Joan,
I appreciate your attempts to solve this problem. The one thing I would disagree with is your
description that this is a possible nuisance. It simply is a nuisance and possibly a health concern
to neighbors.
I simply don't understand why the cost to drain and take down the pool cannot be placed as a
mechanics lien against the property. The cost to the city would be recouped when the property
was sold.
Also, you state that the city cannot go onto the property to mitigate the problem. Then under
what authority does the city have to enter a property to mow the grass when it gets above the
authorized length or survey land for zoning or platting?
MidAmerican Energy has gone on the property to disconnect service and so has Mediacom and
other service providers. My only desire is to have the pool drained and disassembled. To simply
drain the pool in a one time effort does not keep it from filling again with rainwater .
I appreciate your attention to this matter and look forward to it's resolution.

Your letter of July 11, 2010 regarding the above ground pool full of standing water at 1730
lakeside Drive has been referred to me for response. As you note, the property owner is not
readily available for contact as the property is currently uninhabited and has fallen into
foreclosure. The City is aware of this issue and has taken the following steps in an attempt to
ameliorate the possible nuisance caused by the stagnant water in the pool. A list below will allow
you to see what has transpired.

1. April 26 I stopped by the property & knocked at the door with no response. Property
appeared vacant. Neighbor stated that property has been vacant since mid March.
Taped my business card to the front door in hopes of getting a call.
2. Sent notice of violation to current owners of property with a re-inspection date of May 14.
3. May 14 I went to the property to re-inspect and the pool was still full of stagnant water.
Neighbor stated it had gone into foreclosure.
4. May 14 & May 27 talked with BAC Servicing and they stated the property had been sold to
Bank of New York. Called the Assessor and they did not show it had changed hands from
BAC. They did state that an eviction was taking place at the property on Wednesday,
June 2.
5. June 2 I stopped by the property and talked with two gentlemen who worked for Mid
American Property Management out of Nebraska . They had been hired for the eviction
by BAC Home Loan Servicing. Called Mid American Property Management and talked
with Joy Johnson who stated they had indeed been hired for the eviction. He will let them
know the City is in need of the pool being drained.
6. Called and talked with Joy Johnson/Mid American Property Management to see if he has
heard anything regarding the pool. Mr. Johnson stated they had submitted a bid into BAC
Home Loan Servicing to have the pool drained or removed. As of that time they had not
been given permission to attend to the pool.
7. June 18 a notice of violation was sent to Bank of America in Plano , TX and a copy sent to
BAC Field Service Corporation in San Bernardino , CA giving them until July 6 to come
into compliance.
8. July 7 I stopped by the property and again nothing has happened to bring the pool into
compliance.
9. July 12 I emailed Bank of America Field Services & copied Mid American Property
Management asking that someone contact our department no later than July 14 in regards
to the swimming pool. I heard nothing.
10. July 16 received phone call from Debbie Cardenas with Bank of America Field Services
stating this is one of four properties they no longer own.
The City is not authorized to go onto the property and/or take action concerning the condition of
the pool without an order from the court. The City had considered issuing a municipal infraction
citation for the nuisance at the property in hopes of getting a court order to abate the nuisance
violation. As of today we have heard that BAC no longer owns the property and that it is now
owned by the Secretary Of Housing And Urban Development of Washington, D.C.
I will be out of the office next week on vacation. Jann Ream ,Code Enforcement Assistant may

RELOCATION OF THE NORTH WASTEWATER TREATMENT FACILITY
Nearing end of manhole survey task

