Washington Street , Iowa City, IA 52240 June 2, 2010 Dear Mayor Hayek and Iowa City Council members, On behalf of the Downtown Association of Iowa City Board of Directors, thank you very much for pour consideration of the amendment to the solicitation ordinance, as well as the ordinance prohibiting smoking in the Pedestrian Mall. We are well aware of, and understand, the opposition to the solicitation amendment and wish to thank the City staff, which was extremely helpful in crafting an amendment that is fair to everyone. As you know, the goal of this ordinance is to move solicitors away from the pedestrian traveled areas directly in front of stores. This restriction allows solicitors downtown but moves them away from the area that is most disruptive to businesses. Likewise, solicitation at intersections was causing people to jay walk to avoid solicitors standing on sidewalks directly in line with the crosswalks. We also worked with the staff to minimize any impact on musicians, which we all realize are such an important part of the festive downtown atmosphere. We believe that the amended ordinance will be very helpful in assisting downtown businesses to prosper while also allowing space for solicitors. Furthermore, the prohibition of smoking in the Pedestrian Mall is a great public health benefit for both the patrons and employees of downtown businesses. Our goal is to continue to work with the Council and City staff to make downtown the best it can be. We are very grateful for the respect and cooperation we have received from the City. Wyss RE: March- April 2010 Use of Force Review DATE: May 27, 2010 The "Use of Force Review Committee" met on May 27th, 2010. It was composed of Captain Wyss, Sgt. Hurd and Sgt. D. Brotherton. For the review of submitted reports in March, 37 Officers were involved in 12 separate incidents requiring use of force involving 22 individuals. In April, 14 Officers were involved in 10 separate incidents requiring use of force involving 10 individuals. No training or safety issues were identified. All issues or concerns were identified and addressed at previous levels of review. Of the 22 incidents over the two month period, 19 Officers had drawn sidearm or displayed weapons and one of those was for the destruction of an animal. There were eight separate incidents that required a display of weapon response. OC was deployed on one occasion, and in six incidents a Taser was discharged. On two separate occasions, a Taser was displayed which resulted in compliance without deployment. There was one vehicular pursuit involving one Officer during this time period. Of the 22 incidents reviewed, 4 suspects sustained superficial injuries. No Officer injuries were documented during this reporting period. All personnel continue doing a good job in their documentation and review of the reports. Please contact me if you have any questions. Of the 42 properties, 30 of the homes have been acquired through the Hazard Mitigation Grant Program (FEMA), eight with Community Development Block Grant (CDBG) funds, and four with Community Disaster Grant (CDG) funds. In the last weeks, two more properties were demolished in Parkview Terrace and one property was demolished on Taft Speedway. As of today, 32 properties have been demolished in the Parkview Terrace and Taft Speedway neighborhoods. • The City is now accepting applications for Round Two of the Single Family New Construction Program. The program offers down payment assistance of up to 25% of the purchase price of 37 newly constructed homes in Iowa City to help address the loss of Iowa City housing stock in the 2008 flood. Applications will be accepted through June 25, 2010. • Staff continues to review Jumpstart applications for disbursing State Jumpstart 2 and State Jumpstart 3 funding for housing rehab/repair, down payment assistance and interim mortgage assistance. A total of $1.68 million in State Jumpstart funding has been used to assist 75 flood- impacted residential households and $861,000 in Federal Jumpstart funding has been used to assist 17 households. • The City is now accepting applications for the two new business assistance programs: Equipment Reimbursement Assistance Program, and Flood Insurance Reimbursement Program. The City is continuing to take applications for the other four available business assistance programs: Expanded Business Rental Assistance Program, Loan Interest Supplement Program, Residential Landlord Business Support Program, and Commercial Rental Revenue Gap Program. • The I-JOBS Board of Directors will be meeting in Coralville during the morning of June 2"d. The Board will be visiting Iowa City during the afternoon of June 2"d. CONSIDER APPROVAL OF THE MINUTES OF THE MARCH 16 2010 ECONOMIC DEVELOPMENT COMMITTEE MEETING: Mims moved to accept the March 16, 2010, meeting minutes as amended (name spelling). Hayek seconded the motion. Motion carried 3-0. CONSIDER A RECOMMENDATION OF THE MOSS GREEN URBAN VILLAGE TIF ORDINANCE: Ford briefly explained the TIF ordinance which allows for development incentives using tax increment financing. She noted the difference between the TIF ordinance, which simply allows for development agreements to be implemented, and the Development Agreements themselves, that are project-specific and include city-defined performance measures for developers to meet. An economic development driven TIF district can be set up for 20 years, according to Ford, however, a development agreements are typically of a shorter duration. This item will go to the full City Council at their next formal meeting. Hayek moved to accept the staff recommendations for the Moss Green Urban Village TIF ordinance as proposed. Economic Development Committee Meeting April 20, 2010 ENERGY EFFICIENCY REVOLVING LOAN FUND PROGRAM UPDATE: Ford noted that last summer the City was awarded $692,300 to create and implement