Re: Temporary Commercial Activities Near Kinnick Stadium
On football Saturdays there is a myriad of activities on the streets and properties surrounding
the stadium. Although some of these activities are commercial rather than residential in
character, for the most part they have been limited to Melrose Avenue and are tolerated by the
surrounding neighborhoods. The City has not intervened and had no intention of doing
otherwise during the 2010 football season. However, the movement of the Magic Bus into the
neighborhood south of Melrose, and the improvement of the former site of the Magic Bus by the
Stadium Club for commercial use, including paving and fencing of the site and the dispensing of
alcohol, raises issues the City must address.
The new location of the Magic Bus is no longer on an arterial street and has limited pedestrian
and vehicular access, of concern to both the neighborhood and the fire and police departments.
The existing pedestrian access easement by which many patrons will access the Magic Bus
was intended for residential use and the property owner objects to its use for this purpose. The
intensive use heightens the neighbors concerns about noise and security. Additional detail is
outlined in the Building Official's denial, issued today, of the application for a temporary use
permit for the Magic Bus. A copy of that denial is attached.
The yards of the properties located at 817 Melrose and 5 Triangle Place have been paved,
fenced, and advertised for lease as parking spaces. The City has notified the property owner
that the use of the property as a year round commercial -parking lot is not permitted. Three
individuals -Chris Querrey, James Clark and Tracy Barkalow -propose to operate a
commercial venture called the "Stadium Club" on these properties during home football games.
They have recently filed an application for a Temporary Use Permit, a copy of which is attached,
and have begun the process to obtain a liquor license. Absent an extension, the Building
Official's decision on this application will be made next week.

Re: Magic Bus Temporary Use Per t Decision
The purpose of the Temporary Use Permit Regulations is to allow short-term and minor
deviations from the requirements of the Iowa City Code which are truly temporary in nature (i.e.,
can be terminated and removed immediately with no permanent improvements to a site) and will
not adversely impact the surrounding area and land uses.
The Magic Bus owned and operated by the Iowa City Ducks Rugby Football Club has requested
from the City a temporary use permit to locate their football game tailgating venue from 817
Melrose Avenue to 101 Woodside Drive. The proposed location is within a parking lot in a
residential neighborhood that is zoned for residential use.
Any temporary use by law must meet the following approval criteria:
1. Must be temporary in nature and not continue for more than the time specified; and
2. Will not necessitate permanent improvements to the site; and
3. Must be located on a site physically suitable for the type and intensity of the proposed
use; and
4. Must be compatible with uses on the site and existing uses in the general area; and
5. Must provide adequate public and private utilities to ensure the temporary use will be not
detrimental to the public health and safety; and
6. Must provide for adequate public and emergency access to the temporary use; and
7. Must mitigate any impacts of the proposed use.
Based on review of the information and documentation submitted by the Magic Bus organization
and from residents of the neighborhood surrounding the proposed site, I have reached the
following conclusions:
1. The Magic Bus tailgating venue proposal would be temporary in nature and only occur
during home football games.
2. The Magic Bus venue proposal would not necessitate any permanent improvements to
the site. The event set-up and tear-down would occur only on game days.
3. The site is not suitable for the type and intensity of the Magic Bus event. The proposed
site is within a residential neighborhood without frontage on a public street and located
on a dead-end private drive. The site's primary pedestrian access from Melrose and the
football stadium is across private property. The owner of that property, across which the
majority of Magic Bus patrons will cross, has strenuously objected to his property being