Water Division
River Crossings
Due to the lack of `obligation' designation from FEMA we have curtailed the design and
construction of replacement of two 12" river crossing repairs (Old Plant and Hwy 6).
Howard R Green Consultants (HRG) has submitted a draft of scope of services for
design, bid specifications and inspection of the interim project to repair and support the
undermined sections of the two existing 12" water mains. We will wait to see if FEMA
funding comes through for the replacement project.
A meeting with FEMA staff regarding the status of this project is being set up by Deb
Mansfield.
Peninsula Source Protection
• The HRG Hazard Mitigation Study is the source of planning for proposed funding and
projects on the peninsula site and the plant site improvements.
• The PW and Hazard Mitigation Plan for peninsula work; CW 3, CW 4, SW 4, JW 2 and
the respective electrical systems has been `obligated' by FEMA.
• Plans and Specifications for the Hazard Mitigation projects are being scheduled for
public hearings with the City Council in order to put them out for bid. The proposed
schedule will have the projects completed by 12/31/10.
• A City Floodplain Development Permit Application was approved by Julie Tallman with
HIS for the project(s).
• City Council voted to award a contract to Price International Electric, Inc. on 7/12/10.
Notice to Proceed is scheduled for 7/26/10 with project completion scheduled for
12/31 /10.

PLANNING AND COMMUNITY DEVELOPMENT
The City has acquired a total of 50 residential properties and 16.5 acres of property from
Parkview Church along Taft Speedway with Federal and State funds. Of the 50 properties, 32 of
the properties have been acquired through the Hazard Mitigation Grant Program, 12 with
Community Development Block Grant (CDBG) funds, and six with Community Disaster Grant
(CDG) funds. A total of 38 properties have been demolished in the Parkview Terrace and Taft
Speedway neighborhoods. All structures in the Showers Addition have been demolished and
cleared.
• Staff is preparing a grant application to the I-JOBS II program for the
Baculis/Thatcher/Commercial Court levee. The application is due August 2"d
• Staff is continuing work on an application to fund a tornado safe room near the Public Works
building in Napoleon Park. The park is heavily used during the summer. The safe room would
protect park users against high winds and tornados.
• Staff continues to review Jumpstart applications for disbursing State Jumpstart 2 and State
Jumpstart 3 funding for housing rehab/repair, down payment assistance and interim mortgage
assistance. A total of $1.84 million in State Jumpstart funding has been used to assist 77 flood-
impacted residential households and $861,000 in Federal Jumpstart funding has been used to
assist 17 households.
The City continues to accept applications for the following disaster business assistance
programs: Loan Interest Supplement Program, Residential Landlord Business Support Program,
Commercial Rental Revenue Gap Program, Equipment Reimbursement Assistance Program,
Flood Insurance Reimbursement Program, and Expanded Business Rental Assistance Program.
The deadline for all business programs is now December 31, 2010.

The Iowa City Landfill and Recycling Center is sold out of Community Compost for the season.
Additional Community compost should be available again next spring.
This year is the first time the landfill has sold out of compost completely. As the quality of the
compost has improved in recent years, demand has increased. Popular uses of Community
Compost as a soil amendment include residential gardens, lawns, and public projects. The
supply which began "processing" last summer and fall has been used up early this year.
The amount of incoming yard waste materials from the public has decreased in the past year as
well. In the City's Fiscal Year 2009, about 1,865 tons of compost were made and sold, which is a
decrease in production of 25% from 2008.
Yard waste will continue to be accepted and processed this fall and through the winter. Because
the composting process takes six to nine months to fully "cook and cure", finished compost will
not be ready until spring 2011.
A press release will be sent when the compost is ready for sale in the spring.

