Harvat Hall, 410 E. Washington Street, Iowa City, Iowa, or if said meeting is cancelled, at the next meeting of the City Council thereafter as posted by the City Clerk; at which hearing the Council will consider: 1. By formally amending the budget, the general public is provided with an opportunity to be informed of additional program spending. There are six expenditure program areas into which general government operations are summarized. The following items represent significant amendments within these areas: Public Safety: $478,000 ICPD Emergency Comm. -operations through June 30, 2010 $154,400 JECC -operations and overtime training through June 30, 2010 $140,000 Police Patrol -overtime wages due to extended illness/injury leave Public Works: $173,500 Streets & Traffic Engineering -overtime and wages $150,000 Transit -Loss Reserve Funding Community & Economic Development $2.5 million UniverCity Neighborhood Partnerships -property acquisition and loan repayment upon sale of property General Government: ($365,000) General Fund contingency for FY2010 utilized in full. There are a number of sizable adjustments within the Debt Service, Capital Projects and Business Type program areas due to receipt of federal stimulus (ARRA) grant monies, revision of flood recovery project estimates, revision of the five-year Capital Improvement Page 1 of 16 Program (CIP) and issuance of the Series 2010 Sewer Revenue Bond Refunding. Representative large transactions include the following: ^ ARRA Grant Awards $4.9 million ^ North Wastewater Plant Decommissioning ($17.5) million ^ Dubuque Street Elevation ($16.5) million ^ Idyllwild Levee Protection ($10.4) million ^ West Side Levee ($ 4.5) million ^ East Side Levee ($ 3.3) million ^ Revenue Bond Refunding /Proceeds $16.2 million The attached pages 3 - 6 were made available to the public on Thursday, April 29, as is required by state code upon Notice of Public Hearing. The deadline for submission of the FY11 Annual Action Plan to the U.S. Department of Housing and Urban Development (HUD) is May 15. Applications for CDBG and HOME funds became available in December 2009 and the Housing and Community Development Commission (HCDC) received the completed applications in January 2010. Commission members toured many of the proposed project sites on February 10 and 11 and then each applicant made a short presentation to HCDC members on February 16. HCDC members developed rankings for each project and met on March 11 and March 25 to formulate funding recommendations. On April 15, HCDC held a public meeting to discuss the FY11 Annual Action Plan and Amendments, which included their funding recommendations. At that meeting, HCDC voted to recommend approval of the FY11 Annual Action Plan and Amendments, including a recommendation to allocate an additional $70,000 in FY11 HOME funds to Iowa City's Housing Rehabilitation program. Minutes from the April 15 HCDC meeting are in the April 29 Council information packet. HCDC held back $40,000 in CDBG funds for the Council to review Extend the Dream Foundation's request for funds. In the HCDC justification memo, the commission unanimously encouraged Council to allocate $40,000 for tenant improvements at the proposed property. There appears to be a zoning issue of some sorts that precludes having a coffee shop as one of the enterprises (zoned Ci-1), but we feel comfortable in finding a way to either meet this zoning issue or to request some sort of variance. It is our understanding that the City is interested in insuring the development of the south side of the downtown with an eye to greater diversity and less alcohol saturation. The presence of the alcohol free small Mall businesses and services along with PATV itself would provide a "creative" community amenity for that azea of the downtown. I wanted to share a few observations with you as you make the final decision on the allocations. We had requested $190,000 to build four new homes and repair an existing home. The committee recommended funding at the $114,000 level. First, even though all Habitat for Humanity home owners average $550 per month for their mortgage payments (principal, insurance and taxes: and yes, they pay full property taxes), our application received only a "moderate" in the need rankings which was last out of the six housing groups scored by the committee. We feel this scoring does not fully appreciate that our home owners, all under 50% of AMI, need housing just as badly as other renters. In our case, though, they change from being renters by doing 250 hours of sweat equity per adult to become owners and vested in their neighborhood. Second, we have along-term relationship with each of our home owners as we hold their mortgage and receive their payments. Our mortgages run between 15-25 years. This long-term relationship means we do not abandon them the day they move in and unpack. To date, we have had only one foreclosure in 57 homes constructed in our territory of service. Third, we have built 22 homes in Iowa City alone: those homes pay approximately $38,000 in property taxes each year. We believe all CDBG/HOME funds awarded to build Habitat homes bring real and lasting value to both the neighborhoods and the city coffers. Finally, home ownership has been shown to improve the stability of families and increase student test scores by more than 30% in both math and reading. While we fully acknowledge the need for more high quality affordable rental units in the city, we hope you will agree the investement in Habitat homes is lasting and worthwhile as well. Funds can be used for a wide array of activities, including: housing rehabilitation, homeownership assistance, lead-based paint detection and removal, construction or rehabilitation of public facilities and infrastructure, removal of architectural barriers, public services, rehabilitation of commercial or industrial buildings, and loans or grants to businesses. Priority Needs and Strategies Iowa City is committed to allocating funds that serve the needs of low-to-moderate income residents. Households with incomes less than 50% of the area median income, particularly those with extremely low incomes (less than 30% of area median income), are particular priorities. The City has also identified special needs individuals as among those who face the greatest challenges and who should receive high priority in the expenditure of federal funds, including at-risk children and youth, low income families, the homeless and persons threatened with homelessness, the elderly, and persons with disabilities. HUD and regulatory requirements are restricted to assist households at 80% of the area median income or lower. Given the current market conditions, homeownership costs remain high. As a result, the City is continuing to focus its CDBG and HOME funds to support primarily rehabilitation and tenant-based rental assistance activities. 