used for this purpose. Both Iowa City Police and Fire Departments have expressed
serious concerns regarding the lack of adequate public and emergency access to the
site. The site's lack of boundaries raises crowd control issues for the neighborhood that
have not been adequately addressed and are a major concern to the residents. A
majority of the neighboring residents have signed a petition objecting to the Magic Bus
venue being located in their neighborhood. At a public meeting held on July 20, 2010 at
the Iowa City Public Library, representatives of the .neighborhood stated, "The Magic
Bus, a venue for large crowds, free alcohol, and amplified music, would strain our
neighborhood on days when it is already stretched far beyond the capacity for safety. As
a neighborhood, we work diligently to help provide order... it has been and continues to
be our goal to establish afamily-friendly tailgating atmosphere. We believe that the
addition of the Magic Bus and the rowdiness associated with it would seriously impair
this goal, which we consider to be in the best interest of both the neighborhood and
wider community. This statement was also provided by petition which was signed by
abutting property owners and almost all the residents along Olive Court.
4. The Magic Bus proposal is a commercial venue within a residential neighborhood
providing amplified music, large crowds, and free alcohol. Most of the neighbors living in
the area have strenuously objected to the Magic Bus venue being located in their
neighborhood. The Magic Bus venue and associated activities are not compatible with
existing uses in the general area as evidenced by the lack of neighborhood support.
5. The site does not have public street access, and access is very difficult during game
days. As mentioned above, both the Iowa City Police and Fire Departments have
determined that the site does not have adequate public and emergency access. This is a
serious public safety concern.
6. The impacts of the temporary use have not all been mitigated. As expressed by
residents in the neighborhood, the Magic Bus has not adequately addressed issues of
amplified music, crowd control, intoxicated behavior, and the garbage that will occur as
Magic Bus patrons move back and forth through the neighborhood in order to access the
Magic Bus venue.
Based on the above, I find that the issues raised by the neighborhood relate directly to the lack
of compatibility of the Magic Bus tailgate party event with the residential character and the rights
of the residents. Residents of the neighborhood have strenuously objected to the Magic Bus
being located in their neighborhood and creating problems that they as a neighborhood have
been working to control. In addition, the Police and Fire Departments have determined that the
proposed site has serious emergency access issues. Notwithstanding the Magic Bus
organization's intention to run a good tailgate party, I find that the Magic Bus event will have an
adverse impact on the surrounding area and land uses; therefore, the Magic Bus temporary use
permit is denied.

The Stadium Club: Operational Plans
1. Mission Statement
a. To provide a safe, secure and enjoyable live music entertainment option
during University of Iowa home football games. To create a fun, lively
atmosphere for all fans. The Stadium pledges to commit all net proceeds
to local charitable organizations each week.
2. What is the Stadium Club?
a. Owners