Comprehensive Plan Update
If you are receiving this newsletter, your city and county are part of a
regional effort to reduce the amount of waste being landfilled. Since
1991, the cities and counties of the East Central Iowa Council of
Governments solid waste planning area have cooperated to submit one
regional comprehensive plan. The Iowa Department of Natural
Resources (DNR) requires a solid waste comprehensive plan, and
regular updates to that plan, for every permitted solid waste disposal
facility. The last solid waste comprehensive plan update was completed
in 2008 and the next update is due in March 2011. Click here to view
the current comprehensive plan. The regional comprehensive plan is
focused on waste diversion activities and achieving the state's 50%
waste reduction goal, but also serves other important purposes.
The comprehensive plan defines the waste boundaries for the waste
facilities in our region. It is extremely important that the waste generated
within your jurisdiction go to your designated waste facility. Not only is it
state law through comprehensive planning rules, but the public waste
facility serving your area depends on that revenue to operate as well as
provide waste reduction programs. The waste reduction programs
offered in your area are summarized in the comprehensive plan. The
planning process to update the comprehensive plan helps to focus
efforts on successful programs and ways to improve those programs.
Your community participates in the comprehensive planning process by
providing responses to the Municipal Solid Waste & Recycling survey
sent by the DNR. Most of your communities also have representatives
that serve on your local solid waste commission/board, which
participates in setting waste reduction goals for the plan.
The ECICOG regional solid waste comprehensive plan serves as a
resource for waste and recycling activities affecting your communities. It
is also a great resource to find out what other communities are doing

Children and their parents learn the importance of water, the water
cycle, and why we need clean water during this fun and informative
program. This is the seventh year for ECICOG's regional summer
library education program. The number of residents reached through
this program has increased and is averaging 1,700 annually.

Fourth Annual Rummage in the Ramp
The Iowa City Landfill & Recycling Center is sponsoring the fourth
annual Rummage in the Ramp waste diversion and resale event at the
Chauncey Swan Parking Ramp Sunday July 25th through Monday
August 2nd.
During lease changeover, tons of useable
items are thrown in the trash. That stuff
shouldn't go to the landfill. Drop off usable
items instead of throwing them in the trash or
come shop and purchase what you need at
bargain prices. This is reduce and reuse at its
best!

Iowa City Drop-Off Recycling Program
All Johnson County residents are encouraged to recycle at these
locations.
The Iowa City Landfill and Recycling Center operates five drop-off
recycling locations across the city. In four years, the tonnage received
'! through the drop-off program has almost tripled!
Recently the City received a grant to continue improvements at these
sites. Improvements include color coded containers and signage
making it easier for residents to sort materials into the correct
container.

Solid Waste Agency Update
It is a busy start to the summer at the Cedar Rapids/Linn County Solid
Waste Agency. In addition to the Agency's usual recycling efforts,
several initiatives and education efforts are underway.
Biomass Wood Recovery Program
The effort to keep waste wood out of the landfill is getting help with the
"Biomass Wood Recovery Program." Most waste wood, like old
cabinets, shelves, pallets, and construction materials, can be recycled
and turned into fuel. Offered at the Cedar Rapids facility, 2250 A St SW,
the program not only helps keep reusable items out of the landfill, it is
less expensive for residents and contractors too. The tipping fee for
"Biomass" wood is $15/ton, versus $38/ton for a regular landfill load.

In the ongoing effort to help the community recover from the
devastating Floods of 2008, the Agency is being proactive in dealing
with the demolition of flood homes and their debris.

Wood harvest in process.
Recently, three flood homes were deconstructed in Cedar Rapids under
special guidelines. Crews took apart the homes using methods to
capture wood materials that met the Agency's wood fuel specifications.
They also tracked their time for comparison to typical demolition. The
results showed promise. Between 47% and 95% of wood was captured,
depending on the house. Time and cost was slightly higher than
average, however, based on the progress made with the three homes,
both time and labor became more efficient with each effort. Other
factors, like load contamination, are being addressed and future
research and planning is expected.
Student Tours
Students visit the Solid Waste Agency.
With help from the Department of Natural Resources, AmeriCorps
volunteers and Agency staff, the students learned what happens when
they "think" they are throwing garbage away. They saw firsthand there
really is no "away." Instead, they saw where more than 200,000 tons of
garbage ends up each year in Linn County alone. Students also learned
about the recycling options offered by the Agency and how to take that
information into their homes and help make a difference in keeping their
community clean and green.