some energy efficiency strategies. Four projects were developed, and Ford explained the one in particular, related to Iowa City economic development. This is the Energy Conservation Opportunity Revolving Loan Fund (ECO-RLF), which has $250,000 ready to loan on a revolving basis for businesses who wish to upgrade, install, or build energy efficient components for their business. The idea is to structure repayment of the loans by the savings realized in energy bills. The interest rate for ECO-RLF loans is set at one half percent, according to Ford. She added that a brochure is available on the City web site, as is the application for the loan program. Bailey suggested they promote the opportunity to the non-profit community as well. STAFF TIME: Ford noted a further correction to the March 2nd minutes, regarding the K-Mart application to change their building exterior. She explained an inaccuracy in the discussion at that meeting and noted that K-Mart had requested the changes to their building and not the Pepperwood Place owners, Kobrin Development Company, Inc. (fka Southgate Development Company, Inc). Hightshoe then gave a brief update regarding the CDBG economic development funds. She stated that since beginning this fund in FY03, they have had 30 applicants, and have funded 18 projects. She explained how they work with private lenders to help these small businesses achieve the funding they need. She also gave an update on an outstanding loan, noting that they are going through the courts to collect these funds. Hightshoe gave Members some further history on this program, noting some of the recent project successes and challenges they have dealt with. Hightshoe also spoke to Members about an idea that came about through the City STEPS process about a class for preparing high-schoolers for jobs. She stated that they have been working with City High to implement the program, and City High has offered a class to students who are interested. They meet twice a week with these students and work on resumes, job skills, and interview skills, and will even be hosting a small job fair on May 7. Economic Development staff has been working with other interested parties including the UI Small Business Development Center on this project. APPROVAL OF MEETING MINUTES: Minutes from both the April 15 and April 29, 2010, meetings were reviewed. Aviation Commerce Park -Tharp noted that other than the lot offer on Lot #10, which the Council did accept, there isn't much more to report. Dulek noted that the abstract needs updating, but otherwise things should be wrapped up soon. b. FAA/IDOT Projects - AECOM -David Hughes -Tharp noted that Hughes is not present this evening. i. Runway 7/25 8~ 12/30 -Tharp noted that they have some of the punchlist items yet to complete. ii. Obstruction Mitigation -Tharp noted that he does not have an update on this item. Dulek noted that she did send a letter to the contractor for the United Hangar demolition regarding final documents for payment but has not heard anything back. iii. 2010 Pavement Rehab -Tharp reported that they will need to have a special Commission meeting on June 30th in order to have the public hearing on this item, and subsequently approve the plan specs. Bids would then be opened July 19th, and the contract would be awarded at the August 19th meeting. Construction could then begin shortly after this. This will be a 30 to 45-day Airport Commission May 20, 2010 Page 2 project, according to Tharp. The majority of the project involves crack sealing and general pavement repair type issues, in addition to some drain improvements in the Hanger "A" area. The total on this project is around $220,000. c. 2011 Air Race Classic -Gardinier noted that she is still working on some of the details for this. The dates of the race will be June 21St to the 24th, with planes starting to arrive around the 16th of June. Gardinier added that she did meet with staff at the Convention and Visitors Bureau recently regarding the race. She also noted that they have received a $1,000 donation from the Iowa Aviation Promotion Group. Gardinier then responded to Members' questions regarding the race, adding that as she finds out more information on next year's race she will let the Commission know. Gardinier also noted that due to this year's Air Race Classic, of which she is a participant, she will not be at next month's meeting. d. Corporate Hangar "L" -Tharp reported that he added the State application to the packet. He noted the breakdown of the funds, adding that he did receive a call from the State already. e. Airport "Operations": Strategic Plan Implementation; Budget; Management - Tharp stated that he is working with Accounting on some delinquent tenants. He believes this should be resolved soon. He added that overall they are doing okay budget-wise. Tharp noted that they are looking at a possible $4,000 bill to fix the south gate opener problem. The north gate is functional at this point, according to Tharp. A brief discussion ensued about whether they should do both the south and north gates at this time. Horan asked if they shouldn't go ahead and budget for the north gate for next year. Tharp noted that they must do the south gate now, but that he believes they could budget for the north gate to be redone in the next few years. Members agreed that Tharp would have the south gate fixed now. Gardinier then asked why there is no hot water in the Terminal building, adding that she has never been able to get hot water in the restroom. Tharp noted that this has been an ongoing problem, and basically what happens is the pilot light keeps going out on the water heater. Members briefly discussed this issue, with Tharp stating that they could always do under-sink type heaters in the restrooms. He will look into this further and report back to the Commission. Crane asked about the year-to-date