b. Location
i. The Stadium Club is an event open to the public at 817 Melrose
Ave. and 5 Triangle Place in Iowa City, IA.
ii. A six-foot high fence is installed around the entire perimeter of the
Stadium Club premises to deter unwarranted access.
iii. There will be two entrances/exits, both on public thoroughfares.
1. Primary Entrance: Melrose Ave. to the North.
2. Secondary Entrance: Triangle Place to the East.
Hours of Operation
i. During home football games commencing at 11:00 AM, the
Stadium Club will open at 8:00 AM and will close approximately
two hours after the end of the game.
ii. During home football games commencing at 2:30 PM, the Stadium
Club will open at 8:00 AM and will close approximately two hours
after the end of the or upon dusk, whichever occurs first.
iii. For 10/02/2010, Penn State at 7:05 PM. The Stadium Club will
open at 11:00 AM and Close at the end of the game.
iv. We will be onsite Friday afternoon and evening before home
games for setup and Sunday mornings for cleanup.
v. The Stadium Club will not be in operation for University of Iowa
away football games.
3. Operational Summary
a. Security... Who gets in?
i. The Stadium Club will be open to only those of legal drinking age
and older. NO ONE under 21 will be allowed inside the Stadium
Club.
ii. We will have wristbands identifying patrons whose id has been
checked at the door. Theses wristbands will change each week to
prevent fraudulent entry.
iii. A camera system will be employed to match each and every ID
checked to the person who displays it. We will be vigilant in
denying ID's that appear to be fake or misleading.
iv. Persons found to be inside under false pretense or those without a
wristband will be asked to leave premises.
v. We will employ approximately 15-20 security personnel who will
be aptly identified as such by uniform.
4. What goes on inside the Stadium Club?
a. We will provide live musical entertainment for the duration of the pre-
game and post-game hours of operation.
b. Televisions will be located throughout the premises for watching the game
as it happens.
c. Tap beer will be provided free of charge to all who enter.
d. The distribution of beer will be limited to one cup, one person and staff
will be responsible for dispensation.
i. To be clear, the beer taps will be behind a barrier and all
dispensation will be monitored and administered by staff.
ii. Anyone who appears intoxicated will either not be let onto the
premises in the first place or will be given a full refund and asked
to leave the premises.
5. Operating Costs
a. Gate proceeds will pay for band fees, security, sound equipment, rent,
liability insurance and other expenses such as cups and C02.
6. Cabanas
a. Cabanas can be rented for corporate or individual entertainment hosting.
7. Restrooms
a. We will be contracted with Port o Johnny of Hiawatha to provide
necessary restroom facilities. We anticipate the need of 12-15 units.
8. Stage
a. The City of Coralville's Showcase stage has been reserved for use as the
stage facilities.
9. Sponsors
a. Billion Automotive of Iowa City
b. Voss Distributing
c. Fleck Sales
d. Carl & Ernie's Good Time Pub
10. Charities
a. 100% of all net proceeds will be donated.
b. Local charities such as United Way of Johnson County, Big Brothers Big
Sisters, Reach for Your Potential, University of Iowa Children's Hospital -
Touchdowns for Kids, Systems Unlimited and the local humane society
will be targeted for monetary donations.
11. Insurance
a. Terry McDonald of AW Welt Ambrisco is the insurance agent for the
Stadium Club. He can be contacted for any questions at 887-3700.
12. Summation
a. The Stadium Club's main entry point is directly across from Kinnick
Stadium on Melrose Ave.
b. The entire perimeter will be fenced off with brand new chain link fencing
that is over six feet high.
c. 817 Melrose has been the site of similar events for nearly two decades.
d. We will abide by all local and state regulations regarding the distribution
of alcohol. We intend NOT to allow any person under legal drinking age
onto the premises.

Re: Rummage in the Ramp - 2010
Rummage in the Ramp 2010 will be held in the lower level of Chauncey Swan Parking Ramp
from Sunday, July 25 through Monday, August 2. This is the fourth year for the event which was
introduced as an effort to keep discarded household items out of the Iowa City Landfill and
recycle the items to households who could reuse them. The event is always scheduled in late
July/early August, when annual lease turnovers occur. Other goals of the project include:
• Improving neighborhood relations between single-family homeowners and renters
• Utilizing the sales events to provide a way for low-income families to purchase furniture and
household goods
• Creating a fundraiser for local environmental groups and human service agencies
• Reducing the workload of City refuse workers and private waste haulers
In 2007, 10 non-profit agencies volunteered to help staff the event. Last year, the number
increased to 22, and this year, we will have 29 agencies participating. These volunteers help
raise funds for their organizations by splitting the profits from Rummage in the Ramp sales. In
2009, they divided almost $14,000.
Last year, about 24 tons of items were donated, including furniture, clothes, household items,
books, toys, and non-perishable food. Most items were priced at $1, $5, $10 and $20. This
summer, we'll be accepting the same types of items and will set pricing similarly to last year.
We currently have six sponsors in addition to the City:

Hy-Vee
Ultimately, we feel that this event has been a huge success and expect that it will be even
bigger in 2010. We are beginning to receive some press about the event and hope to capitalize
on that to help encourage the public to reduce, reuse, and recycle, not only for Rummage in the
Ramp, but year-round. We encourage our City Council members to participate in the event,
either by donating household items you no longer need, or by stopping by during sales hours to
find great bargains and get afirst-hand look at how this event works.