A lot of new, young faces have been seen out at the Solid Waste
Agency facilities on County Home Rd. More than 1,200 in fact. Sixth
grade students from all of the middle schools in Cedar Rapids took field
trips to the landfill in May.

Benton County Solid Waste Disposal Commission received a Solid
Waste Alternative Program (SWAP) grant from the Iowa DNR to
promote school recycling. Schools received assistance with the
purchase of recycling containers and a flue-lesson educational unit was
presented to one grade level in each district.

28E Agreement Update
What were you doing in 1973? That's the year the Jones County Solid
Waste Management Commission was formed. Many things have
changed in the waste management and recycling industry since then.
To keep up with those changes the Commission has spent the last year
reviewing and updating their original organizational charter or a 28E
agreement. The revised 28E agreement is being approved by member
cities this summer, and will be filed with the Secretary of State this fall.

IWE Success Story
The Iowa Waste Exchange (IWE) was recently pleased to facilitate a
match between two worthy organizations that provide beneficial
services to Iowans. Danielle Allen, a procurement specialist for Options
of Linn County, contacted the Iowa Waste Exchange on March 2, 2010
regarding 6,700 buckets in need of a home. Options of Linn County is a
40-year old organization dedicated to providing work opportunities for
persons with disabilities. They employ over 350 individuals in Linn
County, and offer innovative and inexpensive services to business
seeking project assistance.
The 4-gallon buckets came complete with a metal handle and lid, and
had originally contained lengths of rope. The organization hoped that a
beneficial reuse could be identified for the buckets, since they did not
want to send them all to the landfill.
The Iowa Waste Exchange contacted the Cedar Valley Habitat for
Humanity's Restore to see if they'd be interested in a few of the
buckets. The Restore is a retail facility that accepts donations of new
and used building materials. These materials are either incorporated
into Habitat for Humanity building projects or sold to the public at a
discounted rate, with all proceeds going back into funds to build homes
for people in need. The Director of the Restore, Julie Palmer Nelson,
jumped at the opportunity to accept all 6,700 buckets. She explained
that her facility accepts donations of latex paint, which she then re-

manufactures to be sold at the Restore. The buckets from Options of
Linn County would be ideally suited to this purpose. In addition, the
buckets could be used for Habitat for Humanity home construction
projects.

SUMMARY OF DISCUSSION
Goding reported PATV won an award from the Hometown Video Festival sponsored by the
Alliance for Community Media for staff-assisted program called "Lesson One" on Braille
produced for the Old Capital Chapter of the National Association of the Blind. Hardy said that a
bill was introduced in the U.S. House of Representatives awhile back that would protect local
access channels. The bill now has 15 sponsors. Anew organization, American Community
Television, has been formed. It is made up of people who have been involved in lobbying on
community television issues in the past. Iowa City has joined the organization and given money
to support their efforts. Hardy said the City did not send letters regarding the CAP Act to Iowa
members of Congress in the past, but letters may need to be sent in the future. Hagen said that
the Commission might wish to contact the new superintendent and inform him of the potential
and opportunities the school district channel offers. Hardy said he will oversee preparation of a
short memo to the superintendent. Hoyland said he will be working with Ty Coleman to prepare
written materials for the school district's librarians explaining how they might utilize the school
channel. Hardy said Bergus has been added to the Triennial Review service committee. Hardy
said he hopes to send the service committee materials this week. Hagen noted that the Triennial
Review is over a year late. Hardy said it should be done shortly. Bergus asked if the
Commission would do another review in a year when it would be scheduled or three years after
the current review is finished. Hardy said there may be an option to conduct every 6 years and
he will look into that option. Hardy said Brau reviewed Mediacom's filing and found a number
of errors. Those errors miscalculated the maximum permitted rate too high by $0.50.
Mediacom subsequently refilled and corrected their errors but also included retransmission
consent fees, which they had not previously done. The new maximum permitted rate is $14.22
and the operator-selected rate is $12.95. Brau said that the basic tier rate in the unincorporated
areas of Johnson County is $25. Bergus said in North Liberty, which has a competitive operator,
the rate is around $17.

