They said they had to clear a 30-foot-high clearance area over the street for the new Mega-buses to park at the curb at 320 South Dubuque Street. I pointed out to the tree trimmer that there is not a commercial vehicle in this nation that requires a thirty-foot vertical clearance, and that freeway bridges generally have a 14-1/2 foot clearance limit under bridges crossing the freeways. The founder of this Committee also pointed out to the city tree trimming crew that there are two squirrel nests in the first (south-most) tree, and that squirrels as a wildlife species are protected in this city, that the crews should not disturb those nests by indiscriminately cutting away limbs surrounding those squirrel nests, because those lower tree limbs provide protection from predators. The tree trimmers said they did not know the squirrels were protected, and that nobody had ever told them that! Unbelievable! City crews have already decimated the squirrel population around North Dubuque and Market and Jefferson Streets by cutting away squirrel nests, and two years ago when city crews trimmed the old tree at the northeast corner of Court and South Dubuque, they deliberately cut away a six-foot squirrel nest, which subsequently caused the squirrel family of several squirrels to die from lack of a weather-protective winter home a few months later. Squirrel populations all over central downtown Iowa City have been decimated by tree trimming the past two years! But most of all, the selection of the bus stop for Mega-bus at 320 South Dubuque Street was really stupid, inconsiderate, and not in any way determined by surveying the residents at that street location. It is typical of the mentality of upper-class people to make such commercial decisions, by decision-makers who do not live down town to simply say "Oh well, that's good enough for (that - fill in the blank), I don't live there, it's no biggie to me!" and then to put such a commercial bus stop right next to a residential apartment building where the noise overpowers radios and televisions and telephone conversations. Now, with this new bus stop on South Dubuque Street, there is a greatly-enhanced noise problem in this rental-residential neighborhood that was only an occasional bother with Greyhound's buses that were purchased by Laidlaw when Laidlaw owned Greyhound. But, with commercial bus service brought to this apartment-side location at the very side of the apartment building at 320 South Duquque Street, a far greater noise problem that never existed before now exists. First, the additional location of a new bus stop not at but across the street from the transportation center, where this new commercial bus stop is now located, was entirely 1 dumb and inconsiderate of tenants living in Capitol House Apartments. Dubuque Street As directed by Title 9, Chapter 1, Section 36 of the City Code, this is to advise the City Council of the following action: Action: Pursuant to Section 9-1-3A (19), Install (2) BUS PARKING ONLY - 30 MINUTE LIMIT signs on the east side of the 300 Block of S. Dubuque Street. Comment: This action is being taken at the request of a regional transit provider to delineate an area in the 300 Block of S. Dubuque for temporary bus parking. This action will allow buses to park for up to 30 minutes in order to load/unload or to stage vehicles waiting to access reserved bus parking at the Court Street Transportation Center. No on-street parking will be removed as a result of this action. There are several false and several very misleading statements to this announcement. First of all, it is not for transit, it is for commercial inter-city and inter-state bus service. Second, it is not temporary, although at the fares being charged the Megabus will most likely go out of business. Third, the sign clearly says bus parking for thirty minutes, however, most people will consider the sign to indicate exclusion of other parking, and in fact if a bus arrives and finds a privately-owned automobile parket there, I am sure the driver will contact the Iowa City Police for removal. The wording says at the Court Street Transportation Center." That wording is totally untruthful, it is across the street from the Court Street Transportation Center at the side of an apartment building with tenants, the six-story Capitol House Apartment building at 329 South Dubuque Street. I understand from an interview by one of the local newspapers that nobody in City knows who suggested that location, but it is right next to three existing residential apartment buildings, where idling bus noise can and does echo against the edifaces on three different angles, to bother the residents for the past three days, and that is because the commercial bus station on Court Street is extremely limited in space for use by increased use by commercial inter-city and interstate buses. The "old bus station" in the gas station that has been torn down on Gilbert and Washington Streets had no more room than what is presently provided now for Burlington Trailways and Greyhound bises on Court Street, both locations only had/have space enough for two buses. The founder of ICCCommittee has seen as many as four buses there at the Burlington Trailways/Greyhound bus station on Court Street on rare occasions, but on more frequent occasions there has randomly been three buses at one time, and there is no space for three buses. When a break down bus is parked at the bus station awaiting repairs, that space is reduced in half to only one bus length. Now the City allows a third bus line to park around the corner from the already-crowded bus station, around the corner at a residential apartment, bringing arriving and departing and idling bus noises at night several times each calendar day, coming from right in front of the apartment front entrance, with a potential of five buses at one time appearing at the corner of Court and South Dubuque Street on occasion!. This was not revealed to the public in any public assessment disclosure by Iowa City, and no public official presentation of any study that has taken place has been revealed for public comment. The only information we saw was an announcement vaguely saying that transit buses were desired to be parked in front of the Transportation Center on South Dubuque Street, which would indicate Iowa City Transit buses being parked in front of Fair Grounds coffee cafe, an even worse bad that been the choice as well. Even parking across the street from Fair Grounds at the Capitol House Apartment building will limit the customers who once parked momentarily to get a coffee