No matter what you're looking for to furnish your home or apartment, there's a good chance
you'll find it at Rummage in the Ramp, the giant, nine-day garage sale extravaganza that gets
underway this weekend. This is the fourth year for the event, which is organized by the City of
Iowa City to help reduce the volume of furniture and household goods that are discarded each
summer as people move out of their apartments.
The program encourages tenants to donate, rather than throw away, their still-usable items,
which are then offered for sale at Rummage in the Ramp at bargain-basement low prices. The
event not only helps reduce the amount of waste going into the landfill by encouraging the
practices of reduce /reuse /recycle, but also provides glow-cost way for incoming students and
other residents to purchase items they need for their home. Rummage in the Ramp also serves
as a fundraiser for local nonprofit organizations that help staff the event and then split the profits
at the end of the sale. Most items are priced at $1, $5, $10 and $20.

-- Electronic items will be accepted for a fee of $5 per item. The fee will cover the costs of
disposal in case the items do not sell. Electronics contain lead and other substances which are
harmful to the environment if disposed of improperly. Computers, monitors, printers, TVs,
stereos, copiers, cables, networking hardware, and other small electronic items are included on
this list.
-- Volunteers will be on hand to visually inspect and help unload your donated items. If your item
is beyond reuse, it will not be accepted.
-- Donated items are tax-deductible, so remember to ask for a receipt!

River Crossings
• Due to the lack ofobligation' designation from FEMA we have curtailed the design and
construction of replacement of two 12" river crossing repairs (Old Plant and Hwy 6).
• Howard R Green Consultants (HRG) has submitted a draft of scope of services for
design, bid specifications and inspection of the interim project to repair and support the
undermined sections of the two existing 12" water mains.
• The original PW which included interim repair was de-obligated on 7/9/10.
• Anew PW which includes replacement of the two water mains was signed on 7/9/10.
• Congress voted to replenish the FEMA Disaster Relief Fund (DRF) as part of the
Supplemental Appropriations Act for FY2010.
• A meeting with FEMA staff regarding the status of this project is being set up by the
Water Division and Ron Knoche.
Peninsula Source Protection
• The HRG Hazard Mitigation Study is the source of planning for proposed funding and
projects on the peninsula site and the plant site improvements.
• The PW and Hazard Mitigation Plan for peninsula work; CW 3, CW 4, SW 4, JW 2 and
the respective electrical systems has been 'obligated' by FEMA.
• Plans and Specifications for the Hazard Mitigation projects are being scheduled for
public hearings with the City Council in order to put them out for bid. The proposed
schedule will have the projects completed by 12/31/10.
• A City Floodplain Development Permit Application was approved by Julie Tallman with
HIS for the project(s).
• City Council voted to award a contract to Price International Electric, Inc. on 7/12/10.
Notice to Proceed is scheduled for 7/26/10 with project completion scheduled for
12/31/10.
• Apre-construction meeting was held on 8/28/10 with the general contractor, consulting
engineers and Water Division staff.
Water Works Prairie Park Source Protection
The HRG Hazard Mitigation Study is being used for additional funding requests for
hazard mitigation for plant site well houses.
We have received notice that the FEMA funding application has been approved. We are
awaiting the funds to be approved by Congress.
David Purdy and Sara Sproule attended a Grant Pre Award Meeting in Urbandale on

