bicycles, and pedestrians as well as sight distance issues. Traffic speed on Taft Avenue has been a concern since Court Street was extended to Taft Avenue and with additional residential development in the area. Since Taft Avenue is shared with Johnson County, the Board of Supervisors will also be asked to approve the reduced speed. Currently, Taft Avenue does not have a posted speed limit and the assumed speed limit is 55 mph. Enforcement of the reduced speed limit will be the responsibility of the City. Action: ITEM 14. (SECOND CONSIDERATION) Comment: Both the Zoning Code and the Housing Code limit occupancy. In 2009, the fine for over-occupancy under the Zoning Code was increased to $750.00 for the first violation and $1,000.00 for the second and subsequent violations. The 2009 ordinance did not include an increase in the fine for over-occupancy under the Housing Code. This ordinance provides that the fines for over-occupancy are the same regardless if the person is cited under the Zoning Code or the Housing Code. (DEFERRED FROM 3/2) Comment: The City has the authority under Iowa Code §364.136 to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. The City issued a municipal infraction against the owner for accumulation of junk and debris, and the court ordered the owner to clean up the property. After the owner did not do so, the court authorized the City to clean it up and to assess the cost of doing so against the property. The City has sent a letter to the home owner giving him notice that this resolution would be on the agenda, a copy of which is attached to the resolution. This property was deferred from the February 16 City Council meeting to allow the City time to request that the court enter judgment for the clean up costs. The packet contains a copy of the court's order entering judgment for the costs to clean up the property and ordering the owner to make $50.00 per month payments. Because judgment has been entered, staff is requesting that the property not be assessed.