and then drive somewhere else, because the parking slots in front of Fair Grounds is often taken by morning and late afternoon patrons. Typical of Iowa City's communist govern-mentality to shun Democracy, by not first 2 involving the public in participation in decision-making such as in this issue, and by overlooking pre-announced discussion with the public prior to any decision-making, this is exactly just like what Iowa City Council allowed with Sheraton Hotel to usurp and take over the public right-of-way through the Sheraton Hotel building, and again in this bus- parking issue, the City Council again gives total approval to commercial usurpation of public areas and in imposing disruptive commercial presences upon the public, regardless of the impact on the public. And I know the City Council has been and is totally indifferent to the public's right to an enjoyable city environment, as is shown by allowing apartments and houses to be built next to railroads and the air port, the infiltration of our Iowa City downtown commercial area by the University of Iowa and infiltration of residential areas by Mercy Hospital, the Sheraton take-over of the Pedestrian Mall public right-of-way through the building which was once the former South Dubuque Street, and on and on and on. However, the effect of the selfishly-officious attitude by Iowa City government is steadily turning our Iowa City into another Chicago, and our once happy in-town apartment residence area on South Dubuque Street is rapidly being turned into a noisy commercial zone of commercial-invading environmental discord, and squirrel and bird habitat destruction along our streets. I am making this correspondence be a public record simply as a historic reference for citizens in the future that not everyone in Iowa City is an obedient communist subject of the city, ruled over to the commercial destruction plans over our once beautiful city, that there are now still reminants of and were memories of how it was at this present time, for the historic perspective of future residents in Iowa city, this Committee says that there are those of us who treasure the original pleasant atmosphere of Iowa City and who resent the destruction of our community atmosphere that has been caused by our own City government. Of course, you, the City Council, can change this sterilizing devastating course of "Chicago-izing" our downtown city, and to start respecting those of us who live in the threat of these affected planned areas that are slated for pseudo-progress, thus to bring real progress that enhances an enjoyable life style by preserving the culture and living environment of what has been the real iowa City. But so far, the slow and relentless procession of Chicago-izing Iowa City has had a devastating effect already on the original community environment. I wrote about this January 19 and February 23. I'd like the Council to consider. I have long argued for a greater use of development impact fees. I think there is a great opportunity out there right now that would allow Iowa City, Johnson County, and perhaps Coralville and Tiffin to develop in a smarter and less expensive manner. Iowa City recently came to Johnson County with a proposal to annex 132 acres north of I-80, just west of Pearson. I believe this annexation makes sense, but only if Iowa City and Johnson County begin charging a development impact fee in the area. Some background: Planners in local governments have long envisioned Oakdale Boulevard as the primary east-west arterial street north of I-80. Oakdale already serves this purpose through much of Coralville; what most folks do not realize is that Oakdale is penciled out from west of Tiffin all the way to Scott Boulevard in eastern Iowa City. The fact that the road is planned is great; the implementation has left much to be desired. For example when Oakdale was taken east of 12th Avenue in Coralville, local leaders should have required that it be connected to Dubuque Street. People who did much of the development in the area claim they would have paid for the road had they been asked. (Of course, that is easy to say now! But local electeds should have forced the issue.) Some folks saw what was coming. Then-Supervisor Jonathon Jordahl argued that this situation would create traffic problems, and create a disincentive for future development. Jonathon nailed it. Fast forward 10-15 years, and now Johnson County and Coralville are collaborating on a completion of Oakdale from the dead end to Dubuque Street. Taxpayers in Coralville and rural Johnson County are now footing the bill. Again, this SHOULD have been paid for; developers could have added $2,000 to each of 500 lots and extended the road. Instead, the road was allowed to dead end. Now, instead of $1,000,000 paid by developers, we have $4,000,000 paid by folks who never asked for the development in the first place. Oakdale will soon reach Dubuque Street on the west. If Iowa City develops according to the plan in the proposed annexation, Oakdale will start moving west from Highway 1. That leaves a big gap in the middle. Who will pay to fill in this gap? If both Iowa City and Johnson County begin to charge a development impact fee now, we can save up enough money to connect the road all the way through. It would then be paid for by the development as opposed to being paid for by taxpayers. This is particularly relevant to rural folks. County roads are paid for through the Rural Fund. It will be difficult to argue that the area in question is 3rura12, yet rural landowners will foot the bill. That just isnlt fair. In addition, a full connection between Dubuque Street and Highway 1 requires crossing the Iowa River. That bridge will NOT be cheap! I strongly urge elected officials in Iowa City and Johnson County to enter into a 28E agreement, and to begin collecting a development impact fee in this area. Johnson County, Coralville and Tiffin probably ought to be talking about the same thing heading west. We have an opportunity to do this right. We've evaluated a 'split-phase' traffic signal configuration as you've suggested at the Church St /Dubuque St intersection, where the north- and south-bound legs of the intersection would alternate. We determined this would benefit left- turning vehicles, but would increase delay for the majority of vehicles due to the need to increase the overall signal phase -this is why we recommend not having asplit-phase configuration at this intersection. We discussed a project with the City Council and the surrounding neighborhood a few years ago to add a separate left-turn lane