Congress voted to replenish the FEMA Disaster Relief Fund (DRF) as part of the
Supplemental Appropriations Act for FY2010.
A meeting with David Purdy and Sara Sproule and the Water Division has been set for
next week to discuss FEMA fund tracking for this project.
PLANNING AND COMMUNITY DEVELOPMENT
Last week, the City acquired one more property (704 Manor Drive) with CDBG funds. The City
has acquired a total of 51 residential properties and 16.5 acres of property from Parkview Church
along Taft Speedway with Federal and State funds. Of the 51 properties, 32 of the properties
have been acquired through the Hazard Mitigation Grant Program, 13 with Community
Development Block Grant (CDBG) funds, and six with Community Disaster Grant (CDG) funds. A
total of 38 properties have been demolished in the Parkview Terrace and Taft Speedway
neighborhoods. All structures in the Showers Addition have been demolished and cleared.
• On July 26th, staff presented to the Planning & Zoning Commission on flood recovery efforts. The
presentation included updates on infrastructure projects, housing acquisition, housing
replacement, residential assistance, and business assistance.
• Staff is preparing a grant application to the I-JOBS II program for the
Baculis/Thatcher/Commercial Court levee. The application is due August 2"d
• Staff is continuing work on an application to fund a tornado safe room near the Public Works
building in Napoleon Park. The park is heavily used during the summer. The safe room would
protect park users against high winds and tornados.
• Staff continues to review Jumpstart applications for disbursing State Jumpstart 2 and State
Jumpstart 3 funding for housing rehab/repair, down payment assistance and interim mortgage
assistance. A total of $1.84 million in State Jumpstart funding has been used to assist 77 flood-
impacted residential households and $861,000 in Federal Jumpstart funding has been used to
assist 17 households.
• The City continues to accept applications for the following disaster business assistance
programs: Loan Interest Supplement Program, Residential Landlord Business Support Program,
Commercial Rental Revenue Gap Program, Equipment Reimbursement Assistance Program,
Flood Insurance Reimbursement Program, and Expanded Business Rental Assistance Program.
The deadline for all business programs is now December 31, 2010.

The Iowa City Police Department would like to remind citizens that the "27th Annual National
Night Out" (NNO) crime and drug prevention event is scheduled for Tuesday, August 3rd.
National Night Out, which is sponsored by the National Association of Town Watch (NATW) and
co-sponsored locally by the Iowa City Police Department, will involve over 14,625 communities
from all 50 states. In all, over 36.7 million people are expected to participate in 'America's
National Night Out Against Crime'. NNO 2010 is being supported in part by Target, a national
corporate sponsor, and Iowa City Area Crimestoppers.
National Night Out is designed to: (1) Heighten crime and drug prevention awareness; (2)
Generate support for, and participation in, local anticrime efforts; (3) Strengthen neighborhood
spirit and police community partnerships; and (4) Send a message to criminals letting them know
neighborhoods are organized and fighting back.
From 7 to 10 p.m. on August 3rd, residents in neighborhoods throughout Iowa City and across
the nation are asked to lock their doors, turn on outside lights and spend the evening outside
with neighbors and police. Many neighborhoods throughout Iowa City will be hosting a variety of
special events such as block parties, cookouts, visits from the police, flashlight walks, contests,
and youth activities.
lawn City Police Officers will be attending all registered parties to meet neighbors and handout
safety information. Officers will also be handing out special gifts to children, provided by Target
and Crimestoppers. Each registered block party will receive a guest appearance from local
celebrities, arriving by limousine.

Chair Briggs called the meeting to order at 6:02 p.m.
PUBLIC COMMENT OF ITEMS NOT ON THE AGENDA: Kelsey Kramer introduced herself to Commissioners.
Kramer is the AmeriCorps with the University of Iowa Center for Human Rights. Lubaroff spoke briefly on
discussions Commissioners have after meetings particularly after the May meeting. Lubaroff feels that the
Commission should do a better job of not discussing matters/opinions post meeting.
CONSIDERATION OF THE MINUTES OF THE June 15, 2010 MEETING:
Lubaroff, moved to approve.

CORALVILLE 4th FEST PARADE REPORT

ADA TRAINING
ADA training will be held on October 6tH. There is a morning and afternoon session. Cuttell will cover the
morning and Lubaroff will do the afternoon.
STRENGTHENING LATINO/A COMMUNITIES PROGRAM
Commissioners asked that this item be deferred to the August meeting when more Commissioners will be
present.
SUBCOMMITTEE UPDATES
Cuttell (Gathua, Day) reported that the program on immigration has been deferred. Subcommittee members
have instead focused their efforts on the Speaker's Bureau. Spears (Lubaroff, Mena-Carrasco) reported that
subcommittee members still hope to be able to create a program on bullying this year. Briggs (Cowen, Stoglin)
reported that subcommittee members are trying to find a replacement day and time for the program they have
been planning for sometime.