Bergus moved and Hagen seconded a motion to approve the amended May 24, 2010 minutes.
The motion passed unanimously.

Hardy referred to the complaint report in the meeting packet and said that all four complaints had
been resolved.
MEDIACOM REPORT
Hardy said Grassley informed him that he would be unable to attend the meeting. Hoerschelman
noted that there is an effort by the CEO to take Mediacom private. Brau said that the experts
cited in trade journals do not expect private ownership to have any impact on the operations of
the company. Hoyland said getting digital converter boxes for the school district will need to be
investigated. Hardy said he will ask Grassley about converter boxes for the schools.
UNIVERSITY OF IOWA REPORT
No representative was present.
KIRKWOOD COMMUNITY COLLEGE
Kirkwood provided a written report.
PATV REPORT
Goding reported PATV staff shot footage at Artsfest and will edit it into three or four programs.
Footage from Trekfest was recorded and there are plans to record Jazz Fest. A program created
in association with Access to Independence was recently completed. PATV won an award from
the Hometown Video Festival sponsored by the Alliance for Community Media for staff-assisted
program called "Lesson One" on Braille produced for the Old Capital Chapter of the National
Association of the Blind. The board of directors will meet July 15 at 7 p.m. The next guidelines
workshop will be July 11 at 2:30. Uptown Bill's will begin leasing the top level of the PATV
facility August 1. Construction work has already begun. PATV expects many of the programs
at Uptown Bill's to be carried on PATV.
SENIOR CENTER REPORT
No representative was present.
LIBRARY REPORT
Fisher reported that June is expected to be a slower month. Eight children's programs are
planned. In July fourteen children's programs are planned and four adult programs. Several
programs will be generated by the author in residence events.
ICCSD REPORT
Hoyland reported the schools had some equipment problems that have now been fixed. A couple
of the school district meetings had to be recorded using just one camera. Both the City High and
West High graduation ceremonies were recorded and cablecast on the school channel. Two new
programs, one from Twain and one from the City High parent organization, were generated by
the request for programs initiative. Hagen said that the Commission might wish to contact the
new superintendent and inform him of the potential and opportunities the school district channel
offers. Hardy said he will oversee preparation of a short memo to the superintendent. Hoyland
said he will be working with Ty Coleman to prepare written materials for the school district's
librarians explaining how they might utilize the school channel.
CITY CHANNEL REPORT
Hardy reported that next Community Voice IC People program will feature a woman who has
become a Catholic priest. The At Home program has featured all City Councilors except Ross
Wilburn. After all City Council members are recorded other local city officials may be
interviewed. The Johnson County Historical Society is this month's notable nonprofit. The
Iowa City Pride festival will be featured on the Community Voice. The Community Television
Service recently recorded programs on Alzheimer's for the AARP and a program for the
National Alliance for the Mentally Ill. Agrant-writing workshop presented by the Community
Foundation will be recorded in the near future. The Media Unit recorded another episode of the
police program, Community Beat, the Human Rights Commission Youth Human Rights Awards,
a program on riding the bus, and the ground breaking ceremony for the eastside recycling center.
An interactive computer application created for the Housing Authority and the Iowa City
Association of Realtors that instructs potential home buyers on how to qualify for loans was
recently completed. It is based on a series of video programs previously produced. An
application for the Google infrastructure initiative has been filed. The organization's website is
icabc.org. Bergus noted that the City of Detroit filed a lawsuit challenging Michigan's state
franchising law.
STATE LEGISLATION
Hardy said he has asked the legal department to determine if Iowa City would be protected from
losing its municipal franchise if a competitor indicates an intent to provide service.