for north- and south-bound traffic on Dubuque St at Church St; Council decided not to go forward with the project at that time. This would alleviate much of the congestion on Dubuque. Currently, when traveling South on Dubuque, cars in the left lane wishing to turn left block the south bound traffic such that often only 2 or 3 cars in that left lane get through during one light cycle. This effectively turns Dubuque into a one lane road. Giving the housing density on the north end of Dubuque Street the need of people to enter the down town and east side of Iowa City from the north, this problem need to be addressed. The only access in and out of the Windsor West Neighborhood is American Legion Road which does not have any sidewalks or shoulder. This presents a major safety issue to pedestrians, bicyclists, and vehicles when vehicles encounter such pedestrians and bicyclists. Many of us have seen and experienced near misses year round. This letter is to request the City of Iowa City to install a sidewalk from Scott Blvd to Buckingham Lane. as soon as possible to prevent an injury or fatality. We understand that Americar ~Iegori Road is on the 5: year capital road, improvement plan, but we also know that does not guarantee that the road will be upgraded within the 5 year time period. We cannot afford to wait any longer due to the safety concerns. We understand that when the neighborhoods off of Sycamore Street (1/2 mile South of Hwy 6) encountered this same issue a sidewalk was installed until such time that Sycamore Street is upgraded. We have contacted city staff to investigate the issue. Ron Knoche (City Engineer) has gathered and provided the attached cost estimate to install a sidewalk on the North side of American Legion Road from Scott Blvd to Buckingham Lane. The timing of this meeting is important, occurring approximately a month before the Joint Emergency Communications Center (JECC) is scheduled to be operational and before the Policy Board has hired a new Executive Director. We are writing this letter to inform the parties of areas where we believe the parties can work together to improve the structure and management of the JECC. We hope that at least some of these items can be addressed on the 28th and a plan established to address other ideas in the future. Our concerns fall broadly into the categories of governance, finances and communication among the member entities. 913 SOUTH DUBUQUE STREET, SUITE 201 • IOWA CITY, IOWA 52240-4207 • PHONE: (319) 356-6000 • FAX: (319) 356-6036 Governance: The Board of Supervisors suggests that the parties consider amending the 28E agreement to provide that an elected leader who is a member of the Emergency Management Commission and from one of the communities not otherwise represented on the Policy Board serve as a director. Now that we are a few years into the agreement, we believe that it is important that all the representatives on the Policy Board be elected and therefore directly accountable to local taxpayers. Finances: There are a number of issues concerning the financial management of the JECC that we would like to address. These issues include: 1. The Board of Supervisors would like to see JECSA gradually build up reserves and believes that the Policy Board has taken a more aggressive approach to building up reserves than is necessary given the large start up costs already being expended. Supervisors would like to learn more about the Board's plan for reserves. 2. We would like to emphasize our belief that the Policy Board should consider bonding for major expenses whenever the costs of bonding do not outweigh the benefits. This will allow the properties located in TIF districts to participate in sharing the costs of these expenses which reduces the burden on other taxpayers. 3. We are concerned that the number of administrative staff is in excess of what is necessary to effectively operate the JECC. We would appreciate additional information and justification regarding these positions. We also would like to know whether, if necessary, the additional administrative staff must be hired immediately, rather than waiting until the JECC has been operational for an appropriate period of time. Communication: Open communication among the parties and transparency of finances and decision-making is crucial to this joint project. At the meeting on May 28th, we hope that the following can be addressed: 1. We would like to discuss the parties' expectations for receiving updates and offering input regarding policy decisions. 2. The 28E agreement requires that a complete annual report be provided to the parties by March 31 beginning in 2009. It does not appear we have received the 2009 or 2010 annual reports. We are also not sure whether the Secretary of State has received the appropriate annual reports. We would like to know the status of these reports. 3. The JECC is funded by a countywide levy that is included in the County's budget and certified by Johnson County. The tax levy which supports the JECC is shown on tax statements as being part of the county's tax. Members of the Board of Supervisors are often called upon to explain the level of taxation that supports the JECC. Therefore, the Board of Supervisors would like to address the timing and communication of the JECSA's budget request. One suggestion we would offer is that a joint meeting between th~olicy Board and the Board of Supervisors be scheduled each year prior to submition oe °"=~~ budget. Finally, the Board of Supervisors would like to address expectations regarding the availability of information regarding the policies and operations of the JECC. We believe that the management of the JECSA must do significantly more than what the contract requires to ensure that the member communities and the taxpayers are well informed regarding the operations of the JECC. Providing current, accurate, and accessible information helps prevent misrepresentations and corrects misinformation. Agendas and minutes and financial reports must be made available in a timely and accessible way. Recordings of meetings should also be publicly available. We look forward to starting to address these issues on the 28th. We know that other communities will have input as well. Violation of any of the provisions of chapter 123, the alcoholic beverages control provisions of the Iowa Code. 3. Any change in the ownership or interest in the business operated under a class A, class. B, or class C liquor ,control license, or any wine or beer permit, which change was not previously reported to and approved by the city council. Iowa City