REPORTS OF COMMISSIONERS
Cuttell mentioned a program being held at the Iowa City Public Library-Gregory Boyle a Catholic Priest who
will speak on his work with gangs in Los Angeles. Lubaroff reminded Commissioners of the ADA 20tH
Anniversary Observation being held on July 24tH. Lubaroff also spoke of her volunteer work at the Broadway
Neighborhood Center. Gathua reported on a fundraising project her non profit is holding entitled Project Cans
for Girls. In addition, Gathua reminded Commissioners that small acts of kindness truly do make a difference in
people's lives. Spears commented that she will be participating in a Cancer Awareness Walk in San Francisco
in October. She will be walking 60 miles over two days to raise funds for cancer research.

Re: Investigation of PCRB Complaint #10-01
This is the Report of the Police Citizens Review Board's (the "Board") review of the
investigation of Complaint PCRB#10-01(the "Complaint").
BOARD'S RESPONSIBILITY
Under the City Code of the City of Iowa City, Section 8-8-7B (2), the Board's job is to review the
Police Chiefs Report ("Report") of his investigation of a complaint. The City Code requires the
Board to apply a "reasonable basis" standard of review to the Report and to "give deference" to the
Report "because of the Police Chiefs professional expertise", Section 8-8-7 B (2). While the City
Code directs the Board to make "Findings of Fact", it also requires that the Board recommend that
the Police Chief reverse or modify his findings only if these findings are "unsupported by
substantial evidence', are "unreasonable, arbitrary or capricious" or are "contrary to a Police
Department policy or practice, or any Federal, State or local law", Section 8-8-7 B (2) a, b, c.
BOARD'S PROCEDURE
The Complaint was initiated by the Complainant on February 11, 2010. As required by Section 8-
8-5 (B) of the City Code, the Complaint was referred to the Chief of Police for investigation.
The Chief s Report was completed on May 10, 2010 and was filed with the City Clerk on May 10,
2010.
The Board met to consider the Chiefs Report on May 11, 2010, July 13, 2010 and July 21, 2010.
At the May 11~' meeting the Board voted to review the Chiefs Report in accordance with Section 8-
8-7 (B) (1) (d), Request additional investigation by the Police Chief or City Manager, or request
police assistance in the Board's own investigation.
FINDINGS OF FACT:
On February 6, 2010 at 2342 hours, Officer A responded to a fight call at the VFW on Highway 6
West as a backup officer. When he arrived, he noticed the complainant being lead away by other
people. He described her as being very agitated, yelling profanities, and displaying obscene
gestures. Officer A believed that she was involved in the fight call. Officer A grabbed hold of her
arm to place her under arrest and she resisted this and failed to place her hands behind her back.
Officer A then grabbed both arms and placed her in handcuffs. Complainant was charged with
Disorderly Conduct and Interference with Official Acts.
ALLEGATION:
Complainant alleges that Officer A used excessive force while placing her under arrest.
An investigation was conducted with video/audio recordings and interviews of the officers
involved. Complainant was contacted and agreed to an interview on February 23, 2010, but failed
to make the appointment. She also failed to respond to future requests to meet. Witnesses were
identified and contact was initiated by the investigators but no response was received.
The audio portion of the incident was reviewed and Complainant could be heard yelling when
Officer A arrived. Officer A instructed the Complainant a number of times to put her hands on the
car, and later to put her hands behind her back. There is no indication of profanity from Officer A.
There is also no indication that Complainant's head was hit against the car. No sound or indication
of camera movement was detected. At no time does Officer A say that he is"going to make an
example out of her," as she claims in her statement. Complainant claims that her rights were never
read to her. Officer A did not question Complainant about the incident so Miranda Rights were not
necessary. Upon reviewing the video/audio portions and interviews with Officers involved, there is
no evidence that excessive use of force was used. NOT SUSTAINED