expenses, and whether there are any expenses outstanding. Tharp responded, noting some asphalt work to be done this summer for about $60,000. f. FBO /Iowa Flight Training /Whirlybird Reports -Matt Wolford of Jet Air introduced himself to Commission Members, noting that he has just moved to Iowa City from Galesburg. He shared a maintenance report with those present, noting that the only thing not included is the carpet cleaning that was just completed. He also noted that the open house is this upcoming weekend and Jet Air has been getting things ready for this. Gardinier asked if there are any plans to cut the brush around the Airport perimeter, and Horan responded. Adam Henderson with Whirlybird Helicopters spoke next. He stated that they have been preparing for the open house, as well. Henderson then briefly shared how his business has been doing; adding that he currently has eight students enrolled. Henderson then responded to Members' questions regarding Whirlybird Helicopters. g. Subcommittees' Reports -Horan asked Tharp to make the subcommittee list a part of the normal packet. Commission Members' Reports -Crane noted the possibility of youth programs being offered in aviation. Tharp stated that he is familiar with the group promoting this. He added that Jet Air did atwo- or three-day camp a couple of years ago for youth. Horan shared with new Members some web sites they can visit for aviation information. Gardinier shared with Members that she had been interviewed recently for a Mediacom television show. i. Staff Report -Tharp noted the open house this coming weekend on Saturday from 9:00 to 5:00, stating that he has had phone calls from local congressional folks who have stated they will be stopping by. SUMMARY OF DISCUSSION Coleman reported that the media unit has been busy working on a monthly series for the police department. The Community Television Service was very busy in April. 23 programs were recorded. Typically, about 8-12 programs are recorded per month. The Community Voice IC People program featured a woman who was ordained as a priest. The Downtown Association was profiled in the notable non-profit program. Programs are planned with I Renew, an environmental group, and IC Pride. The City Channel has enhanced its streaming video offerings. McBride reported that the University channel will cover all ten commencement ceremonies. Goding reported PATV has hired two new interns. On March 24 Goding gave a presentation on PATV to students at North Central Jr. High. A group of those students produced a no smoking psa. Goding spoke at an environmental film festival at Augustana College about community media. PATV hosted group of girl scouts and they assisted in production of a program. Some people from Goodwill recently produced a program. PATV staff will be going to Oakdale to record a chorus made up of inmates and others. Discussions about leasing space to the Extend the Dream Foundation have been positive and they may move in in August. Fisher noted that the library's quarterly report was included in the meeting packet. In April 8 Story Time programs were shot, 10 adult programs, and 2 shot by the Community Television Service. Hoyland reported he recently sent an email out to all the schools, which resulted in him being sent a DVD of a concert. A second email generated 2 responses requesting assistance. An issue arose regarding what would be the policy if a student did not want to appear on the channel. The school administration did not offer a response so Hoyland will require all submitted programs from the schools to go through the principal or the librarian and they will be responsible for such issues. Brau reported that the Iowa General Assembly passed a bill modifying the state franchising law. The bill was signed by the governor and is currently in force. The bill puts a year deadline on the amount of time a new entrant has to provide service. If they do not, the incumbent's state-issued franchise could be revoked and the previous franchise reinstated. The legislation also requires a prior demonstration of financial and technical ability to provide service before a state franchise can be issued. UNIVERSITY OF IOWA REPORT McBride reported that all ten commencement ceremonies will be covered. Nine of them will be recorded in four days. The ceremonies will be played back on the channel back to back. They will also be available on their website. Fewer new programs will be produced in the summer. KIRKWOOD COMMUNITY COLLEGE Kirkwood provided a written report. PATV REPORT Goding reported PATV has hired two new interns. The next board meeting will be on May 20 at 7 p.m. The next guidelines workshop will be May 2 at 2:30. Other workshops are by appointment. A letter to the editor appeared in the Press Citizen recently criticizing the content of a program produced by a staff member of PATV on his own time. The program had been removed from playback prior to the letter being published. The program featured a pirate radio DJ who appeared to be smoking marijuana. The producer agreed to withdraw the program as it could be construed to be promoting illegal activity. The incident stimulated a discussion among the staff balance between pushing the boundaries of free speech and protecting PATV as a resource. Goding asked the producer to write a letter to the editor in response. Hoerschelman said Goding handled the matter appropriately. Mekies said the internal discussion PATV had about their role and responsibility was productive. PATV is a valuable resource and it is important to be sensitive to public perceptions. Bergus noted that in the comment section of the online Press Citizen there were three comments supportive of PATV and none critical. SENIOR CENTER REPORT No representative was present. LIBRARY REPORT Fisher noted that the library's quarterly report was included in the meeting packet.