1. Priority Housing Needs and Activities The 2008 Affordable Housing Assessment reported on the priority housing needs within the City of Iowa City. In the study, existing housing need was determined to be a total of 2,206 housing units. This number is the sum of: 289 lower income households which were living in physically-deficient units 1,358 cost burdened family renter households (i.e., non-student households), and -1 559 cost burdened owner households. Projected affordable housing demand in Iowa City was reported to be 649 units for extremely low income households with incomes below 30% of the median income. This number is the sum of: ~ 544 renter units, and ~_' 105 owner units. Most notably, existing housing demand is more than three times projected housing demand. And, projected housing construction is not expected to fully address housing need. The 2008 Affordable Housing Study estimated that an additional 5,136 housing units will be created between 2007 through 2012 in Iowa City. 3. Influence of Housing Market on the Use of Funds The 2008 Affordable Housing Study included the following projections for new housing development based on the assumption that no changes were made to local policies and no new policies impacting affordable housing (such as inclusionary zoning) were adopted. The study projected that an additional 2,154 housing units would be created in Iowa City between 2007 and 2012. This is equivalent to 359 units annually for the next six years. Of these 2,154 privately developed units, it was estimated that approximately 1,292 units would be single family owner-occupied units and the remaining 862 units would be multifamily renter-occupied housing units. Furthermore, the study projected that the private housing market will continue to favor higher income households, owners and student renters over lower income households and family renters. The study also estimated that approximately 10% of the projected 2,154 market-rate housing units would be affordable to median income households. For these reasons, the City of Iowa City will dedicate CDBG and HOME program funds to stimulate the production of new rental housing units affordable to households up to 80% of the MHI. I'm upset with Housing and Community Development Commission and City Council when it comes to how it handles CDBG funds and HOME funds. For these reasons I think the HCDC and City Council should reconsider the affordable housing issue. 1) There is NO Citizen Participation in my opinion and a lot of others out here feel the same way. By the time I (or we) found out the truth what was going out here permits were already issued or they (THF) was to far into the process. Nobody in this subdivision (business or commercial) were made aware of this project or given a chance to ask questions. 2) The loss of tax revenue with these projects are HUGE and will only get worse if you proceed on this same course. According to the Assessors office the City of Iowa City currently has $14.5 million dollars in assessed low rent property. Of that the city only collects $313,000.00. A potential loss of over $2 million in revenue. The investors that own these properties get a 75% discount on their property taxes. There aren't enough taxes paid by these properties to pay for the services the city provides them. 3) In your City Steps Program 2011-2015 it's noted in Market Barriers, that the high cost of land is just one of many financial problems that face people who want to purchase a home, but then again Iowa City is somewhat land locked. The University of Iowa has about 40% of the property in this town that is exempt. Between City owned property and other tax exempt property, that puts a already heavy burden on the those properties being taxed. Also in a recent article in the Press-Citizen noting its #2 ranking for Best Small Places for Business and Careers. But out of 184 communities it fell short in cost of living and economic growth, 103 and 126. It did say that the median household income was $50,934 which is down from your City Steps Program which stated the median family income was $76,000. Speaking with bankers in this area, they tell me it very difficult for someone making either one of these salaries to afford a home. But it is these same people who have saved money to purchase a nice home only to face higher taxes to make up the difference in loss revenue along with the businesses. 4) Why do these homes have to be built brand new? What % of homes purchased under this program are houses currently on the market? Why can't pre-existing be bought and renovated? With the money that's going to be pumped into the lots and units next to me, someone would have more buying power buying pre-existing homes. 5) The real question is how do you improve the cost of living and economic growth in Iowa City, support our infrastructure and still support tax reduced programs without effecting current businesses and homeowners with the tax increase to make up the difference? I think HCDC and City Council should look at the financial impact in relationship to increased property taxes it has our businesses and residential areas. 6) The HCDC and the City Council should work with the School District when it comes to where homes or property is purchased for these projects so you don't saturate any certain school(s) with to many kids that are involved with the free lunch program. That seems to be a side effect with this program and one of the obstacles in the redistricting process also. The meeting will be held at City Hall, Emma Harvat Hall, 410 E. Washington Street at 7:00 p.m. The Citizen Participation Plan sets forth the steps Iowa City uses to encourage citizen participation in the development of the Consolidated Plan (a.k.a. CITY STEPS), Annual Action Plan, any substantial amendments and the Performance Report. Copies of the Citizen Participation Plan are available from the Department of Planning and Community Development, 410 East Washington Street. In addition, a copy of the Plan is available for review at the Iowa City Public Library, 123 S. Linn Street or on Iowa City's web site (www.icgov.org/commdev under Documents and Resources). The deadline for submission of this plan to the U.S. Department of Housing and Urban Development (HUD) is May 15. As a reminder the Citizen Participation Plan is a required HUD document that sets forth the steps Iowa City uses to encourage citizen participation in the development of the Consolidated Plan (a.k.a. CITY STEPS), Annual Action Plan, any substantial amendments and the Performance Report. On April 15, the Housing and Community Development Commission (HCDC) held a public meeting to discuss the Citizen Participation Plan. At that meeting, HCDC voted to recommend approval of the Plan with one minor clarification (adding "whichever is less."). HCDC recommends that the following paragraph on page 3 be changed as follows: • Change in Scope: if the scale and/or nature of the activity changes to the extent that there is a significant increase or decrease in funds budgeted for the activity. For activities with an original allocation of $50,000 or more, an amendment to the applicable Annual Action Plan is required if the change in scope exceeds $50,000 or 25% of the original budget allocation, whichever is less. If needed, amendments or changes to this plan may be considered at the May 10 meeting. A draft copy of the Citizen Participation Plan was included in your April 8 Council information packet. You can also find this document at www.icgov.org/commdev under Documents and Resources. At your May 10 meeting, we are asking that you consider approval of the Citizen Participation Plan as recommended by HCDC.
