Comment: Included on the recent assessment schedule adopted on July 12, 2010 was a bill for unpaid snow removal costs at 731 Bowery Street. PLANNING AND ZONING MATTERS. a) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR AUGUST 31 ON AN ORDINANCE AMENDING THE ZONING CODE, SECTION 14-36-1 HISTORIC DISTRICT OVERLAY ZONE; SECTION 14-8E-2, HISTORIC REVIEW; SECTION 14-8E-3, CERTIFICATE OF ECONOMIC HARDSHIP; AND SECTION 14-2B-6, MULTIFAMILY SITE DEVELOPMENT STANDARDS TO CORRESPOND WITH AMENDMENTS TO THE HISTORIC PRESERVATION HANDBOOK Comment: At its August 5 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval. Staff recommended approval in a memo dated July 15. The Historic Preservation Commission voted 9-0 (Thomann absent) to approve these amendments at its May 13 meeting. ADOPTING AMENDED FY11 ANNUAL ACTION PLAN WHICH IS A SUB-PART OF IOWA CITY'S 2011-2015 CONSOLIDATED PLAN (CITY STEPS) AND AUTHORIZING THE CITY MANAGER TO SUBMIT SAID AMENDED PLAN TO USE CDBG DISASTER RECOVERY PROGRAM INCOME FOR THE WEST SIDE LEVEE. Comment: This is a public hearing and resolution regarding an amendment to the FY11 Annual Action Plan to use approximately $1.9 million in anticipated CDBG Disaster Recovery Housing Fund program income, along with anticipated I-Jobs funds, to construct a levee between McCollister Boulevard and the Crandic Railroad tracks along the west side of the Iowa River to protect businesses and two mobile home parks. A 30-day public comment period ends on August 17, 2010. HCDC in the future will make a recommendation to Council on the use of the remaining funds, and Council will hold a public hearing on the proposed use. Currently the fee is $15.00 per month; the increase would change the fee to $15.50, effective on the first full billing sent after the adoption and publication of this ordinance. This action is necessary due to annual increases in operational costs. CONSIDER AN ORDINANCE AMENDING TITLE 17 OF THE CITY CODE, ENTITLED "BUILDING AND HOUSING," CHAPTER 1, ENTITLED, "BUILDING CODE," SECTION 3, ENTITLED "AMENDMENTS TO CODE," TO DELETE SECTION 313 OF THE INTERNATIONAL RESIDENTIAL CODE. (FIRST CONSIDERATION) Comment: The City adopted the 2009 edition of the International Residential Code ("IRC") on December 1, 2009. With limited exception, the local amendment to section 313 of the IRC required that townhouses and one and two family occupancies protect lightweight materials such as trusses or engineered lightweight material in the structural floor or ceiling areas. This past spring, the Greater Iowa City Area Home Builders Association ("Home Builders") and truss manufactures raised issues concerning the implementation of this life safety requirement. In June Council amended the code to change the effective date to January 3, 2011 to allow a committee comprised of staff, the Home Builders, the truss manufacturing industry, area fire departments, and others time to discuss the issue. This committee has met, and there was a consensus that this matter should wait until the adoption of the 2012 edition of the IRC. The Board of Appeals recommends that Council delete Section 313, and the minutes from August 2 meeting containing the recommendation are in the Information Packet. ~~ G v~~ Action: ~5 / ~c-V'~'~- Gt/r%b u r~r ~ ITEM 11. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY i a- 3~.3 CLERK TO ATTEST AN AGREEMENT WITH THE IOWA DEPARTMENT OF CULTURAL AFFAIRS FOR A GRANT FROM THE IOWA GREAT PLACES PROGRAM. Comment: This agreement will provide a $70,000 grant from the Iowa Great Places Program for extending the Iowa Avenue Literary Walk into the North Side Marketplace. The project will be constructed in spring of 2011 as part of the reconstruction of the North Side Marketplace streetscape. A memorandum from staff is enclosed. Action: +" ~,$~ ~~ ITEM 12. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN THE CI ~o- 3~y- CLERK TO ATTEST A GRANT AGREEMENT WITH THE IOWA DEPARTMENT OF TRANSPORTATION (IDOT) FOR EXTENDING THE COURT HILL TRAILS PROJECT ALONG RALSTON CREEK IN EAST IOWA CITY TO WINDSOR RIDGE. COURT HILL TRAIL PROJECT PHASE THREE. Comment: In January 2010, the City of Iowa City was awarded $416,159 of the National Recreation Trails (NRT) Program of the Iowa Department of Transportation to construct a recreational trail extending the Court Hill Trail approximately 3,950 feet following Ralston Creek in East Iowa City into the Windsor Ridge neighborhood. This resolution authorizes the Mayor and City Clerk to sign said grant agreement, which is required by the IDOT before the grant funds are released. Comment: This agreement authorizes Snyder and Associates Professional Engineers to provide design engineering services related to the construction of the Terry Trueblood Recreation Area Phase Two improvement project. This project will include construction of north access drive, cul-de-sac parking, boat trailer parking, boat ramp, marina facility and shelter, utilities and seeding. The total cost of the engineering services is $97,500. This project will be funded by GO Bonds. Action: ITEM 14. It is referred to as non-competitive because the City did not have to apply for the funds; the legislature appropriated the funds specifically for the project. Comment: This agreement will allow the University of Iowa to erect a flood protection wall within the Riverside Drive public right-of-way to protect the University's Art Building West if the Iowa River water levels rise above flood stage and threaten damage to the building. The agreement also allows the University to reconstruct the sidewalk and infrastructure facilities located within the Riverside Drive public right-of- way in order to support said flood protection wall. CONSIDER A RESOLUTION ADOPTING AN ASSESSMENT SCHEDULE OF ~o_ ,379 UNPAID MOWING, CLEAN-UP OF PROPERTY, SNOW REMOVAL, SIDEWALK REPAIR, AND STOP BOX REPAIR CHARGES AND DIRECTING THE CLERK TO CERTIFY THE SAME TO THE JOHNSON COUNTY TREASURER FOR COLLECTION IN THE SAME MANNER AS PROPERTY TAXES. Comment: The City has the authority under Iowa Code §364.136 to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. This assessment is being pursued only after the City took many steps to resolve the matter. The City notified the home owners to abate the nuisance (for example, to remove snow from the sidewalk) and after the home owner did not take action to abate the nuisance,, the City abated the nuisance and billed the owner. After being billed at least twice, these owners still have not paid the abatement costs. The City has sent a letter to the home owner giving them notice that this resolution would be on the agenda, a copy of which is attached to the resolution. No interest will be charged if the owner pays within 30 days of the first required publication. Attached as an exhibit to the resolution is a list of the properties that will be assessed and the amount that will be assessed.
